DECLARATION
of 21 December 2005
amending Decree No 673 / 2004 Coll., laying down rules for the organisation of the gas market
The Energy Regulatory Authority (hereinafter referred to as "the Authority ') provides, pursuant to Article 98 (7) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the amendment of certain laws (Energy Act), as amended by Act No. 670 / 2004 Coll., for the implementation of § 17 (7) (e) and (k) of the Energy Act:
Decree No 673 / 2004 Coll., laying down rules for the organisation of the gas market, is amended as follows:
1. In the last sentence of Paragraph 1, the words "the method of balancing, evaluating and settling derogations' are replaced by the words" the rules for the production, assignment and use of gas supply diagrams'.
2. in Article 2 (r), the word "gas' is replaced by" transport or distribution ';
3. In Article 2 (t), the words "flow value, which is" shall be replaced by the words "quantity of gas which";
4. in Paragraph 2 (v):
"(v) the balancing point - the place in which the balance sheet deviation from the relevant gas day or gas month is subsequently settled;"
5. in Section 2, the following points (w) to (y) are added:
"(w) standard type diagram - sequence of relative shares of each daily gas consumption of the relevant end-customer group defined by the supply type diagram class at planned annual consumption;
x) recalculated type diagram - standardized type diagram converted into actual climatic conditions on gas day,
(y) the supply type diagram class - a summary of the characteristics of the sampling points to which the same delivery type diagram is assigned. ';
6. Paragraph 3 (2) reads as follows:
"(2) Within the gas market, all time data are given in valid time in the Czech Republic. '
7. in Article 4 (6) (c) and (d):
"(c) a monthly contract for the transport of gas with fixed capacity; the contract is concluded for 1 to 12 months; the contract is always concluded with effect from the first gas day of the following calendar month,
(d) a monthly gas contract with interruptible capacity; the contract is concluded for 1 to 12 months; the contract shall be concluded with effect from the first gas day of the following calendar month; when entering into a contract, the transmission system operator shall identify the balance sheet entity with the size of the uninterruptible part of the capacity, in respect of the interruptible part of the capacity with the manner, time and conditions of limitation or interruption of the gas transport, the manner and conditions of notification of restrictions or interruptions and the maximum frequency of restrictions or interruptions over the duration of the contract. ';
8. In Article 5 (1), the words "the beginning of the gas year, with the exception of the opening dates of the gas market under Article 55 of the Act, and 'are replaced by the words" the first gas day of each calendar month except'.
9. Paragraph 5 (2) is deleted.
Paragraphs 3 to 13 shall become paragraphs 2 to 12.
10.Paragraph 5 (3) reads as follows:
"(3) A request for a reservation of transmission capacity for 1 year or more shall be submitted by the user to the transmission system operator no later than 30 calendar days before the start of the first gas day of the calendar month when the gas transport is to start under the gas contract. The transmission system operator shall evaluate the requests received and report the results of the reservation of annual and multiannual transmission capacities to all applicants no later than 20 calendar days before the start of the first gas day of the calendar month when the gas transport is to start under the gas contract. ';
11. in Article 5 (6), "paragraph 5" is replaced by "paragraph 4."
12. in Article 5 (6), "paragraph 6" is replaced by "paragraph 5";
13. in Article 5 (8), "paragraphs 3 to 8" is replaced by "paragraphs 2 to 7."
14. in Paragraph 5 (8), "paragraph 6" is replaced by "paragraph 5";
15. in Article 5 (10), "paragraph 4" is replaced by "paragraph 3";
16. in Article 5 (10), "paragraphs 1 and 2" shall be replaced by "paragraph 1";
17. Paragraph 5 (11) reads:
"(11) The transfer of reserved transmission capacities shall be determined by the transmission system operator's order. The transfer may take place only on the first day of the calendar month.
18. in Paragraph 6 (1), "paragraph 11" is replaced by "paragraph 10."
