DECLARATION
of 14 December 2005
on the establishment of models in the field of personnel security and safety competence and on the lists of documents attached to the application for the issue of a natural person's certificate and the application for a document on the safety competence of the natural person and on the manner in which such applications are to be submitted (Personnel Security Order)
The National Security Authority shall determine, pursuant to § 7 (3), § 9 (8), § 64, § 85 (5) and § 135 (a) to (f) and § h) of Act No. 412 / 2005 Coll., on the Protection of classified information and on security competence, hereinafter referred to as "the Act":
Models in the field of personnel safety and safety competence
(1) The model of the declaration of legal capacity by a natural person is set out in Annex 1 to this Decision.
(2) The model of the declaration of personality is set out in Annex 2 to this order.
Models in the area of personnel security
(1) The template for the notification of compliance with the conditions for access to classified information of a natural person is set out in Annex 3 to this Regulation.
(2) The model of the lesson is set out in Annex 4 to this Decree.
(3) The model of the application for a natural person's certificate is set out in Annex 5 to this Decree.
(4) The model of the natural person questionnaire is set out in Annex 6 to this Decree. The model of the natural person's questionnaire shall also specify the scope of the data of the natural person's questionnaire completed in the case of a request under Paragraph 94 (4) of the Act.
(5) The model of the certificate of a natural person is set out in Annex 7 to this Decree.
(6) The model of the application for a certificate of a natural person for a force majeure is set out in Annex 8 to this Decree.
(7) The model of the application for recognition of the security authorisation of a natural person is set out in Annex 9 to this Decree.
(8) The model of the lesson provided for in Paragraph 58 (5) of the Act is set out in Annex 10 to this Decree.
Model for safety competence
(1) The model of the application for a natural person's safety evidence is set out in Annex 11 to this Decree.
(2) The model of the questionnaire is set out in Annex 12 to this Decree. The questionnaire model shall also determine the scope of the questionnaire data completed in the case of a request under Section 99 (4) of the Act.
(3) The model of the evidence of the safety competence of a natural person is set out in Annex 13 to this Decree.
List of documents attached to the application for a natural person's certificate and the application for a natural person's security document
A natural person shall affix to an application for a certificate of a natural person or an application for a document of the security of a natural person pursuant to § 94 (2) (b) or § 99 (2) (c) of the Act:
(a) the birth or birth certificate and, where appropriate, other similar documents;
(b) proof of the highest education achieved;
(c) confirmation of study abroad, including the duration of study;
(d) decisions of law enforcement authorities;
(e) the employer's certificate of income, indicating the amount thereof, in the case of another type of income, of a tax return or of another document confirming that income, 5 years in the case of a first application for a certificate or for a period which has elapsed since the last submission of such documents in the security procedure;
(f) evidence of the rights of third parties burdensome to the applicant's ownership;
(g) documents documenting the difference between the entry in the public register of a court or other public authority and the fact; and
(h) a decision by the competent authority on the enforcement regulation.
Application procedure
(1) The completed models set out in Annexes 1, 2, 6 and 12 to this Decree shall be submitted in both electronic and paper form, shall be submitted in electronic form on the technical medium of the data.
(2) The electronic template of the designs set out in Annexes 1 to 6 and 8 to 12 to this Decree is published in a manner that allows remote access at the National Security Office's website.
(3) The paper form of the completed models referred to in paragraph 1 must correspond to their electronic form, except for signature.
Efficacy
This Decree shall take effect on 1 January 2006.
