on training and further enhancing the expertise of road motor vehicle drivers
In agreement with the participating central authorities, the Ministry of Transport provides, pursuant to Article 16 (1) (b) of Decree No. 54 / 1953 Coll., on road traffic, as amended by the statutory measure of the Bureau of the National Assembly No. 13 / 1956 Coll.:

ČÁST PRVNÍ

Basic driver training
§ 1
Organisation authorised to train drivers
(1) Training for drivers of road motor vehicles (hereinafter referred to as "motor vehicles") may be carried out if the conditions laid down in the following decree are met:
(a) Association for Cooperation with the Army ("Swazarm")
(b) vocational schools, secondary and vocational schools (hereinafter referred to as "schools")
(c) other State economic and budgetary organisations (hereinafter referred to as "state organisations").
(2) The organisations authorised to train drivers referred to in paragraph 1 (hereinafter referred to as "approved organisations") shall take care of the educational and professional level of training.
(3) The District National Committees, in cooperation with the District Transport Inspectors of Public Safety, assist the competent organisations in carrying out the tasks related to driver training and continuously monitor and evaluate the overall level of training in each organisation, in particular the level of teachers, equipment of training facilities and the preparedness of pupils for testing. In the case of urban transport undertakings and schools, this obligation shall be assumed by the National Committee which manages these organisations, together with the District Transport Inspectorate of Public Security.
(4) Driver training is carried out by approved organisations in their training facilities (driving schools, motor clubs).
(5) Swaziland shall train motor vehicle drivers for the needs of the national economy and citizens in the form of courses, individual training and long-distance studies.
(6) Schools may train drivers for their pupils (apprentices) if this activity is included in their curriculum and subject optional.
(7) State organisations may conduct driver training for their personnel to obtain a driving licence of Group A, B, C, D, M, T, *) only if it is necessary to ensure their tasks or the need for People's militia, civil defence or fire protection. Agricultural state organisations may also carry out training for agricultural establishments if this is necessary to ensure the operation of the agricultural establishment. State organisations for which it would not be useful and economical to set up a one-off course shall be associated to conduct training courses with other state organisations.
§ 2
Consent to train drivers
(1) In order to train drivers, prior written consent of the District Transport Inspectorate of Public Security is required.
(2) Consent may be given for the organisation of a one-off course or for continuous training in courses.
(3) The application for approval to train drivers shall specify:
(a) the name and registered office of the applicant, his superior authority and the central authority to which the applicant belongs;
(b) the seat of the training establishment, the name, surname and address of the training establishment manager responsible;
(c) the purpose for which driver training is organised;
(d) the group of driving licences for which training is to be obtained;
(e) whether it is a one-time course or continuous training;
(f) the curriculum;
(g) the nominal list of teachers, indicating the subjects entitled to teach;
h) a room where teaching theory will be conducted, a list of teaching aids and training vehicles,
(ch) the estimated capacity of the training facility and the number of pupils per course and per year.
The school shall accompany the application with evidence that driver training is included in its curriculum.
(4) Consent to conduct driver training shall be given only on condition that driver training is carried out:
(a) eligible teachers (Section 4);
(b) according to the curriculum of driver training issued by the Ministry of Transport (§ 3 (3)),
(c) on training vehicles meeting the requirements of Section 7;
(d) prescribed and approved teaching aids (§ 8),
(e) courses in which the maximum number of pupils laid down in § 3 (4) is not exceeded.
§ 3
Scope and manner of training for drivers
(1) The purpose of the training is to provide the driver with the transport and technical knowledge necessary for the perfect control and operation of the vehicle.
(2) Driver training consists of:
(a) teaching theory,
(b) practical training in vehicle maintenance and control.
(3) Driver training shall be carried out at least to the extent specified by the relevant curriculum. The curriculum for individual categories of driving licences shall be issued by the Ministry of Transport in agreement with the Ministry of Interior and National Defence.
In the training of drivers in schools, the teaching theory shall be waived to the extent that the substance is taught in a professional subject.