19. Paragraph 7 (1), including footnote 2, reads:
"(1) The prices for the transport of gas shall be determined by the Authority in accordance with the procedure laid down in the specific legislation2).
2) Annex No 10 to Decree No. 438 / 2001 Coll., laying down the content of economic data and the procedures for regulating prices in energy, as amended. '
20. in Paragraph 7 (3), the words "point of entry into the transmission system or" shall be deleted.
21. in Paragraph 8 (c):
"(c) the numerically indicative size of the technical, overall negotiated and free transmission capacity for all pairs of entry points into and exit points from the transmission system; the total contracted and free transport capacity shall be published under the conditions of at least three transporters who have a gas contract drawn up to a given pair of entry and exit points. ';
22. in Paragraph 9 (3), including footnote 3:
"(3) In the case of sampling points equipped with measurements of type A and B of the category of wholesale and medium customers (3), the gas distribution contract shall specify the maximum daily quantity directly agreed.
3) Paragraph 3 of Decree No. 329 / 2001 Coll., which sets out the conditions for connection and supply of gas to protected customers. '
23. Paragraph 13 (1), including footnote 4, reads:
"(1) The prices for gas distribution shall be determined by the Authority in accordance with the procedure laid down in the specific legislation4).
4) Annex No 12 to Decree No. 438 / 2001 Coll., laying down the content of economic data and the procedures for regulating prices in energy, as amended. '
24. in Paragraph 13 (3):
"(3) Where the authorised customer at whose sampling point the measurement type A or B is installed exceeds the distribution capacity at the sampling point by more than the allowed tolerance by the Authority, the distribution system operator shall charge for the sampling point for the excess distribution capacity. ';
25. Paragraph 14 (2) reads:
"(2) For the purpose of transporting gas to the underground gas storage tank when importing gas into the Czech Republic via the transmission system, the virtual entry point of the relevant underground gas storage tank shall be located at the point of entry of the imported gas into the transmission system."
26. In Paragraph 14 (4), the word "each 'is replaced by the word" competent'.
27. in Paragraph 14 (8) (b):
"(b) an intermittent gas storage contract; the contract shall be concluded for at least 1 month with effect from the first day of the gas day of the specific month. ';
28. Paragraph 15 (3) is deleted.
Paragraphs 4 to 11 shall be renumbered paragraphs 3 to 10.
29. in Article 15 (4), "paragraph 4" is replaced by "paragraph 3";
30. In Article 15 (6), the words "broken down into each month of the storage year and the operating volume 'are deleted.
31. in Article 15 (8), "paragraph 4" is replaced by "paragraph 3";
32. in Article 16 (c):
"(c) the size of the technical, total and free storage capacity of the relevant virtual gas storage tank; the total negotiated and free storage capacity shall be published on the basis of at least three users who have a gas storage contract in the relevant virtual gas storage tank. ';
33. in Paragraph 17 (1), the word "transport" shall be inserted after the word "agreed."
34. In Article 17 (2), the words "in the form of an hourly diagram 'are deleted.
35. in Paragraph 17 (3), "13: 00" is replaced by "14: 00."
36. Paragraph 17 (4) to (6) reads as follows:
"(4) The transmission system operator shall carry out a nominal verification and, no later than 15.00 on the day preceding the gas day on which the delivery is to be made, notify the balance-sheet bodies, after confirming compliance of their nominations with the relevant nominations submitted to individual gas storage operators and interconnected transmission systems, whether they have been accepted and registered.
(5) The balance sheet entity may submit a corrective nomination to the transmission system operator no later than 16.00 on the day preceding the gas day on which the delivery is to take place.
(6) No later than 18.00 on the day preceding the gas day on which the delivery is to be made, the transmission system operator shall, after confirmation of compliance of the corrective nominations with the relevant nominations submitted to the individual gas storage operators and interconnected transmission systems, notify the final nominations for the following gas day. ';
37.In Paragraph 18 (1), "19.00" is replaced by "20.00."
