Regulation on the increase in certain pension schemes

increasing certain pensions from pension schemes.
The Government of the Czechoslovak Republic orders pursuant to § 6 paragraph 3 of Act No. 102 / 1951 Coll., on the Rebuilding of National Insurance:
§ 1.
Purpose of the regulation.
The positive results of the building effort of the workers make it possible, in accordance with the socialist principle, to increase the standard of living of the people continuously, to increase certain pensions from pension insurance.

Oddíl první.

Increase in national insurance pensions as of 1 December 1956.
§ 2.
Increasing old-age and disability pensions from occupational insurance.
(1) Old-age and invalidity pensions from occupational insurance, which are below 350 CZK per month, are increased by 10% but at least to 350 CZK per month. However, if entitlement to an old-age pension has arisen after 31 December 1951 from an occupational pension that has not lasted for more than 10 years, the pension shall be increased to 300 CZK per month if it does not reach that amount; This also applies to invalidity pension, unless entitlement to this pension is due to an accident at work (occupational disease) or before the age of 30.
(2) Old-age and invalidity pensions granted to miners and below the amount of 600 CZK per month are increased by 10% but to at least 600 CZK per month.
(3) For the purposes of this Regulation, persons entitled to a pension shall be regarded as miners.
(a) after 31 December 1946 in accordance with the regulations on mining pension or mining pension insurance;
(b) before 1 January 1947, if they have been employed in mining for at least 15 years, or at least half of the insured period, or immediately before entitlement to a pension is established, at least 5 years; the condition of the period of employment is deemed to have been fulfilled if the miner's invalidity is due to an accident at work (occupational disease) or before the age of 30.
§ 3.
Increase in widow's pensions.
(1) Widows' pensions (widows) after employees or pensioners of old-age or invalidity pensions from occupational insurance up to a maximum of 280 CZK per month are increased by 10% but to a minimum of 280 CZK per month.
(2) Widows' pensions (widows) for miners (§ 2 (3)), which are below 350 CZK per month, are increased by 10% but at least to 350 CZK per month.
(3) The increase in the pension referred to in paragraphs 1 and 2 shall be for a widow (s) who is disabled or cares for at least 1 child to whom the education is provided or has reached the age of 50 or reached the age of 45 and has raised at least 2 children.
§ 4.
Increases in old-age and invalidity pensions granted from non-occupational insurance.
Old-age and invalidity pensions granted from non-occupational insurance, which do not amount to 300 CZK per month, and if there are widow's pensions, 280 CZK per month, may be increased in cases where the Social Security Service of the District National Committee is not subject to a proposal, except if the beneficiaries of those pensions are deprived and permanently unable to work and have no one who is obliged to provide them with nutrition, particularly if they live in the city.

Increase in national insurance pensions as of 1 January 1957.
§ 5.
Increasing old-age and disability pensions from occupational insurance.
(1) Old-age and invalidity pensions from occupational insurance, amounting to at least 350 CZK per month but not exceeding 600 CZK per month, are increased by 10% to a maximum of 600 CZK per month. However, if entitlement to an old-age pension is acquired after 31 December 1951 from an occupational insurance scheme which has not lasted more than 10 years, the increase shall not apply; This also applies to invalidity pension, unless entitlement to this pension is due to an accident at work (occupational disease) or before the age of 30.
(2) Old-age and invalidity pensions granted to miners (Section 2 (3)) and amounting to at least 600 CZK per month, but not exceeding 800 CZK per month, are increased by 10% but not exceeding 800 CZK per month.
§ 6.
Increase in widow's pensions.
(1) Widows' pensions (widows) after employees or beneficiaries of old-age or invalidity benefits from occupational insurance, which are at least 280 CZK per month but are below 350 CZK per month, are increased by 10%, but up to a maximum of 350 CZK per month. However, the increase in pension is not for the widow
(a) after a staff member who died after 31 December 1951 and whose occupational insurance has not lasted more than 10 years,
(b) after an old-age pensioner, where he has been entitled to an old-age pension after 31 December 1951 from an occupational insurance scheme which has not lasted more than 10 years; This also applies if the widow of the disability pension is a widow, unless entitlement to that pension is due to an accident at work (occupational disease) or before the age of 30.
(2) Widows' (widows) pensions for miners (Section 2 (3)), which are at least 350 CZK per month but do not reach the amount of 420 CZK per month, are increased by 10% to a maximum of 420 CZK per month.
§ 7.
The provisions of this Section shall not apply to pensions which have been increased in accordance with the provisions of the first section of this Regulation.

