amending and supplementing Decree of the Ministry of Culture of the Czech Republic No. 115 / 1991 Coll., on the modification of remuneration and compensation to authorised entities for the use of subject-matter under copyright law by the acquisition of sound or sound image copies and public lending of images for personal use
The Ministry of Culture of the Czech Republic provides pursuant to § 13 (3), § 39 (1), § 45 (3) and (4) and § 46 (2) and (3) of Act No. 35 / 1965 Coll., on works of literary, scientific and artistic (copyright), as amended by Act No. 89 / 1990 Coll. and Act No. 468 / 1991 Coll.:
Decree of the Ministry of Culture of the Czech Republic No. 115 / 1991 Coll., on the modification of remuneration and compensation to authorised entities for the use of subject-matter under copyright law by the acquisition of sound or audio image copies and public lending of images for personal use, is amended as follows:
1. In the first sentence of Paragraph 1, the words "who operate on the territory of the Czech Republic 'are replaced by the words" who have their registered office, place of permanent residence or stay for at least 183 days in the relevant calendar year, in a continuous manner or in several periods in the territory of the Czech Republic'.
Article 2 (2) reads as follows:
"(2) The amount of the remuneration referred to in paragraph 1 shall not apply to borrowers who have concluded valid collective or individual contracts with eligible entities whose rights are protected by copyright. ';
3. Paragraph 2 is added to paragraph 3:
"(3) The obligation referred to in paragraph 1 shall not apply to a lender who, by submitting the relevant contracts to the organisations referred to in paragraph 4 below, proves that, in the case of the image and audio images of the author's or performer's right to use the work in return for payment, the author's or performer's contract with the author and performer's producer of the image or audio image. ';
4. In Article 5 (d), at the end of the last sentence, the words "from the Czech Republic 'shall be added after the words" or broadcast by radio or television'.
This Decree shall take effect on 1 January 1993.
