determining the amount of the flat-rate compensation in connection with the transfer of the number or change of the provider of the Internet access service and the manner in which information on the right to flat-rate compensation is published
The Ministry of Justice, in cooperation with the Ministry of Industry and Trade, provides pursuant to Section 150 (6) of Act No. 127 / 2005 Coll., on Electronic Communications and amending certain related laws (Act on Electronic Communications), as amended by Act No. 468 / 2011 Coll. and Act No. 374 / 2021 Coll., for the implementation of Sections 34 (11) and 34a (11) of the Act on Electronic Communications:
Reimbursement on delay with the transfer of a number or change of the provider of Internet access service
(1) If there is a delay in transferring the number or changing the provider of the Internet access service, the amount of the flat-rate refund is CZK 200 for each day of delay.
(2) Starting on the sixth day of the delay, the participant shall receive a flat-rate refund of CZK 400 for each day of delay.
(3) Where more than one participant's number is transferred simultaneously and more than 10 numbers are late, the flat-rate refund referred to in paragraphs 1 and 2 shall be at the eleventh and half the rate referred to in paragraphs 1 and 2.
Compensation for misappropriation of a number or change to an Internet access service provider
In the case of misuse of a number transfer or misuse of a change of an Internet access service provider, the amount of a flat-rate refund shall be CZK 600 for each starting day, after which the condition resulting from the misuse of the number transfer or change of the Internet access service provider persists.
Compensation for non-compliance with repair and installation deadlines
(1) If an entrepreneur providing a public communications network or providing a publicly available electronic communications service or an Internet access service provider (hereinafter referred to as "the entrepreneur") fails to comply with the agreed date of repair and installation, the amount of the flat-rate refund shall be CZK 200 for each day of delay. However, if an entrepreneur has the right to similar transactions under the contract in the event that the participant does not provide him with synergies during repair and installation under the agreed conditions and the amount of such transactions exceeds CZK 200, the participant shall be entitled for the first day of delay, instead of a flat-rate refund according to the first sentence, a flat-rate refund corresponding to the amount of such transactions, but not more than CZK 1 000.
(2) Starting on the sixth day of the delay, the participant shall be reimbursed in the amount of CZK 400 for each day of delay.
Method of publication of information on the right to flat-rate compensation
Information on the right to a flat-rate refund, including its amount, shall be published by the entrepreneur on his website in a clear, understandable and easily accessible manner. Such information or a reference to it shall always be published by the entrepreneur together with information on the procedure for transferring the number or changing the provider of the Internet access service.
Efficacy
This Decree shall take effect on 1 January 2022.