Pupils who have completed a secondary vocational, higher vocational or university education in the mechanical or electrical direction or in the direction of agricultural mechanisation may not participate in the teaching of vehicle design and maintenance theory.
(4) The training of drivers is usually carried out in bulk courses, with the highest number of pupils per course being 35.
(5) Under the conditions and to the extent laid down in the curriculum, applicants for a driving licence may also study remotely.
(6) Practical driving training shall not be initiated before pupils have acquired basic knowledge of road traffic rules and become familiar with driving theory and driving technique. Final practical driving training lessons are held on roads with normal operation, under normal operating conditions and conditions.
(7) Practical driving training is usually done in lessons after 25 minutes of actual driving. A student may attend a maximum of two lessons a day, i.e. 50 minutes of driving. For practical driving training with a range of more than 12 hours (24 driving lessons), this limit shall be increased to twice as long as the student has a break of at least 25 minutes after two lessons. The length of driving in one lesson shall be at least 10 km on average of the entire training, for the tractor 5 km. In schools, two driving lessons last 45 minutes. The length of driving in one lesson shall also be at least 10 km on average of the entire training, for the tractor 5 km. The total actual period of practical training provided for in the curriculum must be respected.
(8) Practical training in driving carts for disabled persons will be adapted to the student's health. The training of disabled persons may be carried out on a wheelchair which does not meet the conditions of § 7 (1) and (5).
(9) Practical training in bus control is allowed only in buses of a total length of 9 or more metres.
(10) Practical training in the maintenance of motor vehicles shall be carried out in groups of up to seven pupils.
§ 4
Teachers of theory and practical training
(1) Only persons (hereinafter referred to as "teachers") who have been certified by the Regional Public Security Inspectorate or by an authority of the armed forces or the Security Corps may teach the theory and conduct practical training in the management and maintenance of motor vehicles.
(2) A teacher certificate may be issued only to persons who provide a guarantee that they will conduct the training conscientiously, demonstrate the necessary pedagogical knowledge, pass a test with success before a commission composed of representatives of the Regional Transport Inspectorate of Public Security, the Regional National Committee and the management of the Svanzarm Motoring Department and fulfil the other conditions set out in paragraphs 5 to 7. The teacher's certificate shall indicate the subjects to which the teacher is entitled to teach.
(3) The certificate for teachers is issued (extended) for a period of five years. If the teacher requests an extension of the certificate after that period, he shall be subject to the examination of his abilities before the commission referred to in paragraph 2.
(4) The test schedule for teacher examinations shall be issued by the Ministry of Transport in agreement with the Ministry of Interior; for examinations of teachers who will teach theory and perform practical training in the management and maintenance of T-category motor vehicles, also in agreement with the Ministry of Agriculture, Forestry and Water.
(5) Authorisations to teach road traffic rules, rules on the conditions of use of road motor vehicles, the cost-effectiveness of road motor vehicles and safety at work in motor vehicles may be granted only to persons who have the driving licence of the group to be trained.
(6) Approval to carry out practical training in the steering and maintenance of motor vehicles of the group: *)
(a) A and M may be granted to drivers who are entitled to drive category A motor vehicles and demonstrate at least two years' experience in driving that category;
(b) B and C may be granted to drivers who are entitled to drive category C motor vehicles and demonstrate at least two years' experience in driving that category;
(c) T may be granted to drivers who are entitled to drive category C or category T motor vehicles and prove at least two years' experience in driving agricultural tractors;
(d) D may be granted to drivers who have a driving licence of that category and prove at least two years' experience in driving motor vehicles of that category.
(7) Authorisation to teach the theory of the construction, maintenance, driving and driving techniques of motor vehicles group:
(a) A and M may be granted to drivers who are entitled to drive category A motor vehicles;
(b) B and C may be granted to drivers entitled to drive category C motor vehicles;
(c) T may be granted to drivers who are entitled to drive category C or T motor vehicles;
(d) D may be granted to drivers who are entitled to drive this category.
