DECLARATION
of 21 November 2006
laying down the limit values for noise indicators, their calculation, the essential requirements for the content of strategic noise maps and action plans and the conditions for public participation in their preparation (Noise Survey Decree)
The Ministry of Health provides pursuant to § 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on amendments to certain related laws, as amended by Act No. 392 / 2005 Coll. and Act No. 222 / 2006 Coll., ("the Act ') for the implementation of § 80 (1) (s) of the Act:
§ 1
Initial determination
This decree (1) implements the relevant regulations of the European Communities (2) and regulates the limit values of noise indicators, their calculation for noise generated by road, rail, air and noise from equipment covered by the Integrated Prevention Act (3) ("Integrated Devices'), the essential requirements for the content of strategic noise maps and action plans, the details of how the public is informed of strategic noise maps, the preparation of draft action plans and the participation of the public in them, and the elaboration of action plans.
§ 2
Noise indicators and their limit values
(1) Noise indicators are noise indicators for day-night (Ldvn), for day (Ld), for evening (Lv) and for night (Ln). The calculation of noise indicators is set out in Annex 1 to this Decree.
(2) Noise indicator for
a) day-evening (Ldvn) is a noise indicator for all-day noise harassment,
(b) day (LD) is a noise indicator for noise harassment during the day;
(c) evening (Lv) is a noise indicator for noise harassment during the evening;
(d) night (Ln) is a noise indicator for sleep interference.
(3) For noise indicators for day-night (Ldvn) and night (Ln) the following limit values are set:
(a) for road transport Ldvn is equal to 70 dB and Ln is equal to 60 dB;
(b) for rail transport Ldvn is 70 dB and Ln is 65 dB;
(c) for air transport Ldvn is equal to 60 dB and Ln is equal to 50 dB;
(d) for integrated Ldvn devices is 50 dB and Ln is 40 dB.
§ 3
Strategic noise maps
(1) The essential requirements for the content of strategic noise maps are set out in Annex 2 to this Decree.
(2) Noise mapping means the presentation of data on the current noise situation using a noise indicator showing an excess of the relevant limit value, data on the number of persons and buildings for housing, schools, educational advisory facilities, educational and further education facilities, educational and accommodation facilities, school catering facilities, diagnostic institutes, children's homes, school homes, educational institutions, education centres and hospitals exposed to defined noise indicators in the area for which the noise map is being processed.
§ 4
Information to the public on strategic noise maps
The strategic noise maps shall be processed as graphical outputs, maps showing the exceeding of noise limit values, differential maps on which the existing situation is compared with the various possible future situations, and maps showing the noise indicator value, where appropriate, at a height other than 4 m above the terrain. These strategic noise maps are made available to the public by the Ministry of Health (hereinafter referred to as "the Ministry ') in paper form in its headquarters and in electronic form at the Ministry's website.
§ 5
Action plans
The basic requirements for the content of the action plans are laid down in Annex 3 to this Decree.
§ 6
How to inform the public about action plans and public participation in their preparation
(1) The Ministry of Transport and the Regional Authorities (hereinafter referred to as the "purchaser") make the draft action plans and action plans available.
(a) in paper form at the place of its registered office;
(b) in electronic form at its website.
At the same time, the Buyer shall post a notice on his official record of where the draft action plans and the action plans may be consulted.
(2) The contracting authority shall publish, in accordance with paragraph 1, the arrangements for evaluating the public's initiatives and opinions on draft action plans.
§ 7
Efficacy
This decree shall take effect on the day of its publication.

