Regulation on the safety and economy of the operation of certain technical installations

ensuring the safety and economy of the operation of certain technical installations.
The Government of the Czechoslovak Republic orders, with the agreement of the President of the Republic, pursuant to § 42 paragraph 1 of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan), and under § 1 of Constitutional Act No. 47 / 1950 Coll., on adaptations to the organisation of public administration:
§ 1.
Purpose of the regulation.
The purpose of this Regulation is to ensure the safety of human life and health, national assets and other economic values, as well as efficiency in terms of thermal technology, when operating technical equipment. This is why technical supervision is newly organised and the care of safety and thermal technical measures in the operation of technical equipment is intensified.
§ 2.
Subject matter of technical supervision.
(1) Technical equipment in the course of which the safety of human life and health, national property and other economic values may be compromised or serious economic losses caused by uneconomy in terms of thermal equipment (hereinafter referred to as "technical installations") are subject to technical supervision. In particular, they are steam boilers (steam generators) and other pressure vessels, heavy current electrical equipment and hoists. The Ministry of Fuel and Energy may, in agreement with the competent central authorities and the single trade union organisation, determine under which conditions such technical equipment is exempted from technical technical supervision and which other technical installations are subject to such supervision.
(2) Technical equipment of military administration, Ministry of Communications, Railways to which the Ministry of Railways is supervised, and technical equipment of Czechoslovak Radio and Czechoslovak State Film are excluded from technical technical supervision under this Regulation.
Technical supervisory authorities.
§ 3.
(1) Technical supervision is carried out by the Institute of Technical Supervision at the Ministry of Fuel and Energy and its branch in Bratislava (hereinafter referred to as the Institute).
(2) The activities of the Institute are governed by the rules of organisation issued by the Ministry of Fuel and Energy in agreement with the central authorities involved and by a unified trade union organisation.
(3) The staff of the Institute are required to maintain national, economic and professional secrecy. The obligation to keep secrets shall continue after the staff member's employment has ceased.
§ 4.
The Ministry of Fuel and Energy may, in agreement with the Ministry of Interior and the Single Trade Organisation, delegate certain tasks of technical supervision to national committees.
§ 5.
Tasks of technical supervision.
(1) The technical surveillance authorities shall establish:
(a) whether the technical installations, their operation and maintenance comply with the regulations and technical standards, following the recognised rules of technology and scientific progress;
(b) whether the projects and structures and technical installations in operation comply with the requirements of economy and are used economically at the plant, in particular with regard to the use of less valuable fuels;
(c) whether staff responsible for operating and supervising technical equipment have the necessary expertise both in terms of safety and heat engineering;
(d) for technical installations designated by the Ministry of Fuel and Energy in agreement with the competent central authorities and a single trade union organisation (hereinafter referred to as "dedicated technical installations"), whether their projects, construction, material, production, location and use comply with the requirements of safe operation.
(2) The technical supervision bodies shall provide expert advice and expertise on the matters referred to in paragraph 1, organise courses for training of technical cadres with the aspects listed therein and prepare regulations on the safety of technical installations and on their cost-effectiveness in terms of thermal technology.
(3) In particular, the technical supervision bodies in the exercise of supervision over the safety and economy of the operation of technical equipment are assisting the board of directors and management. They shall carry out their tasks in cooperation with the labour inspection authorities.
§ 6.
Obligations of designers, manufacturers, suppliers and operators of technical installations.
(1) Engineers of technical equipment are responsible for ensuring that the projects and design solutions of technical equipment comply with the regulations on the safety of human life and health, national assets and other economic values and on the cost-effectiveness of thermal equipment. In the case of reserved technical installations, the project shall be submitted for approval by the technical surveillance authority.
(2) Manufacturers are responsible for ensuring and deepening the safety and efficiency of the operation of technical equipment. In the case of dedicated technical equipment, they shall require a report from the technical surveillance authority on the control and approval of calculations and design drawings before they are included in the production plan.
(3) Manufacturers and suppliers are required to ensure that manufactured technical equipment complies with the rules on safety and health at work, on the safety of national assets and other economic values, on economy and safety of operations, as well as with technical standards and recognised technical rules. They shall also be required to draw up and supply the prescribed documents for the manufactured technical equipment.
