of 27 November 1990
amending and supplementing Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (School Act), as amended by Act No. 171 / 1990 Coll.
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (School Act), as amended by Act No. 171 / 1990 Coll. is amended as follows:
1. in Article 10 (1) and (2):
"(1) The Centre Vocational Training Centre or the Centre for Practical Teaching shall set up or abolish a central body of government, or an agricultural or other cooperative (cooperative).
(2) The Government of the Czech Republic in the Czech Republic and the Government of the Slovak Republic in the Slovak Republic (hereinafter referred to as the "Government of the Republics") provide for cases where the central authority of the state administration is obliged to establish a secondary vocational training centre or a centre of practical teaching. At the same time, they shall determine the conditions for concluding contracts for their material and financial security. ';
paragraph 3 is deleted;
paragraph 4 is renumbered paragraph 3;
paragraph 5 shall become paragraph 4 and shall read as follows:
"(4) The secondary vocational training centre set up under paragraph 1 shall be a legal person. The centre of practical instruction set up under paragraph 1 may also be a legal person. ',
paragraph 6 shall become paragraph 5;
the following paragraphs 6 and 7 are inserted after paragraph 5:
"(6) Where a State enterprise or public organisation which has transferred management law pursuant to Paragraph 11a or their legal successor, the competent authority of the State administration to which the right of management has been transferred shall apply for the free use of the assets of the secondary vocational training centre or of the practical training centre, that authority of the State administration shall conclude an economic contract with the State enterprise or the state organisation or their legal successors. This contract shall define the conditions for the operation of a secondary vocational training centre or centre of practical instruction.
(7) By decree, the Ministry of Education shall lay down the terms and conditions for the conclusion of economic contracts referred to in paragraph 6, their formalities, the grounds for and the manner in which they are repealed. "
2. in § 11 (2) to (6):
"(2) The institutions in their field of competence in secondary vocational education manage and plan youth training for the profession.
(3) The institutions which have decided to abolish, divide, merge or merge a secondary vocational training centre or a centre of practical teaching shall designate a secondary vocational training centre or a centre of practical teaching which shall assume the rights and obligations of pupils.
(4) Organisations may be entrusted with the management of secondary vocational schools by a central authority.
(5) In the event of the disappearance of a cooperative or, where appropriate, a secondary vocational training centre or a centre of practical training within its competence, the cooperative shall be required to offer, as a priority, assets serving the secondary vocational training centre or a centre of practical training to the competent central administration, which shall establish a secondary vocational training centre or a centre of practical training, or shall add the assets thus acquired to the established secondary vocational training centre or centre of practical training.
(6) By decree, the Ministry of Education provides for a procedure and a more detailed definition of the tasks of the institutions and organisations in the management and preparation of youth for the profession of secondary vocational teachers and centres of practical teaching and the conditions for their establishment. ',
paragraph 5 shall become paragraph 7.
3. The following Section 11a is inserted after Section 11:
(1) A state enterprise or public organisation whose internal organisational unit is a secondary vocational training centre shall transfer, by 30 June 1991 at the latest, the right of management of the property used on 30 June 1990, mainly for the preparation of youth for the profession and professional activities, to the central authority responsible for the establishment of the secondary vocational training centre referred to in Article 10. If, for serious reasons, the competent central government authority cannot establish a secondary vocational training centre, it shall, with the approval of the Ministry of Education, transfer the right to manage such property to another central administration which shall establish a secondary vocational training centre within its competence. The extent of the assets to which the right of management is transferred shall be proposed by the receiving central administration.
(2) A state enterprise or state organisation whose internal organisational unit is the centre of practical teaching shall transfer, by 30 June 1991 at the latest, the right of property management (1) serving on 30 June 1990 mainly for the preparation of youth for the profession and professional activities to the competent central authority of the state administration. This central government body shall assign a centre of practical instruction to a secondary vocational training centre within its competence or establish a centre of practical instruction in accordance with Section 10.
(3) If the centre of practical teaching is a physically inseparable part of a state enterprise or a state organisation, they shall conclude an economic contract with the relevant secondary vocational training centre no later than 30 June 1991 on the property serving on 30 June 1990, mainly for the preparation of youth for the occupation and professional activities of a temporary using2) or, exceptionally, a contract for hire. 3)
(4) Where a state enterprise or public organisation whose internal organisational unit is a secondary vocational training centre or a centre of practical training ceases to be liquidated, the procedure laid down in paragraph 1 or paragraph 2 shall be followed. In exceptional cases, if the assets serving the Centre cannot be transferred in such a way, the liquidator shall provide financial compensation to the competent secondary vocational training centre.
(5) The detailed arrangements for concluding the economic contracts referred to in paragraphs 1 to 4 are laid down by the Government of the Republics by regulation.
(6) Disputes concerning the transfer of the right of management referred to in paragraphs 1 to 3 are decided by the oglans of economic arbitrage. "
4. The second sentence of Paragraph 12 (2) reads: "The investment development of secondary vocational schools and practical training centres set up by the cooperative shall be provided by the cooperative from its sources."
5. In Article 17 (2), the words "Article 11 a 'shall be inserted after the words" Article 11'.
6. In Article 32 (5), the words "Article 11 a 'shall be inserted after the words" Article 11'.
7. In § 57a (1), the words "§ 11 a 'shall be inserted after the words" § 10a'.
8. In Article 57b (1), the words "Article 11a 'are inserted after the words" Article 10a'.
9. In Paragraph 63 (4), the words "§ 11a 'and the words" 31.12.1990' are replaced by the words "30.6.1991 '.
This Act shall take effect on the 15th day following its dispatch.
