DECLARATION
of 13 December 2005
amending Decree No. 84 / 2001 Coll., on sanitary requirements for toys and products for children under 3 years of age
The Ministry of Health provides pursuant to § 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 274 / 2001 Coll., Act No. 320 / 2002 Coll., Act No. 274 / 2003 Coll. and Act No. 392 / 2005 Coll., ("the Act ') for the implementation of § 26 (1) (b) and (d) and paragraphs 8 and 9 of the Act:
Decree No. 84 / 2001 Coll., on sanitary requirements for toys and products for children under 3 years of age, is amended as follows:
1. in Paragraph 1 (1) (d), the word "others" shall be deleted;
2. In Article 1 (1), at the end of the text in point (d), the words "; if it is a dress-up, it shall be considered as a product for children under the age of 3 years of dress-up up up to 110, including size 110 '.
3. In Article 1, at the end of paragraph 3, the sentence "The requirements for products intended for children under the age of 3 and intended in their final state for contact with food and dishes or in contact with food and dishes and intended for this purpose are laid down in a separate legislation (4)."
4. In the first sentence of Paragraph 2 (6), "Products' is replaced by" Coloured products'.
5. In the second sentence of Article 2 (6), "plastic 'is replaced by" coloured plastic' and "surface 'is replaced by" coloured surface'.
6. In the first sentence of Article 3 (5), the words "for children from elastomers referred to in Article 7 (1) may be replaced by" for children referred to in Article 7 (1) may be. "
7. Paragraph 4 (1) reads as follows:
"(1) A dyed fabric product for which a repeated test has been carried out to verify the change in the colour of the product and the result of the repeated test is in accordance with the requirements set out in Annex 10 shall contain on the packaging, label, label or label of the product a visible, easily legible and indelible warning" Before first use of the wash. 8. In Article 4 (2), "outside retail sales' is replaced by" outside sales of the product to the consumer '.
9. In Article 4, the following paragraph 3 is added:
"(3) When placed on the market, products shall be marked with a commercial firm or with the name of the manufacturer or importer and the address of their registered office, if they are a legal person, and by a commercial firm or by the name, surname and address of the place of business, if they are a natural person operating under specific legislation. ';

Non-metallic surface-coating products
The non-metallic coating of the products shall not exceed the hygiene limits set out in Annex 7. ';
11. in Paragraph 6 (1):
"(1) In the manufacture of products which are intended for childcare and which may be put into the mouth by children, they shall not be used as substances or as constituents of preparations of phthalic acid esters listed in Annex 6 (I) at concentrations exceeding 0,1% by weight in plasticised polymer material. ';
12. in Paragraph 6 (2):
"(2) In the manufacture of childcare products, they shall not be used as substances or as constituents of the preparation of phthalic acid esters listed in Annex 6, point II, at concentrations exceeding 0,1 per cent (weight) in plasticised polymer material. ';
13. in Article 6 (4), the words "for example, baby anemones, biters and cooling rings," shall be deleted.
14. in Article 6 (5), the words "for example, baby scrubbers, bites and cooling rings," shall be inserted after the words "in the mouth."
15. in Article 7 (1), the words "for example, baby anemones, biters and cooling rings," shall be deleted;
16. in Article 7 (2), the words "for example, baby scrubbers, bites and cooling rings," shall be inserted after the words "in the mouth."
17. in Article 11 (a), "additives" is replaced by "substances."
18. in Article 11 (e) and (f), the word 'additives' is replaced by 'substances';
19. In Article 12 (1), "rubber 'is replaced by" elastomers'.
20. In Section 13, the words "and their markings' are deleted.
21. In Paragraph 13 (3), the second sentence shall be replaced by the sentence "The azo dyes resulting from the risk aromatic amines listed in Annex 2 shall not be used for colouring and decoration of toys."
22. in Paragraph 13 (4):
"(4) Toys referred to in § 1 (1) (a) to (c) made of soft plastic shall not contain more than 0,1 per cent by weight of one or more phthalic acid esters listed in Annex 6."
23. Paragraph 13 (5) is deleted.
Paragraphs 6 and 7 shall become paragraphs 5 and 6.

Natural materials, such as cork or wood of non-toxic wood, which is free from spoils, bark residues and resinoids, with a smooth uncracked surface, may be used for the manufacture of toys and baby products. These materials shall not show signs of pest infestation or micro-organisms, in particular microscopic fibrous sponges. ';

26. In Annex 7 (1), the words:
"primary aromatic amines 0,002 mg aniline hydrochloride / dm2"
shall be replaced by:
"primary aromatic amines 0,005 mg aniline hydrochloride / dm2 ';
27. In Annex No 8, point 4, the words "product weight 'shall be inserted after the words" the following limits'.
28. In Annex 8, point 7, "2,2 g sodium dihydrogen phosphate dihydrate - Na2HPO4.2 H2O 'is replaced by" 2,2 g sodium dihydrogen phosphate dihydrate - NaH2PO4.2 H2O'.

In the case of satisfactory results for a repeated test to verify the change in the stability, the product shall be marked in the manner specified in Section 4 (1). ';

Transitional provision
The provisions of this Order shall not apply to products intended for children under the age of 3 years and placed on the market before the date of entry into force of this Decree.
Efficacy
This Decree shall take effect on 1 January 2006.