38. Paragraph 18 (2) to (4) reads as follows:
"(2) The transmission system operator shall carry out a verification of the renminated values and, no later than 22: 00 on the day preceding the gas day on which the delivery is to be made, shall notify the balance-sheet bodies, after confirming compliance of their nominations with the relevant nominations submitted to the individual gas storage operators and interconnected transmission systems, whether they have accepted and registered the nomination.
(3) An additional re-nomination may be submitted by 24.00 on the day preceding the gas day on which the delivery is to be made.
(4) The transmission system operator shall carry out the verification of the retrospectively reputable values referred to in paragraph 3, and no later than 02: 00 on the day on which the gas day on which the delivery is to be made begins, shall notify the balance-sheet bodies, after confirming compliance of their nominations with the relevant nominations submitted to the individual gas storage operators and interconnected transmission systems, whether they have been accepted and registered. ';
39. in Paragraph 18 (6):
"(6) Administration of the nomination after 9.00 hours on a given gas day shall be subject to the cost of the nomination as determined by the Office. ';
40. In Paragraph 19 (4), "transport 'is replaced by" gas'.
41.Paragraph 19 (5) reads as follows:
"(5) At the entry into virtual gas storage facilities, the value of the amount of gas allocated by the transmission system operator at the border entry point of the nomination relating to the transport of gas to the virtual gas storage tank shall be considered as the amount of gas to the virtual storage tank delivered. At outputs from virtual gas storage tanks, the nominal value is considered as actually delivered quantities. The differences shall be addressed between the transmission system operator and the underground gas storage system operator on the basis of separate operational contracts. ';
42. Paragraph 19 (9) is deleted.
43.Paragraph 21 (1) reads as follows:
"(1) Each working day no later than 11.00 hours, the balance sheet manager shall transmit to the transmission system operator for the preceding working gas day and for all immediately preceding non-working gas days:
(a) the pre-value of the gas supply from the transfer points or the sum of the transfer points of the gas production sites by individual balance sheet entities;
(b) the pre-value of gas supplies and withdrawals at transmission points between distribution systems;
(c) preliminary values of gas supplies and withdrawals at transmission points between the distribution system and the foreign distribution system by individual balance sheet entities;
(d) the pre-allocated value of final customers' purchases aggregated by individual balance sheet entities. "
44. In Paragraph 21, the following paragraphs 2 to 4 are inserted after paragraph 1:
"(2) Each working day, by 10: 00, the local distribution system operator shall transmit to the relevant balance sheet zone manager for the previous working gas day and for all immediately preceding non-working gas days:
(a) the pre-value of the gas supply from the transfer points or the sum of the transfer points of the gas production sites by individual balance sheet entities;
(b) the provisional value of the final customers' purchases, aggregated by individual balance sheet entities.
(3) Each month by 12.00 on the fifth working day, but not later than 12.00 on the eighth calendar day, the balance sheet manager shall transmit to the transmission system operator, for all gas days preceding the gas month:
(a) the actual value of the gas supplies from the transfer points or the sum of the transfer points of the gas production sites per balance sheet entity;
(b) the actual value of gas supplies and withdrawals at transmission points between distribution systems;
(c) the actual value of gas supplies and withdrawals at transmission points between the distribution system and the foreign distribution system by individual balance sheet entities;
(d) the actual value of the final customers' purchases aggregated by individual balance sheet entities.
(4) Each month, by 12: 00 on the fourth working day, but not later than 12: 00 on the seventh calendar day, the local distribution system operator shall transmit to the competent balance sheet zone manager for all gas days preceding the gas month:
(a) the actual value of the gas supply from the transfer points or the sum of the transfer points of each gas production plant per balance sheet entity;
(b) the actual value of the final customers' purchases aggregated by individual balance sheet entities. ';
Paragraph 2 shall become paragraph 5.