Oddíl třetí.

Increasing the provisions of military and war damages and war victims and fascist persecution, measured according to Act No. 164 / 1946 Coll.
§ 8.
Increase in disability benefits.
(1) Providing benefits for disabled persons (Article 15 (1) (a) of Act No 164 / 1946 Coll.) with a parental allowance (Article 22 of the same Act) and a pension supplement (Article III of Act No 242 / 1949 Coll.), which have been awarded for a reduction in gainful capacity of at least 65% and which is below 350 CZK per month, are increased to that amount.
(2) The provision of benefits for disabled persons granted to victims of the fight against fascism (paragraph 3) for a reduction of at least 65% of their gainful capacity shall be increased to 600 Kccs per month; an increase of at least 95% in the amount of a person's allowance of 400 CZK per month shall be granted to disabled persons with a reduced gainful capacity.
(3) The victims of the fight against fascism are those to whom provision benefits have been granted
(a) as freedom fighters and victims of persecution (§ 2 (1) (c) to (h) and § 2 (1) (n) in conjunction with the provisions of points (f) to (h) of Act No 164 / 1946 Coll.),
(b) as members of international brigades (§ 2 (5) of Act No. 164 / 1946 Coll.); and
c) as members of the Red Army (§ 81 of Act No. 76 / 1922 Coll., on Military Benefits Providing).
(4) Paragraph 1 shall also apply to military benefits granted to participants in the struggle for independence and liberation of the Czechoslovak Republic pursuant to § 81 of Act No. 76 / 1922 Coll., on military benefits provided.
§ 9.
Increasing widow's welfare.
(1) Widow benefits which are below 280 CZK per month are increased to that amount. Widows' benefits are the widow's pensions (§ § 34 to 40 of Act No. 164 / 1946 Coll.) with an increase supplement, a special supplement and an addition to the pension (§ § 42, 43 and 57 of Act No. 164 / 1946 Coll.) as well as an addition to the pension pursuant to Article III of Act No. 242 / 1949 Coll.
(2) The provision of benefits for widows following the victims of the fight against fascism (Section 8 (3)), which do not reach the amount of 420 CZK per month, is increased to that amount.
(3) Paragraph 1 shall also apply to the military provision benefits of widows (widows) by persons referred to in Paragraph 8 (4).
(4) The increase in widower benefits under the preceding paragraphs shall be for a widow (co-worker) who is disabled or looks after at least 1 child for whom an orphan's pension is granted, or has reached the age of 50 or reached the age of 45 and has raised at least 2 children.

Oddíl čtvrtý.

Provisions common and final.
§ 10.
(1) Under this Regulation, pensions and provision benefits (hereinafter referred to as "pensions') to which entitlement arises or arises before 31 December 1956 shall be increased.
(2) For the purposes of increasing pensions under this Regulation, an increase in income shall not be considered as a loss of professional capacity (occupational disease), education, an increase in helplessness and a medical and blind supplement.
(3) For the purposes of this Regulation, if the same person has two or more pension schemes, or similar public arrangements, or if such pensions are combined only as effective, the sum of pensions paid shall be considered to be one pension. The total of pensions shall not include accident and pension pensions. If one of the pensions has been increased before their coexistence, the right to increase this pension shall cease to exist on the day of coexistence. Where different provisions of this Regulation apply to the increase of individual pensions, the provisions for more favourable pensioners shall apply.
(4) If the pensioner has earnings for which the pension is reduced, the entitlement to an increase in the pension shall be assessed according to the non-reduced pension; the amount by which the pension is increased pursuant to this Regulation shall not be subject to the rules on the reduction of the pension in connection with earnings.
(5) The increased pension is due from the due date of the pension payment.
§ 11.
Pensions paid abroad shall be increased under this Regulation if reciprocity is ensured by national conventions.
§ 12.
The State Pension Insurance Office may take measures to eliminate the hardships that would arise in the implementation of this Regulation.
§ 13.
This Regulation shall enter into force on 1 December 1956, with the exception of the provisions of Section 2, which shall take effect on 1 January 1957; they shall be carried out by the Chairman of the State Pension Insurance Commission.