(8) Driver training teachers shall be required to be associated in the Svarm motor cathedrals, except for permanent teachers of schools teaching a professional subject included in the curriculum for driver training and staff of public road and urban transport organisations operating as drivers' training teachers in the framework of their duties; However, these teachers may join the department.
(9) The Regional Transport Inspector of Public Security shall withdraw the certificate if he or she finds that the teacher does not provide a guarantee of the conscientious performance of this function or that he or she has lost the required expertise.
§ 5
Obligations of management training establishments and driver training teachers
(1) The head of the training establishment shall be responsible for the proper, planned and continuous conduct of driver training in accordance with the curriculum and shall ensure that each pupil is called to the test after successful completion of the training without undue delay. In cooperation with the Department of Motoring, he provides for the increase of the qualifications of his subordinate teachers. He's responsible for the good technical condition of the training vehicle.
(2) Driver training teachers are required to follow a specified curriculum. During and after training of drivers, they shall be satisfied that pupils are properly prepared to pass the prescribed test. If the student finds that the student is not adequately prepared, he shall not allow him to be called for the driving test and to receive additional training. In practical driving training, the driver of the motor vehicle shall be adequately required.
§ 6
Conditions for the admission of a pupil to train drivers
An applicant may be included in driver training who, on the day of completion of the training, fulfils the age prescribed for the granting of a driving licence for motor vehicles of the group concerned.
§ 7
Training vehicles
(1) A vehicle on which practical driving training is carried out must be equipped with a safe driving device (dual coupling control device, service brake and dual steering motor). In addition, the tractor shall be equipped with a teacher's seat adjacent to the seat or behind the pupil's seat. Buses, small motorcycles and scooters may not have double steering and control. In practical driving training only training vehicles which are in socialist ownership and whose competence to train has been approved by the District Transport Inspector of Public Security may be used.
(2) A training vehicle (except a dual-driving motorcycle) must be marked "Training driving" in black characters on a white background. The label takes the form of an equilateral triangle with rounded vertices built on the base. The sides of 25 cm long are red lined in a width of 2 cm. The marking shall be placed in the front on the left side of the vehicle and in the rear in the middle or on the left side of the bodywork.
(3) Practical driving training is not permitted on vehicles to carry out medical and mining rescue and fire protection services using a special warning sign. In practical driving training there shall be no uninvolved or dangerous costs in the vehicles of the training personnel.
(4) The training vehicle must always be in impeccable technical condition, clean and properly maintained (Section 5 (1)). Vehicles of those brands and types of vehicles used in road traffic are used for training. Training on outdated or unrunning vehicle types is not allowed.
(5) The holder of the training vehicle shall, at least once a year, present the vehicle for technical inspection to the Public Security Transport Inspectorate.
§ 8
Apprenticeship aids
(1) Appropriate teaching tools (manuals, complementary literature, paintings, films, mass-produced functional models, training tables, etc.) are used to train drivers; these aids can only be produced in bulk after prior approval by the Ministry of Transport. Authorised organisations are required to complement teaching tools to match current technical developments and vehicles newly introduced into road traffic.
(2) Only textbooks approved by the Ministry of Transport may be used to train drivers, for schools by the Ministry of Education and Culture in agreement with the Ministry of Transport.
(3) The completeness and suitability of the teaching tools used are checked by the District Transport Inspectorate of Public Security in cooperation with the District National Committees.
§ 9
Obligations of pupils of training facilities
The student is obliged to participate fully in the training of drivers. If more than 1 / 4 of the syllabus of prescribed teaching theory or practical training in maintenance is lost, he is obliged to complete training again. All missed lessons in practical driving training shall be supplemented.
§ 10
Individual driver training
Individual training *) must respect the scope of the training set out in the curriculum. However, it may also be carried out on vehicles which do not comply with the requirements of § 7 (1) and (5) or, where applicable, on vehicles of non-running type.