Calculation of noise indicators
Noise indicators related to the harmful effect of noise shall be calculated;
1. harmful effects of noise are the effects which are adverse to human health, noise harassment, the feeling of discomfort resulting from noise action on persons exposed to the defined noise indicator values,
2. dose-effect relationship means the relationship between the value of the noise indicator and its harmful effect;
3. the value of the noise indicator for the day-evening (Ldvn) in decibels (dB) is defined by the formula
Ldvn = 10.log12412.10Ld10 + 4.10Lv + 510 + 8.10Ln + 1010
where
Ld is the long-term average of the sound pressure level weighted by function A according to Czech technical standard4) determined for all daily periods of one year,
The lion is the long-term average of the sound pressure level weighted by function A according to the Czech technical standard4) for all evening periods of one year,
Ln is the long-term average of the sound pressure level weighted by function A according to Czech technical standard4) for all night periods of one year
and where
the day is 12 hours between 6.00 and 18.00 hours; the evening is 4 hours between 18: 00 and 22: 00 and 8 hours between 22: 00 and 6: 00, and
the year is the relevant calendar year in terms of noise emissions and the average year in terms of weather conditions.
4. When calculating the noise indicator, account shall be taken of a sound incident which does not contain sound reflecting from the circumference of the protected object concerned. In the case of verification of the values of this noise indicator, the value of 3 dB shall be deducted from the values measured for the circuit shell.
5. In the case of calculation for the purposes of strategic noise mapping with regard to the exposure of persons to noise in and near buildings, the assessment point at a height of 4,0 m ± 0,2 m (3,8 to 4,2 m) above the terrain shall be the most exposed part of the envelope. For this purpose, the most exposed part of the circuit shell means the outer wall of an object oriented towards the nearest specific noise source.
6. Other heights may be chosen for acoustic planning and noise zones, in particular for rural areas with single-storey houses, for the design of local measures designed to reduce noise load on certain housing structures or for detailed noise mapping in a defined area to identify the exposure level to defined noise levels. However, in such cases the assessment points shall never be less than 1,5 m above the terrain.
7. For the calculation of noise values for road, rail, air transport and for integrated equipment, the provisional calculation methodology referred to in Commission Recommendation 2003 / 613 / EC of 6 August 2003 on guidelines for revised provisional methods for the calculation of industrial noise, air noise, road noise and rail noise as well as related emission values shall be used.

Essential requirements for the content of strategic noise maps
1. General section - common content of strategic noise maps
The strategic noise map shall be a summary of the data on each of the following aspects:
1.1. Existing, previous or anticipated noise situation, expressed as a noise indicator,
1.2. exceeding the limit value of the noise indicator in the relevant calendar year and in the area for which the strategic noise map is being drawn up;
1.3. Estimated number of persons exposed to defined noise indicator values in the area for which a strategic noise map is being drawn up;
1.4. Estimated number of buildings for housing, schools, school counselling facilities, educational and further education facilities, educational and accommodation facilities, school catering facilities, diagnostic institutes, children's homes, school homes, educational institutions and centres of education and hospitals exposed to defined noise indicators in the area for which a strategic noise map is being processed.
Strategic noise maps shall be drawn up to document the noise situation in bands of 5 dB.
2. Special section - content requirements for individual types of strategic noise maps
A. Strategic noise maps for agglomeration focus on noise caused by:
2.1. Operation on major roads,
2.2. Operation on main railway lines,
2.3. Operation of major airports,
2.4. Integrated devices,
unless Part Nine of Article XII of Act No 222 / 2006 Coll., amending Act No. 76 / 2002 Coll., on Integrated Pollution Prevention and Control, on Integrated Pollution Register and on the Amendment of Certain Acts (Integrated Prevention Act), as amended, and certain other laws, otherwise.
Separate strategic noise maps shall be drawn up for these noise sources.
