GOVERNMENT REGULATION
of 29 September 2004
delimiting the Bird Region Water Works Tanks
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' zone is defined as the water works tank of Pherunice (hereinafter referred to as the "bird area").
(2) The protection of the bird area is the populations of the wild goose (Anser fabalis) and of the wintering waterbirds.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) The bird area is situated in the territory of the Ústí Region, in the cadastral territories of Břežno near Chomutov, Poles, Rokle, Tushimice, Vadkovice and Vikletice.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 10 000 scale map documents in which the territory of the bird area is drawn are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the Ústí Region and the municipal offices of the enlarged municipalities in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
Only with the prior consent of the competent authority of nature protection (2) may be allowed in the birds' area
(a) operate sailing, windsurfing and use jet skis for recreation between 25 October and the end of February;
(b) organise hunts and fish for aquatic feathered game from boats and on banks in the 100 m zone from the shore from 15 October to 30 November (wild duck, pollack, black fox), respectively from 15 October to 15 January (wild goose, white goose, white goose).
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border Bird areas Water works tank
The territory of the area is defined by the plots of the water works of Přezranice and partly by the flow of the river Ohře. The following parcels are concerned: p.p.1200 / 1 k.ú. March at Chomutov, p.400 / 1 k.ú. Vicletice, p.260 k.ú. Vadkovice, p.298 / 1 k.ú. Poles. On the K. Ú. Tushimice and Rokle is the flow of the Hole in the length of 635 m upstream from the boundaries of the cadastral at the entrance to the dam.
