GOVERNMENT REGULATION
of 11 October 2004
amending Government Regulation No 242 / 2004 Coll., on the conditions for implementing measures to promote the development of non-production functions of agriculture consisting of the protection of environmental compartments (on the implementation of agri-environmental measures)
The Government orders pursuant to § 2c paragraphs 5 and 6 of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 85 / 2004 Coll., (hereinafter referred to as "the Act") to implement § 2c paragraph 2 (b) of the Act:
Amendment of the Government Regulation on the implementation of agri-environmental measures
Government Regulation No 242 / 2004 Coll., on the conditions for implementing measures to promote the development of non-production functions of agriculture in order to protect environmental compartments (on the implementation of agri-environmental measures) is amended as follows:
1. Paragraph 4 (4) is deleted.
Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.
2. In Paragraph 4 (4), the words "in paragraph 4 'are replaced by the words" in the regulations of the European Communities (10)'.
3. In the first sentence of Article 5 (1), the words "3 or 'are deleted and the words" If the agri-environment measure referred to in Article 2 (1) (c) (3) is applied after the first sentence, the applicant may increase the area included in that measure during the relevant five-year period by a maximum of 10% of the total area included in that measure in the first calendar year of the five-year period.';
4. In Article 5 (3), the words "except for the measure referred to in Article 2 (1) (c) (3) 'shall be inserted after the words" paragraph 1'.
5. In Article 13, the words "for applicants included in the field of landscape care in the calendar year 2005 and in the following years, the distance between each biostrip within the soil blocks or parts thereof shall be at least 50 metres' shall be added at the end of the text of paragraph 4.
6. In Article 21, the following paragraph 4 is added:
"(4) An application for inclusion in an agri-environmental measure pursuant to Article 2 (1) (c) (3) may not be made for a five-year period beginning on 1 April 2005 and ending on 31 March 2010. '
Efficacy
This Regulation shall enter into force on the day of its publication.