45. After Paragraph 21, the following Section 21a is inserted:
Evaluation of deviations using type diagrams
(1) The supply type diagrams shall be used as a substitute method for determining the daily take-off of final customers' natural gas with type C measurement for each balance sheet entity.
(2) On the basis of the data provided by the distribution system operators, standardised type diagrams are developed for each calendar year for each class, which are valid uniformly for the whole gas system.
(3) The assignment of individual classes of delivery type diagrams to final customer sampling points with type C measurement shall be carried out by distribution system operators when connecting final customers or when changing the nature of the sampling point. Only one delivery type diagram may be assigned to each sampling point for a given period. The assignment of the delivery type diagrams classes to individual sampling points shall be based on the nature of the sampling point. The characteristics of the sampling points for this purpose are set out in Annex 1 to this Decree. The management of the balance sheet shall keep a record of the allocation of the classes of supply type diagrams over at least the last three years.
(4) The daily consumption for final customer sampling points with type C measurement per gas day shall be calculated from the size of its planned annual consumption and the daily value of the relevant type of supply diagram converted to the actual temperature for that gas day. The planned annual gas consumption of final customers with type C measurement shall be determined by the distribution system operators in accordance with the procedure set out in Annex 2 to this Decree.
(5) For each gas day, the balance sheet zone manager shall establish a residual sampling diagram for a given balance sheet zone, which shall be determined as the difference between the total gas supply to the balance sheet zone and the sum of the actual gas consumption values with measurements of types A and B, the own consumption and the value of losses determined by the Office. If the actual sampling values for Type B measurements are not available for the preliminary balance sheet during the gas month, they shall be used as a substitute for the actual nomination values for Type B. The nomination of the relevant type B measurements for each gas day shall be carried out by the relevant user who has a gas distribution contract with the balance sheet manager. The submission of nominations shall be carried out electronically by the end of the gas day on which the procurement is to take place at the latest. If the user concerned does not carry out the nomination in accordance with this paragraph, such collection shall be assigned, on the relevant date, a value calculated as the arithmetic mean of the last known actual sampling of four calendar days equal to the name and immediately preceding that date. Details for the submission of nominations are given in the Order of the Distribution System Operator.
(6) The residual sampling diagram for each gas day shall be divided into the sampling points of the final customers, with the measurement of the type C of each class of supply type diagram as set out in Annex 3 to this Regulation. The values thus determined shall be considered as the values of the gas consumption of final customers with type C measurement for the purpose of determining the daily deviations of each balance sheet entity.
(7) The balance sheet zone manager shall publish:
(a) standardised type diagrams valid throughout the calendar year, not later than 1 calendar month before the first gas day of that calendar year;
(b) translated type diagrams valid for the gas day;
(c) the residual diagrams of each distribution system, not later than the first working day following the gas day to which they relate; the details of the method for establishing the coefficient of the residual diagram are set out in Annex 3 to this order.
(8) The transmission system operator shall publish:
(a) normal climatic conditions applicable throughout the calendar year, not later than 1 calendar month before the first gas day of that calendar year;
(b) actual climatic conditions, not later than 9: 00 on the first working day following the gas day to which they relate.
(9) The classes of supply type diagrams shall be published in the Energy Regulatory Journal and the individual balance sheet zone administrators in a way that allows remote access.
(10) Changes to standard type diagrams shall be made no more than once per calendar year. ';
46. in Paragraph 24 (1):
"(1) For eligible customers, the bill shall separately indicate the payment for gas distribution in accordance with the applicable price decision of the Office. In the case of sampling points equipped with measurements of type A and B of the category of wholesale and medium-sized customers (3), the payment for exceeding the agreed distribution capacity and the size of the excess shall also be entered in the bill. ';
47. Paragraph 25 shall be deleted, including the title.
48. The following Annexes 1 to 3 are added:

Character of the sampling point for assignment of the supply type diagram
The sampling point character describes the characteristics of the sampling point on the basis of which the delivery type diagram is assigned to the sampling point. The characteristics of the sampling point are determined for this purpose by the use of the sampling point, the timing and the nature of the sampling. On the basis of the assignment of specific values of each characteristic and the amount of annual consumption, the delivery type diagram will be assigned to the sampling point.