Strategic noise maps for agglomeration include:
2.5. Brief description of the agglomeration: location, size, population,
2.6. Listing and content of noise protection programmes that have been implemented in the past and current noise prevention measures;
2.7. the calculation methods used,
2.8. the estimated total number of persons (in hundreds) living in housing structures, which are at a height of 4 m above the ground for the most exposed part of the circumference, exposed to the following noise indicator ranges for the day-night (Ldvn) in dB 55-59, 60- 64, 65- 69, 70- 74, > 75, determined separately for the source noise referred to in points A 2.1 to 2.4. The values must be rounded to the nearest 100 (for example, 5,200 = between 5,150 and 5,249, 100 = between 50 and 149, 0 = less than 50),
2.9. the estimated total number of persons (in hundreds) living in residential buildings that are at a height of 4 m above the ground for the most exposed part of the circuit shell exposed to the following noise indicator values for the night (Ln) in dB 45- 49, 50- 54, 55- 59, 60- 64, 65- 69, > 70, determined separately for the source noise referred to in points A 2.1 to 2.4.,
2.10. where possible, the number of persons in the above categories living in residential buildings where noise prevention measures are implemented;
2.11. where possible, the number of persons living in residential buildings with a quiet part of the perimeter, meaning that part of the perimeter of the building for housing, where the value of the noise indicator for the day-night (Ldvn) at a height of 4 m above the ground and 2 m before the circumference is more than 20 dB lower for noise from a specific source than for the part of the envelope exposed to the highest noise indicator for the day-night (Ldvn),
2.12. data on the contribution to noise of the main infrastructure, the main railway lines, the main airports and the integrated equipment;
2.13. in the case of graphical representation of at least the isophones for (Ldvn) 40, 45, 50, 55, 60, 65, 70 and 75 dB.
B. Strategic noise maps for major infrastructure, main railway lines or major airports include:
2.14. general description of infrastructure, railway lines or airports, in particular location, size, traffic data;
2.15. characteristics of the surrounding area: agglomeration, village, countryside or other surroundings, information on land use and other sources of noise,
2.16. the list and content of noise protection programmes which have been implemented in the past and the current noise protection measures;
2.17. the calculation methods used,
2.18. Estimated total number of persons (in hundreds) living outside the conurbations in housing buildings at a height of 4 m above the ground and, for the most exposed part of the circumference, exposed to the following noise indicator ranges for the day-night (Ldvn) (dB): 55- 59, 60- 64, 65- 69, 70- 74, > 75,
2.19. Estimated total number of persons (in hundreds) living outside the agglomeration in housing buildings at a height of 4 m above the ground and, for the most exposed part of the circumference, exposed to the following noise indicator values for the night (Ln) (dB): 45- 49, 50- 54, 55- 59, 60- 64, 65- 69, > 70,
2.20. where possible, the number of persons in the above categories living in residential buildings where noise prevention measures are implemented;
2.21. Where possible, the number of persons living in residential buildings with a quiet part of the perimeter envelope, meaning that part of the housing envelope, where the value of the noise indicator for the day-night (Ldvn) at a height of 4 m above the ground and 2 m before the perimeter envelope, is more than 20 dB lower for noise from a specific source than for the part of the envelope which has the highest noise indicator for the day-night (Ldvn),
2.22. the total area (in km2) exposed to noise levels for a daily evening (Ldvn) of more than 55, 65 and 75 dB, the estimated total number of buildings for housing (in hundreds) and the estimated total number of persons (in hundreds) living in each of these areas; the data relate to the agglomeration,
2.23. On one or more noise maps providing information on the location of municipalities, cities and conurbations, isophones for (Ldvn) 55 and 65 dB.

Basic requirements for the content of action plans
The action plan shall include:
1. a description of the conurbation, major infrastructure, major railway lines or major airports and integrated facilities;
2. the designation of the purchaser,
3. the list of legislation on the basis of which the action plans are prepared,
4. noise limit values;
5. summary of noise mapping results,
6. an assessment of the number of persons exposed to noise (noise harassment, sleep disturbance and other effects), the definition of problems and situations to be improved;
7. All approved or implemented noise prevention measures, all projects prepared, including proposals for the announcement of silent areas in the agglomeration,
8. the measures which the purchasers plan to take over the next 5 years, including any measures to protect quiet areas;
9. long-term noise protection strategy;
10. economic information - assessment of cost efficiency, assessment of noise protection costs and benefits, estimated reduction of noise exposure.
1) It is issued on the basis and within the limits of the law to which the relevant directive of the European Communities has already been reflected.
2) Directive 2002 / 49 / EC of the European Parliament and of the Council of 25 June 2002 on the assessment and management of ambient noise.
3) Act No. 76 / 2002 Coll., on integrated pollution prevention and control, on integrated pollution register and on amending certain laws (Integrated Prevention Act), as amended.
