DECLARATION
of 29 November 2006
on the establishment of protection zones of natural medical sources of mineral water washed by a well of Le- 7 in the cadastral territory of the Charvátská Nová Ves Municipality of Breclav and on the definition of specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Areas and on the amendment of certain related laws (Spa Act):
In order to protect the natural medical source of mineral water, which is covered by the well Le- 7 on the land parcel No 1972 / 101 of the cadastral territory of the Kharvátská Nová Ves municipality Breclav, the district of Breclav, the region of Jihomoravský ("the source '), protection zones I and II shall be established.
(1) Level I protection zone (2) consists of the immediate vicinity of the source output and is defined by land parcel No 1972 / 101 of the cadastral territory of Kharvátský Nová Ves village Breclav; the protection zone is also a zone of physical protection of the source.
(2) The definition of the protection zone I is graphically indicated in a copy of the cadastral map of the scale 1: 2 000, which is annexed to No 1 of this Decree. The definition of the first-degree protection zone in the cadastral map of the scale 1: 2 000 is available at the Ministry of Health, the Municipal Office in Lednice, the Breclav City Office and the South Moravian Region Regional Office.
(1) Level II protection zone (3) is established to protect the territory of static stocks of iodine water of the base structure of the source.
(2) The Level II protection zone is defined by the territory whose border is drawn from the level crossing of the railway track with a field crossing called Ladenská, along that road along the wine cellars to the field path leading to the south-east on which it continues, and after 650 m at the intersection with the road leading towards the north-east, it diverges to that route. After 280 m the route crosses the high voltage line and the border under this line continues in the southeast direction until the corner of 166.3, then heads towards the southwest and after crossing the railway track through the forest passage to the forest road called Jezecka. On this road, the border is led 1 540 m west to the forest road turning northwest. Following this route, which is the border of the Kharvatský Nová Ves and Valtice, it leads to a forest road called the Border Alley, on which it is led to the north via the location of Saint Hubert to the field road leading along the northern edge of the forest towards the north-west to the crossing with the field route called Ladenská, from Valtice to the starting point of the level crossing with the railway.
(3) The definition of the protection zone II is graphically marked in the basic maps of the Czech Republic on the scale 1: 10 000 and 1: 50 000, the copies of which are annexed to Nos 2 and 3 of this decree. The definition of protection zone II in the basic maps of the Czech Republic is available at the Ministry of Health, the Municipal Office in Lednice, the Municipal Office in Breclav and the Regional Office of the South Moravian Region.
(1) The following shall be prohibited in the protection zone II:
(a) to operate landfills of hazardous waste (4);
(b) mine (5) from a depth greater than 200 m below the terrain or carry out geological surveys at a depth greater than 200 m below the terrain; If the extraction or geological exploration of oil or natural gas is concerned, it shall be carried out in accordance with the special legislation6),
(c) to take groundwater from a depth greater than 200 m below the terrain;
(d) dig wells to obtain geothermal energy to a depth greater than 200 m below the terrain.
(2) The activities referred to in paragraph 1, if carried out in Level II protection zone, will be completed within two years of the date of entry into force of this Decree.
Level I protection zone (7) shall be fenced. In the territory of the protection zone I, the unauthorised entry is prohibited (7).
This Decree shall take effect on 20 December 2006.
