DECLARATION
of 8 December 2020
on the implementation of adaptive integration courses
The Ministry of Interior provides pursuant to § 182 (1) (h) and (i) of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended by Act No. 176 / 2019 Coll., (hereinafter referred to as "the Act") for the implementation of § 155b (1) and (5) to (7) of the Act:
INTRODUCTORY PROVISIONS
Subject matter
This decree provides for:
(a) requirements for the organisational provision of an adaptive integration course (hereinafter referred to as "the course") provided by the Centre to promote the integration of foreigners (hereinafter referred to as "the centre");
(b) the amount of remuneration for participation by a stranger in the course;
(c) content and time range of the course;
(d) conditions for passing the course by a stranger;
(e) the compulsory particulars of the proof of completion of the course;
(f) the requirements for the competence of the course instructor (hereinafter referred to as "the tutor") and the course interpreter (hereinafter referred to as "the interpreter"); and
(g) the content, scope and other requirements of the examinations for teachers and interpreters and the way in which they are carried out and evaluated.
KURZ AND HIS ORGANISATION INSURANCE
Course types
(1) From the point of view of organisational collateral, courses are divided into courses intended for the public and courses not intended for the public.
(2) Any stranger who has paid the fee for his participation in the course has the right to apply for a public course.
(3) A non-public course may be provided by the Centre at the request of a legal person who:
(a) bear the costs of securing the premises, the tutor and the interpreter;
(b) provide the courses approved by the Centre; and
(c) identify the foreigners who will participate in the course.
(4) In the case of their inclusion in a specific course not intended for the public, the alien shall address the legal person referred to in paragraph 3.
Course Language
(1) The course is conducted in the Czech language by a lecturer with competence under § 16 and its content is interpreted by an interpreter with competence under § 18 into one of the languages referred to in paragraph 2.
(2) The course content is translated into language
(a) English,
(b) Arabic,
(c) French;
(d) Mongolian,
(e) Russian,
(f) Serbian,
(g) Spanish;
(h) Ukrainian; or
(i) Vietnamese.
(3) On the basis of the agreement of the Ministry, the Centre may provide a course the content of which shall be interpreted in a language other than that referred to in paragraph 2 by a court interpreter for a given language or person meeting the requirements set out in Section 26 of the Law on Judicial Interpreters and Judicial Translators in relation to that language.
Course venue
(1) The Centre provides a course in premises which, with their dimensions and their equipment, enable the course to run properly for the number of participants for which the course is intended.
(2) The course is private.
Number of participants in the course
(1) The number of participants in the course for the public shall be at least 10 and not more than 30.
(2) The number of participants in a course not intended for the public shall not exceed 30.
(3) The Centre may, with the agreement of the Ministry, provide a course for a number of participants less than or equal to the number of participants referred to in paragraph 1 or 2.
Notification of course information
(1) The Centre shall notify the Ministry no later than 5 calendar days before the date of the relevant course:
(a) the type of course referred to in Article 2;
(b) date and time of course;
(c) the place of the course;
(d) the language to which the course content will be interpreted;
(e) the maximum number of participants in the course, if they are intended for the public; and
(f) the number of participants in the course and the name, address and identification number of the legal person on whose request the course is provided by the Centre if it is a non-public course.
(2) The Centre shall notify the Ministry without undue delay:
(a) an amendment to the data notified pursuant to paragraph 1; and
(b) the fact that the number of registered aliens is less than 10 two working days before the day of the course.
Data published by the Ministry
(1) The Ministry shall ensure the publication, without undue delay, of information on courses intended for the public, through its website, to the extent specified in § 6 (1) (b) to (d).
(2) The Ministry shall keep a list of instructors who have met the competence requirements of Section 16 and shall provide the Centre with the data from that list.
(3) The Ministry shall keep lists of interpreters who have met the requirements for professional competence in accordance with Article 18 for each language in accordance with Section 3 (2) and provide the data from these lists to the centres.
Amount of remuneration for participation of a stranger in the course
Amount of remuneration for participation of a stranger in the course
(a) intended for the public is CZK 1,500,
b) not intended for the public is CZK 800.
Payment of payment and payment confirmation
(1) Payment of remuneration for his participation in a public course is made by an alien in favour of an account determined by the Ministry before entering the course; upon making the payment, the alien receives confirmation of payment.
(2) Payment of remuneration for participation of foreigners in a non-public course is made by a public legal person in favour of an account designated by the Ministry for all foreigners for whom a specific course is intended; upon payment, the legal person shall receive a payment confirmation.
Subscription to a specific course for the public
After paying the fee for his participation in the course, the stranger has the opportunity to apply for a specific course intended for the public in the application accessible via the Ministry's website.
Registration of participants
Course participant before the course starts on the day of the course
(a) provide the Centre's representatives with a residence permit issued under the law; If the alien does not have a residence permit, he shall provide a travel document,
(b) he shall confirm his participation in the course by signature in the presentation form indicating his name, surname, date of birth and the number of the document referred to in (a).
Course content
(1) Within the course part of the course devoted to the rights and obligations of foreigners related to their stay in the territory, participants will be informed of the basic information on:
(a) conditions of residence of aliens in the territory;
(b) conditions governing the employment of foreigners in the territory;
(c) conditions for the business of foreigners in the territory;
(d) the system of providing health services to foreigners in the territory, including the issue of foreign health insurance; and
(e) housing in the territory.