(4) Operators are required to:
(a) ensure the safety and economy of the operation of technical equipment in accordance with the relevant regulations and technical standards as well as with the instructions of the technical surveillance authorities;
(b) immediately report serious disturbances and detected defects and measures taken to remove them from the technical surveillance authority;
(c) in cases where the technical surveillance authority instructs the inspection or test of the technical equipment to prepare the equipment in time for the required operation, to carry out the required operations in accordance with the instructions of the technical supervision authorities, to provide the necessary explanations and to provide relevant documents;
(d) in the case of technical equipment subject to periodic inspections of [steam boilers (steam generators), pressure vessels, hoists, etc.], report to the technical surveillance authority the date of the planned inspection at the planning date for the following year and, where appropriate, notify it in due time of the change of the planned date;
(e) to report to the technical surveillance authority technical equipment for registration in accordance with directives issued by the Ministry of Fuel and Energy;
(f) to provide training for staff responsible for operating and supervising technical installations.
§ 7.
Implementation of technical supervision.
(1) The technical surveillance authorities shall order the removal of any defects which they detect in the investigation pursuant to the provisions of Section 5 (1).
(2) The Institute also communicates its decisions to the national committee which oversees the removal of defects and to the labour inspector.
(3) The decision of the Institute may be subject to decomposition within 15 days, requesting that the professional findings underlying the decision be reviewed by another institution of the Institute. Decomposition has no suspensive effect, but the Institute may allow the implementation of the decision to be postponed. They shall do so in particular if the life or health of the workers or the technical equipment itself is not at immediate risk.
§ 8.
Access to technical equipment.
The technical surveillance authorities shall be entitled at any time to access technical equipment in accordance with specific regulations issued by the Minister for Fuel and Energy in agreement with the Minister for National Security.
§ 9.
Replacement.
The Institute shall levy compensation for the performance of technical supervision. In agreement with the Ministry of Finance, the rates of such refunds shall be set and more detailed provisions shall be adopted by the Ministry of Fuel and Energy.
§ 10.
Implementing regulations.
The Ministry of Fuel and Energy shall, in agreement with the participating central authorities and the unified trade union organisation, issue regulations on the safety and economy of the operation of technical equipment, on the documents to be produced and supplied by their manufacturers and suppliers, on the professional qualifications of staff serving technical equipment and on how this qualification is acquired and demonstrated.
§ 11.
Repeal of existing regulations.
(1) The provisions relating to the matters governed by this Regulation shall be repealed, in particular:
1. Regulation No 273 / 1860 of the Council concerning safety measures against the risk of explosion of stoves and boilers fitted with a hermetically sealed hatch,
2. Law No 112 / 1871 on testing and periodic examination of steam boilers,
3. Regulation No 130 / 1875 on measures to prevent the explosion of steam boilers,
4. Regulation No 78 / 1877 of the Court of Justice, whereas some amendments are made to Ministerial Decree No 130 / 1875 of the Court of Justice concerning the anti-explosion measure,
5. Regulation No 32 / 1882, which, after the case, complements Ministerial Regulation No 130 / 1875, on measures to prevent the explosion of steam boilers,
6. Regulation No 108 / 1891 (z) concerning the licence to operate steam boilers and to supervise the work of steam boilers as well as to operate steam machinery and to drive locomotives and steam boats,
7. Regulation No 172 / 1893 of the Council on the official inspection and testing of old steam boilers in the trade concerned and for the re-use provided for,
8. Regulation No 108 / 1894 / 94 on how to test steam boilers,
9. Regulation No 59.963 / 1895 K. M. (coal min. trade), as amended by Regulation No 17.752 / 1903 K. M., on the testing and control of steam boilers used in ships and other vessels,
10. Regulation No 50 / 1897 of the Council amending and supplementing the Ministerial Decree of 4 May 1884, Article 2 (1) of the Ministerial Decree of 1 October 1875, on security measures against the explosion of steam boilers,
11. Paragraph 32 to 53 of Regulation No 17.001 / 1901 K. M. (Trade min.), which issues instructions for business inspection and boiler supervision,
12. Act No. 449 / 1920 Coll., amending the provisions of Law No. 112 / 1871, on the testing and periodic inspections of steam boilers,

(2) The provisions of this Regulation shall continue to be adopted in accordance with the existing rules, unless they contradict it.
§ 12.
The effectiveness of the regulation.
This Regulation shall enter into force on 1 November 1952; they shall be carried out by the Minister for Fuel and Energy in agreement with the participating members of the Government.
