to carry out qualification tests replacing professional competence for the operation of certain trades
The Ministry of Economy of the Czech Republic, the Ministry of Industry and Trade of the Czech Republic, the Ministry of Education, Youth and Sports of the Czech Republic, the Ministry of Interior of the Czech Republic, the Ministry of Health of the Czech Republic and the Ministry of Agriculture of the Czech Republic provide, pursuant to § 22 paragraph 2 of Act No. 455 / 1991 Coll., on Business Business (Trade Act), (hereinafter referred to as "the Act"):
Purpose of the Order
The purpose of this decree is to determine the content and manner of carrying out the qualification examination, (1) which replaces the professional competence (2) demonstrated by a teaching certificate or other evidence of the proper completion of the teaching profession and of the evidence of performance of the prescribed length of practice for the exercise of the trades of crafts3) and, to the extent set out in the annexes to the law, also for the exercise of the trade linked (4) and licensed. 5)
Qualification test
(1) The qualification test (hereinafter referred to as the "test") cannot be replaced by the professional qualifications demonstrated in accordance with the specific rules set out in Annexes 2 and 3 to the Act for tied and licensed trades.
(2) The examination will take place before the Examination Board in secondary vocational schools6) and secondary vocational educations7) (hereinafter referred to as educational establishments). The competent authority of the State administration, of which 8) belongs to the sector in which the business is carried out, shall ensure that the educational establishment in which the examination takes place is published in the Commercial Journal for each school year. 9) The selection of the educational establishment shall be carried out by the central administration if it does not manage it itself. The list of training establishments for applicants is also available at the relevant trade offices. 10)
(3) The application for examination shall be submitted by the tenderer to the designated educational establishment. The application shall state:
(a) the name and address of the educational establishment;
(b) name, surname, birth number, ID number, permanent residence;
(c) trade (field of business);
(d) date of completion, signature by hand.
(4) In cases where, in the specific content of the examination referred to in Annex 1, which is part of this Order, a special course is required, 11) the tenderer shall submit the relevant proof of completion at the same time as the application.
(5) The educational establishment shall set at least two dates for the examination for the school term. At the same time as the date of the examination is determined, the educational establishment shall notify the amount of the payment for the performance of the examination, determined in accordance with the applicable price regulations.
(6) The invitation to be tested shall be delivered by the educational establishment to the tenderer no later than one month before the date of the examination. In addition to the invitation, the candidate will receive a range of test questions identifying the aids or means to test the holidays.
Test Panel
(1) The members of the Examination Committee12 (hereinafter referred to as "the Commission") shall be appointed by the Director of the educational establishment in such a way that one member shall always be appointed as a representative of the competent trade office on a proposal from that office and, if the relevant trade association is set up, 13) another member shall be appointed on a proposal from that community.
(2) The chairman of the commission shall be appointed a representative of the educational establishment, a deputy chairman of the relevant trade office. The experts for the individual part of the examination are usually appointed from the pedagogical works14) the educational establishment. The director of the educational establishment may not be a member of the commission in the educational establishment he manages.
(3) The Commission shall act in a number of five members and shall act by a majority of its members.
Content and method of test
(1) The content of the test is based on the syllabus of the study or teaching sector which is consistent with the relevant business business (hereinafter referred to as "business"). For a business which is not in conformity with the study or teaching field, the content of the test shall be determined from the study or teaching field of the relative. If the content content is not determined for each trade by these means, it is determined by the specific test content.
(2) The examination for individual trades shall demonstrate knowledge and skills within the scope of the final examination of the relevant field of study or teaching referred to in Annex 1 which is part of this decree and, where applicable, the specific content of the test referred to in Annex 1.
(3) The test consists of part theoretical and part practical. In the theoretical part, which is carried out orally and in writing, the applicant shall demonstrate a summary of the expertise in the relevant business business, and in the practical part of the examination the tenderer shall demonstrate the ability to use theoretical knowledge in the course of the business.
