on the remuneration of members of councils in municipalities
The Government of the Czech Republic orders the implementation of the Act of the Czech National Council No. 367 / 1990 Coll., on municipalities (municipal establishment):
(1) The members of the municipal council who are long-term dismissed from their duties shall be paid by the municipality instead of the remuneration or other remuneration for the work determined within the limits set out in column 1 or 2 of Annex 1 or column 1, 2 or 3 of Annex 2 to this Regulation.
(2) In determining the level of remuneration, account shall be taken of the complexity and responsibility of the office, the personal assumptions and results of the work of a member of the municipal council and of the fact that the municipal office in the municipality fulfils the function of the entrusted municipal office. 1)
(3) The remuneration shall be assessed as remuneration and paid by the municipality from its budget.
The members of the municipal council who are not long-term vacancies in the performance of their duties may be remunerated by the municipality from their budget resources for the duties of mayor and deputy mayor within the limits set out in columns 3 and 4 of Annex 1 to this Regulation and for the duties of member of the municipal council, the chairman of the commission and the chairman of the special authority of the municipality up to the amount set out in column 5 of Annex 1 or column 4 or 5 of Annex 2 to this Regulation.
The remuneration provided for in Paragraph 1 or 2 shall also be payable to members of the municipal council who are not in a working or other similar proportion.
The compensation paid to a member of the municipal council who is not relieved of his duties shall be paid by the municipality to its employer, if the employer so requests, on a monthly or quarterly basis, in accordance with mutual agreement.
The members of the municipal council may receive one-off remuneration according to the results of their work; remuneration may also be granted to other citizens for their work as members of the Commission and the special authorities of the municipality.
The members of the municipal council who are long-term dismissed from their duties shall be assessed as workers of the municipal office as regards their labour rights. Likewise, members of the municipal council who perform the function of long-term vacant member of the council and who are not in an employment or other similar relationship, or who do not pursue a gainful activity in which they are considered to be self-employed for the purposes of sickness and pension insurance.
The provisions of this Regulation shall also apply to members of the councils in the municipalities active in the service, members of the National Security Corps and the Czech Correctional Education Corps.
This Regulation shall enter into force on the day of the elections to the municipalities in 1990.

Note: If only one member of the municipal council as deputy mayor is long-term unemployed in the municipalities of up to 3000 inhabitants for the performance of his duties, he shall be remunerated according to column 1.
