Act on the award of scientific degrees and on the State Commission on Scientific Aspects

THE LAW
of 26 February 1964
on the award of scientific degrees and on the State Commission for Scientific Aspects
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
§ 1
The development of a socialist society is conditional on increasing the share of creative scientific work in all areas of economic and cultural construction. For this reason, the socialist society ensures the continuous growth of the level of scientific work and the personnel who have publicly demonstrated the scientific qualifications of the original scientific or scientific research activities for the benefit of peace and socialist construction, or for the development of scientific research itself, grants scientific degrees as a recognition of their creative competences and the importance of their scientific activities.

Scientific rank
§ 2
(1) Scientific grades are awarded in two stages:
(a) the rank of candidate for science;
(b) Doctor of Sciences
with the addition of the designation of the relevant group of sciences (Section 4).
(2) Scientific rank shall be given either in full or in abbreviations to CSc. (candidatus scientiarum) for the rank of candidate of sciences and DrSc. (Doctor scientiarum) for the rank of doctor of sciences.
§ 3
(1) Scientific rank
(a) the Czechoslovak Academy of Sciences and the Slovak Academy of Sciences (hereinafter referred to as the Academy of Sciences),
(b) universities.
(2) The bodies of academia of science and universities which are entitled to decide on the award of scientific degrees of candidate and doctor of science in each group of sciences, science or disciplines, as appropriate, shall be determined by the State Commission for Scientific Organisations (Section 12).
(3) Academies of Science and Higher Education issue diplomas on the scientific degrees they have awarded.
§ 4
(1) Scientific degrees are awarded in the following groups of sciences:
Physically Mathematical Sciences,
geological-mineralogical sciences,
geographical sciences,
chemical sciences,
biological sciences,
medical sciences,
pharmaceutical sciences,
agricultural and forestry sciences,
veterinary sciences,
technical sciences,
philosophical sciences,
economic sciences,
legal sciences,
historical sciences,
pedagogical sciences,
psychological sciences,
philosophical sciences,
Military science.
(2) The other groups of sciences in which scientific degrees are awarded shall be designated by the State Science Commission, which may also make changes to the groups of sciences referred to in paragraph 1.
§ 5
(1) The scientific rank of the candidate of science expresses the competence for creative scientific work, demonstrated by a solution to a scientific or scientific research task by which the worker has proven to control scientific methods, has deep theoretical knowledge and has brought new knowledge.
(2) The applicant shall certify the scientific competence referred to in paragraph 1 by carrying out candidate examinations and by publicly defending the candidate dissertation.
(3) Excellent staff who have objectively demonstrated their higher scientific qualifications with their work results verified in practice may certify the scientific competence referred to in paragraph 1 without carrying out tests by defending the social importance of their scientific work in the public scientific debate before the Commission (§ 8).
§ 6
(1) The scientific rank of doctor of science expresses a particularly high scientific qualification demonstrated by the creation of serious scientific original work important for the development of research in a particular field or for social practice and characterising a dedicated scientific personality.
(2) The applicant shall certify the scientific competence referred to in paragraph 1 through the public defence of doctoral dissertation.
§ 7
(1) Scientific degrees may be awarded to workers with completed higher education and their scientific creative activities, based on scientific world opinion and professional practice, guarantee further development as socialist scientists.
(2) Workers without higher education may be awarded scientific degrees with the consent of the State Commission for Scientific Aspects, exceptionally, if they otherwise fulfil the conditions set out in paragraph 1 and the scientific work, discoveries or inventions have demonstrated the required scientific level.
§ 8
The eligibility of candidates for the acquisition of scientific qualifications under paragraphs 5 to 7 shall be certified and verified before the defence committees.
§ 9
To express a high honor for merit for progress in the field of science and culture or social relations and for significant merit for socialist construction, excellent scientific or public staff can be awarded the honorary scientific rank of doctor of science both domestic and foreign. The approval of the State Commission on Scientific Aspects is required to grant the honorary degree of the Doctor of Sciences under this Act.
§ 10
Academics of Science and Higher Education may, with the approval of the State Commission on Scientific Aspects, notrify the scientific grades obtained abroad if these grades correspond to their level to those obtained in the Czechoslovak Socialist Republic.
§ 11
(1) The ranks of scientists are no longer those who embezzlement from civil and scientific integrity.
(2) If the loss of scientific rank is no longer due to the judgment of the court, the authority which granted it shall decide on its withdrawal.

ČÁST DRUHÁ

State Commission on Scientific Aspects
§ 12
(1) The State Commission on Scientific Aspects ("the State Commission") is a national supranational body for addressing questions relating to the award of scientific degrees.
(2) The State Commission has the following main tasks:
(a) manage and coordinate the activities of the institutions in the award of scientific degrees;
(b) oversee the high level of candidates for scientific degrees and ensure its uniform assessment;
(c) collect experience in the award of scientific degrees and, on this basis, gradually improve the method of awarding scientific degrees.
(3) The State Commission, in agreement with the Czechoslovak Academy of Sciences, the Ministry of Education and Culture, the State Commission for the Development and Coordination of Science and Technology and the participating central bodies, issues detailed regulations for the implementation of this Act.
(4) The State Commission consistently oversees the observance of this law and its implementing provisions and may, on appeal and in justified cases, repeal the decision of the body implementing those provisions on its own initiative.
(5) The State Commission works closely with the Czechoslovak Academy of Sciences, the Ministry of Education and Culture and the State Commission for the Development and Coordination of Science and Technology in the performance of its tasks.
§ 13
(1) The President of the State Commission and its members are appointed by the Government on a proposal from the Minister of Education and Culture, submitted in agreement with the President of the Czechoslovak Academy of Sciences and the Chairman of the State Commission for the Development and Coordination of Science and Technology.
(2) The President, Vice-Presidents, Scientific Secretary and other members of the provisions shall be President of the Presidium of the State Commission.
(3) The rules of organisation and procedure of the State Commission are approved by the Government.
(4) As a rule, the President of the State Commission shall report once a year to the Government on the activities of the State Commission.
§ 14
The activities of the State Commission shall be provided by the Secretariat of the State Commission.

Final provisions
§ 15
Scientific degrees acquired under § 2 and § 9 of the legal measure of the Bureau of the National Assembly No. 64 / 1959 Coll., on the award of scientific degrees and on the State Commission for Scientific Positions, and under the legal measure of the Bureau of the National Assembly No. 10 / 1955 Coll., which regulates the award of the rank of doctor of sciences to certain scientists, remain unaffected.
§ 16
Academic degrees and state titles awarded before 1 September 1953 and graduates of medical and veterinary faculties before 1 January 1954 remain unaffected.
§ 17
Exemptions from the provisions of Sections 5 to 7 are permitted by the State Commission.
§ 18
The legal measure of the Bureau of the National Assembly No. 64 / 1959 Coll., on the award of scientific degrees and on the State Commission on Scientific Aspects is hereby repealed; However, in accordance with the regulations issued for the implementation of this statutory measure, the procedure for the award of scientific degrees may be held until the provisions laid down in Article 12 (3) of this Law. *)
§ 19
This Act shall take effect on the day of its publication.
