of 23 January 1992
on minimum wage
The Government of the Czech and Slovak Federal Republic orders pursuant to § 111 (3) of the Labour Code No. 65 / 1965 Coll., as amended by Act No. 3 / 1991 Coll., and pursuant to § 4 (4) of Act No. 1 / 1992 Coll., on wages, remuneration for on-call and on average earnings:
Scope
This Regulation provides for the provision of a minimum wage for workers (workers) in employment or in a similar employment relationship ("staff ').
Minimum wage
(1) The minimum wage amount is:
a) za díúm čr odpracovanú zamestnancom 12 Kčs,
b) za mesiac 2200 Kčs pre zamestnanca demenovaných mesánka pádou,
(c) 75% of the amounts referred to in points (a) and (b), if it is a staff member who is a beneficiary of a partial invalidity pension and a young staff member over 16 years of age;
(d) 50% of the amounts referred to in points (a) and (b), if it is a staff member who is a beneficiary of an invalidity pension, a staff member under 18 and a staff member under 16.
(2) The minimum wage referred to in paragraph 1 (a) is fixed for a weekly working period of 42 1 / 2 hours; for a different length of fixed weekly working time, the minimum wage shall be adjusted proportionally.
(3) Staff members who receive a monthly salary (remuneration) which has an agreed or permitted shorter working period (1), or who have not worked all working days in a month, are entitled to a minimum wage equal to the working period.
(1) If the staff member does not achieve a wage of 2) (remuneration) in the calendar month of the minimum wage due to him pursuant to Paragraph 2, the employer will pay him the difference ("supplement").
(2) Staff members whose salary (remuneration) or part thereof is payable for more than a month shall be paid an advance payment (3) and shall be settled on the payment of that salary (remuneration) or part thereof for the three calendar months preceding the date of payment. By way of derogation, the method of settlement of the supplement may be agreed in a collective agreement or, where appropriate, in an internal regulation issued in agreement with the relevant trade union body; for members of cooperatives, such arrangements may be laid down by a resolution of the Member States.4)
Common, transitional and final provisions
For domestic workers, for the purposes of this Regulation, the hours worked shall be the hours worked according to the standard of labour consumption laid down by the employer. 5)
The salary (remuneration) referred to in Article 3 (1) shall not include:
(a) overtime wage;
b) Loyalty stabilization fees granted for 1991 to employees in selected counties and locations of the Czech Republic according to special regulations.
A supplement up to the minimum wage provided for in this Regulation shall be granted for the first time in January 1992; a supplement shall be granted to young workers, with the exception of disabled workers, for the first time for the month of February 1992.
The Decree of the Government of the Czech and Slovak Federal Republic No. 99 / 1991 Coll., on the establishment of a minimum wage is hereby repealed.
This Regulation shall enter into force on the day of its publication.
