GOVERNMENT REGULATION
of 29 September 2004
defining the Bird Region of Libavá
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The bird region of Libavá ("the bird region") is defined.
(2) The object of the protection of the bird area is the population of the Crex crex and its biotope.
(3) The aim of the protection of the bird region is to preserve and restore the ecosystems relevant to the bird species referred to in paragraph 2 in its natural area of extension and to ensure conditions for the conservation of the stock of that species in a favourable conservation situation.
Definition of bird area
(1) The bird region is situated in the territory of the Olomouc Region, in the cadastral territories of the Military Departure of Libava.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 50 000 scale map documents, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the Olomouc Region, the Military Forest Office and the Central Office of the Military Departure Libava.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of the municipalities be located in the birds' area, outside the areas designated for the performance of forest functions (3), and outside the concurrently built and stoppable (4),
(a) carry out activities causing a change in the level of established surface and groundwater levels which could cause a change in the biotope of the species for which the bird area is established;
(b) to change the type of land and the means of usingit (5).
(2) The prior consent of the competent nature conservation authority to the activities referred to in paragraph 1 (a) shall not be required if the procedure is in accordance with the waterworks handling rules (6).
(3) The prior consent of the competent nature conservation authority to the activities referred to in paragraph 1 shall not be required if priority is given to the use of the military escape area for State defence purposes (7).
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Bird Region
The border of the bird region is the same as the border of the military escape of Libavá and it is made up of the external borders of the cadastres of the municipality of Libavá, Černá near the town of Libavá, Rudoltovice, Slavkov near the town of Libavá and Velka Střelná.