(2) Within the course of the course devoted to the fundamental values of the Czech Republic, participants will be familiar with the concept of the Czech Republic as a sovereign, uniform and democratic rule of law based on respect for the rights and freedoms of man and citizen and as a state respecting the obligations arising from international law and membership of the European Union. The course will highlight respect for human rights, freedom of religion, prevention of trafficking in human beings, prevention of domestic and gender-based violence and equality between men and women.
(3) As part of the course dedicated to local conditions and cultural practices prevailing in the Czech Republic, participants will be familiar with the basic information about
(a) compulsory pre-school and school attendance;
(b) significant social, cultural and religious events; and
(c) the Czech Republic in general.
(4) Within the course, the participant will receive a link to information on organisations and institutions providing free advice to foreigners and other up-to-date information.
Time range and course layout
(1) The course lasts 4 hours within one day.
(2) The course consists of a lecture by the instructor and a view of the video approved by the Ministry.
Conditions for completion of the course
(1) The course is attended by a stranger who
(a) meet the requirements set out in Section 11; and
(b) was present at the course for the duration of the course.
(2) A stranger who has fulfilled the condition referred to in paragraph 1 (b) shall also be considered not to have been present at the course for the entire duration of the course, unless his absence has exceeded 30 minutes and his absence has been due to deterioration in his health or force majeure.
Compulsory elements of the course completion document
The compulsory formalities for the completion of the course are:
(a) the date of issue and the number of the document;
(b) the date, time and place of the course;
(c) details of the participant to the extent specified in Section 11 (b); and
(d) the name and signature of the representative of the Centre.
TRAINING ELIGIBILITY OF THE LECTOR AND THE TLUMINARY
Professional competence of the instructor
The lecturer may only be the person who passed the examination referred to in Paragraph 17.
Teacher test
(1) The Ministry is responsible for carrying out the instructor's examination through a commission appointed by the Ministry.
(2) The theoretical part of the instructor's examination is carried out by a written test lasting 120 minutes, composed of 50 questions from the areas referred to in § 12. The test participant shall draw up the test separately and without aid, if not compensatory aid. A participant to the test shall complete the theoretical part of the test if it correctly answers 40 questions in the written test.
(3) Within the practical part of the test participant
(a) after preparation of a period of 5 minutes, it shall present to the Commission an interpretation of at least 15 minutes on one of the subjects referred to in Section 12, to be determined by the Commission;
(b) in an interview with members of a commission of at least 15 minutes, it will respond to questions concerning basic information from the areas referred to in Section 12 which could be placed on the course by a participant.
(4) Within the practical part of the examination, the panel assesses the candidate's didactic and presentation skills and his ability to respond to questions asked. A participant shall pass a practical part of the test if, according to the majority of the members of the panel participating in the examination of his skill and competence are sufficient to provide the correct, clear and understandable transmission of information within the course.
(5) If a participant in the test has not submitted one of its parts, it shall repeat both parts.
Professional competence of the interpreter
The interpreter for the relevant foreign language referred to in § 3 (2) may be the person who passed the examination referred to in § 19.
Interpreter's test
(1) The Ministry is responsible for carrying out the interpreter's examination through commissions appointed by the Ministry for the Foreign Language.
(2) The participant of the test without preparation before the panel continuously interprets the interpretation of the instructor from the Czech language to a foreign language for at least 15 minutes focused on one of the topics listed in Section 12, which will be addressed by the commission. The exam also includes interpretation of 3 questions addressed to the instructor, from a foreign language to the Czech language.
(3) The panel examines the knowledge of a foreign language, especially professional terminology, and the quality of interpretation. A participant shall pass the test if the level of its interpretation performance demonstrated by the majority of the members of the panel present at the test allows for correct and understandable interpretation of the course content.
Test Panel
(1) The Ministry shall appoint members of the examination committees for:
(a) the instructor's test; and
(b) each of the languages referred to in Paragraph 3 (2) for the interpreter's examination.
(2) The examination committee shall have at least five members; at least three members are required to perform the test. The Chairman of the Commission shall be an employee of the Ministry.
Transitional provisions
(1) The instructor's examination shall be viewed as if he had passed both the theoretical and practical part of the examination if:
(a) have applied for this test before 31 December 2021;
(b) submit to the Examination Committee a document of secondary education with a graduate examination, higher vocational education or higher education obtained by study in the territory; and
(c) the examination committee shall provide evidence that, between 1 January 2017 and the date of entry into force of this Decree, it has lectured at least twice an educational event with a content similar to the content of the course referred to in § 12 and a similar or higher time range than that referred to in § 13.
(2) The interpreter's test participant shall be regarded as having passed the test if:
(a) have applied for this test before 31 December 2021;
(b) the Examination Board shall provide evidence of compliance with one of the conditions laid down in Article 8 (1) of the Law on Judicial Interpreters and Judicial Translators, not applicable to the judicial interpreter for the language in question; and
(c) the examination committee shall demonstrate that it has interpreted at least twice the educational action with a content similar to the content of the course referred to in Article 12 and a similar or higher time range than that referred to in Article 13 between 1 January 2015 and the date of entry into force of this decree.
EFFECTIVE
This Decision shall enter into force on 1 January 2021.