Determination of planned annual gas consumption
For the purpose of determining the planned annual consumption, the samples made during the previous three years shall be used before using the gas supply type diagrams. From the sum of consumption from deductions in the period thus defined, the value of the planned annual gas consumption shall be calculated. The initial and final state of the meter at the sampling point and the date of deduction during that period shall be used for its determination. Where the final customer draws gas for a period of less than three years, this shorter period shall be used to determine the planned annual consumption.
However, if the total duration of the withdrawals is less than or equal to 4 months, or if a new sampling point is involved and no indication of the measured consumption is available, the estimated quantity under the gas distribution contract shall be used.
The procedure for calculating the planned annual gas consumption if the total time of documented final customer purchase exceeds a period of more than 4 months:
1. The annual consumption calculation shall be made for each customer. The annual consumption shall be calculated by dividing the sum of the consumables determined from the deductions over the defined period by the total number of days of that period (number of days from the beginning of the consumption period of the relevant first deduction by the date of the last deduction) and by the subsequent multiplication of 365. If this value is less than or equal to 900 m3, it shall be considered as an estimate of the annual consumption of the sampling point.
2. For sampling points for which annual consumption has been calculated in excess of 900 m3, annual consumption shall be calculated as the proportion of the sum of consumables determined from the aggregated deductions (all deductions from the defined period) and the sum of the coefficients of all months falling within the total consumption period corresponding to the measured sum of consumables (for the first and last months of the total consumption period, linear conversion of the coefficients of the month to the number of days covered by the period of those months). The share thus calculated shall be multiplied by 100 to obtain annual consumption.
The coefficients are determined by the percentage of annual consumption for each month of the year:

Calculation of residual consumption diagram
The residual sampling diagrams for each balance sheet zone shall be determined by the relevant balance sheet zone manager (PDS). The residual sampling diagram of the lth balance sheet zone is determined from the measured daily sampling types A and B and from the calculated daily consumption values (for losses and wool consumption) in the lth balance sheet zone:

V is the quantity of gas delivered to the balance sheet zone from the gas production of the PD gas day,
PDS is the amount of gas supplied or transferred from / to another distribution system on the PD gas day,
PHPS is the amount of gas supplied or transferred from / to the cross-border distribution system on the PD gas day,
ol A, PD is the sum of the measurements of the type And in the Ith balance sheet zone for PD gas day,
ol B, PD is the sum of the measured samples of the type B in the Ith balance sheet zone for the PPD gas day (for pre-balance sheets during the gas month when actual sampling values for Type B measurements are unavailable, the nominations for Type B sampling shall be used to replace the actual values),
VSl PD is the own consumption in the Ith balance sheet zone for the gas day PD
Zl PD is the loss in the Ith Balance Zone for Pd gas day.
The daily take-off of oi, lt, PD and th of the final customer sample point with measurement of type C for the gas day PD shall be calculated from the size of its planned annual consumption of Oi, l and the proportional value of the relevant type of TDDpPD converted into actual climatic conditions for the gas day:

The value thus calculated of the sampling of the ith of the final customer's sample point with the measurement of type C in the lth balance sheet zone relevant to the type t diagram TDpt shall be corrected to the value of participation in the residual DZLPD diagram in the lth balance sheet zone for the gas day PD in proportion to the "weight 'of the sample with the measurement of type C, so that its valuaoi, ltK, PD after this correction is:

The sum of all samples with type C measurement in the Ith balance sheet zone for the gas day PD calculated using the supply type diagrams is equal to 1Toi, lt, PD.
The corrected daily sampling values for final customer sampling points with type C measurement shall be used to determine the nomination and balance sheet deviations of each balance sheet entity. ';
Efficacy
This Decree shall take effect on 1 January 2006.