(4) The theoretical part of the test takes no more than 60 minutes, the practical part of the test lasts no more than 240 minutes.
Notification of test result and certification
(1) The Commission shall report the result of the examination to the tenderer on the day of the examination.
(2) The educational establishment shall be issued to the successful tenderer within 14 days of the examination of the certificate at the latest. The certificate shall contain:
(a) the name and address of the educational establishment;
(b) the name, surname, birth number, permanent residence of the tenderer;
(c) the date of the examination, the date of issue of the certificate;
(d) the trade for which the certificate is issued;
(e) the stamp of the educational establishment and the signature of the Chairman of the Examination Board.
(3) The certificate confirms the competence of each trade within the scope laid down by law.
(4) The administrative rules shall not apply to the conduct of the examination and certification.
Test schedule
The procedure for carrying out the test, its evaluation, the rights and obligations of the Examination Board and the applicant shall be further adapted to the test schedule set out in Annex 2, which is part of this Order.
Determination of the replacement time and repeat of the test
(1) Candidates who could not attend the examination for serious reasons or have duly apologized for their non-participation shall, in agreement with the training establishment, set a replacement test date in accordance with Article 2 (4) and (5).
(2) A candidate who has failed the test may submit a new application for the test in accordance with Paragraph 2 (3).
This decree shall take effect on the day of its publication.

Conditions for carrying out qualification tests replacing professional competence for the conduct of trade
I. Rights and obligations of the Commission and its President
1.
(a) prepare test questions for oral examination and topics or text for written examination;
(b) inform the tenderer of his rights and obligations, of the organisation of the examination and of the manner in which he is assessed;
(c) notify the tenderer before each part of the examination has begun;
(d) may exclude a tenderer who, during the examination, uses illicit aids or means or, where appropriate, significantly impedes the course of the test;
(e) decide on any issue at issue relating to the examination.
2.
(a) verify the identity of the tenderer according to the personal documents and the application;
(b) manage the meetings and work of the Commission, ensure the proper conduct of the Commission;
(c) ensure a protocol record (hereinafter referred to as the "Protocol") of the course and result of the test, indicating:
- the name and address of the educational establishment, the reference number of the protocol,
- name, surname, birth number, permanent residence of the applicant,
- the composition of the Commission,
- the trade for which the test took place,
- entering and evaluating each part of the test,
- overall assessment of the test,
- the date of completion of the protocol, the signatures of the members of the commission and the stamp of the educational establishment.
The original of the protocol on the course and result of the examination shall be established for the educational establishment.
II. Method of conducting the test
(a) the test consists of two separate parts, practical and theoretical;
(b) the practical part of the test shall be carried out by the tenderer before the theoretical part of the test; in the case of the unsuccessfully completed practical part of the test, the test shall no longer take place from the theoretical part.
III. Evaluation
(a) the outcome of the examination shall be decided by the members of the Commission;
(b) the result of the test shall be assessed by the classification grade "benefit" or "benefit";
(c) the classification grade "benefit" shall be assessed by a candidate who has demonstrated knowledge and skills within the scope of the final examination of the relevant field of study or teaching or, where appropriate, the specific content of the test referred to in Annex 1;
(d) the classification grade "non-profit" shall be evaluated by a tenderer who has not demonstrated the required knowledge within the scope of the final examination of the relevant field of study or teaching or, where applicable, the specific content of the test set out in Annex 1;
(e) the classification grade "failed" shall also be evaluated by the candidate who has been excluded from the test.
IV. Rights and obligations of the applicant
(a) the selection of the training establishment is at the discretion of the applicant;
(b) the tenderer who has passed the test has the right to be certified under this Order;
(c) failure to participate in the examination for serious reasons (Paragraph 7 (1)) shall be subject to the obligation of the applicant to apologise to the educational establishment within 3 days of the date of the examination.