Further increase in driver skills
§ 11
Safe, smooth and economical road traffic, as well as new means of transport, require that the professional and technical level of drivers continuously and consistently increase and consolidate. In particular, they shall serve to perform this task:
(a) driver training;
(b) regular compulsory training of professional drivers;
(c) education and other professional growth of other drivers.

Driver training
§ 12
Driver training method
(1) If the driver is to be entrusted with a vehicle in which he does not have experience, the organisation shall, at his request, allow him to train on the vehicle under the guidance of the instructor.
(2) Training shall be carried out in normal operation and, where applicable, the economic performance of the vehicle under the supervision of the instructor.
§ 13
Driver training instructors
Instructors for the training of motor vehicle and combination drivers shall be designated by the training organisation from among its staff, and by disciplined and competent drivers who have sufficient experience in driving the relevant type of vehicle. The driver training instructor need not be certified for teachers; does not assume the duties and responsibilities of the driver during training.

Hlava II

Regular compulsory training of professional drivers
§ 14
Method and scope of compulsory instruction
(1) Regular compulsory training for professional drivers (hereinafter referred to as "compulsory training") is carried out by organisations for which the driver is employed and, where appropriate, by cooperative organisations of which he is a member, in the competitive (cooperative) employment schools. For this purpose they provide the necessary conditions (instructors of compulsory instruction, suitable room, teaching aids, etc.).
(2) Organisations for which it would not be expedient and economical to organise compulsory training on their own shall be associated with the joint compulsory training with other organisations or shall, where appropriate, entrust the implementation of this activity to Swaziland.
(3) Compulsory instruction shall be carried out at least 40 hours per year, i.e. usually 4 hours per month. This period shall be counted against the working time of drivers and shall be paid by their average hourly wage. One eight-hour working day in a two-month cycle may be reserved for this compulsory instruction. Mandatory training must be planned in such a way that all professional drivers pass through it and that the organisation's own operation is not jeopardised.
(4) As a rule, more than 35 drivers are not required to participate in one compulsory training course. The teaching hour lasts 50 minutes, breaks between each teaching hour 10 minutes.
(5) The organisation shall keep an accurate record of the mandatory instruction. Unexcused non-participation in compulsory instruction shall be deemed to be an unjustified absence of the driver at work.
(6) Drivers who have missed at least 8 hours of mandatory instruction in the last three months shall be required to participate in replacement training on the same topic, including, where appropriate, other organisations.
(7) The organisation sending drivers to another organisation shall discuss the classification of its drivers for compulsory training with that organisation, which shall include them in its register (paragraph 5) and shall charge the sending organisation for the relevant amount of costs within the meaning of Article 16.
(8) The Ministry of Transport issues an annual framework thematic programme for compulsory training; *) when processing the syllabus of individual topics, the organisation will take into account in particular its transport activities and the composition of its fleet.
§ 15
Instruction instructors
(1) Driver training or discipline teachers, professional and experienced drivers and, where appropriate, other road and urban transport professionals shall perform the duties of instructors.
(2) On a proposal from the organisation, instructors shall be approved by the relevant national committee (§ 1 (3)) in agreement with the District Transport Inspectorate of Public Security.
(3) External speakers, such as from the District Institute of National Health, State Insurance companies, legal advice, Swaziland, production or repair plant, can be invited to expert lectures on transport topics.
§ 16
Payment of costs
The reimbursement of the costs of compulsory training shall be governed by the rules applicable to the labour racing schools. The costs of compulsory training undertaken jointly for drivers of several organisations shall be borne by those organisations in proportion to the number of drivers who participated in the compulsory training. If the compulsory education is carried out by Svazarm, the rate approved by the Ministry of Finance shall apply to the amount of the remuneration.
§ 17
Driver testing
(1) Organisations are required to ensure the regular checking of their drivers engaged in the mass transport of passengers or in the transport of dangerous goods at least every two years to the extent specified by the Ministry of Transport.
(2) An entry shall be made on the staff member's record of the check.
§ 18
Tasks of national committees
National Committees (§ 1 (3))
(a) supervise and monitor the organisation and conduct of compulsory training and courses organised in the framework of racing schools and monitor the results thereof, eliminate the deficiencies identified directly from organisations;
(b) familiarise organisations with the compulsory training thematic plan (Section 14 (8)) for the following quarter at the latest one month before its beginning;
(c) keep a register of instructors for compulsory instruction. To ensure professional and pedagogical training of instructors, they shall organise seminars in cooperation with the District Transport Inspector of Public Security and the Motoring Department of Swaziland, once every quarter of the year, where instructors will familiarise themselves with the thematic plan of the following period and with the subject of compulsory instruction. The organisation will send instructors to these seminars on its load.
§ 19
Tasks of organisations
(1) The organisation will complement the thematic plan of compulsory instruction to the full number of specified hours by problems of its own operation and will provide for the planned dates of compulsory lecturing by the lecturer and the necessary aids. Such obligations shall also apply mutatis mutandis to organisations carrying out compulsory training within the meaning of Paragraph 14 (2).
(2) At the latest at the beginning of each quarter, the organisation shall notify the relevant national committee of the dates of compulsory instruction.

Hlava III

Training and other professional growth of other drivers
§ 20
The education and other professional growth of drivers who do not carry out this activity as a profession is provided by Svanzarm, who is also obliged to create the appropriate conditions to ensure the development of motoring in agreement with the Ministry of Transport.

Final provisions
§ 21
Authorisation of exemptions
Exemptions from the provisions of this Decree are permitted by the Ministry of Transport in agreement with the competent central authorities.
§ 22
Scope
This decree does not apply to training of drivers of armed forces and security corps. * *)
§ 23
Validity of current registration
The registration of state organisations carried out in accordance with the regulations previously in force is considered to be an agreement to conduct the training provided for in this Decree (§ 2) until 31.12.1965.
§ 24
Repeal
The provisions of Section 72 of the Ordinance of the Ministry of Interior No 145 / 1956 Ú. l., on road traffic, Section 52 and 53 of the Ordinance of the Ministry of Transport No 145 / 1958 Ú. l., on the conditions for the operation of vehicles on roads, the uniform curriculum for training of drivers of motor vehicles announced by the official communication of the Ministry of Transport in the amount of 157 Ú.l., 1953, as amended by the Official Communication of the Ministry of Transport in the amount of 65 Úl. l. 1954 and the Directive on the transport, economic and technical training of drivers in the profession published in Annex II.
§ 25
Efficacy
This Decree shall take effect on 1 July 1965.
