DECLARATION
of 4 December 2020
on fuel requirements and the implementation of certain other provisions of the Fuel Act
The Ministry of Industry and Trade sets out, pursuant to Section 11 (1) of Act No. 311 / 2006 Coll., on Fuel and Fuel Petrol Stations and on the amendment of certain related laws (Fuel Act), as amended by Act No. 91 / 2011 Coll., Act No. 234 / 2013 Coll., Act No. 152 / 2017 Coll. and Act No. 48 / 2020 Coll., to implement § 3 (4), § 4 (1), § 5 (4), § 6q (7) and § 7 (5):
Subject matter
(1) This decree implements the relevant provisions of the European Union1) and provides for
(a) the composition and quality requirements for fuel and the method of monitoring and monitoring the composition and quality of fuel;
(b) the determination of the data contained in the summary report on the quantities and composition of each type of fuel sold by the service station operator;
(c) the determination of additives and their dosage,
(d) the way in which the data on the quantity of electricity consumed for the charging of vehicles at charging stations are transmitted;
(e) the determination of the content of the reports and summary reports on the results of monitoring the composition and quality of fuel.
Definition of terms
For the purposes of this decree:
(a) by the code of the combined nomenclature, the code number of the selected products referred to in the Council Regulation on the tariff and statistical nomenclature and on the Common Customs Tariff (2), as applicable on 1 January 2020;
(b) mineral diesel oil for the propulsion of combustion positive ignition engines falling within CN codes 2710 12 41, 2710 12 45 and 2710 12 49
1. without addition of biofuels;
2. containing added bioethanol and added bioethers containing 5 or more carbon atoms in the molecule, with an ethanol, ether and other oxygen content not exceeding those specified in the relevant Czech technical standard,
3. referred to in points 1 and 2 with a content of other oxygen substances in such a way that the total oxygen content does not exceed the oxygen content of the relevant Czech technical standard;
(c) diesel fuel
1. gas oils intended for the propulsion of compression-ignition internal combustion engines falling within CN code 2710 19 43;
2. gas oils with a maximum volume of 7 per cent by volume of fatty acid methyl esters intended for the propulsion of combustion compression-ignition engines listed under CN code 2710 20 11,
(d) biofuel liquid or gaseous fuel used for transport and produced from biomass;
(e) biomass-degradable fraction of products, waste and residues of biological origin from agriculture (including plant and animal substances), forestry and related industries including fisheries and aquaculture, as well as biodegradable fraction of industrial and municipal waste;
(f) a biogas mixture of gas produced from biomass referred to in the Combined Nomenclature code 2711 29 00, which is a raw material for the production of biomethane;
(g) bioethanol ethanol in general or specially denatured, produced from biomass and declared under Combined Nomenclature code 2207 20 00,
(h) bioether of ethyl tercbutyl ether produced from bioethanol, used as an addition to motor gasoline and covered by CN code 2909 19 10, or methyl tercbutyl ether produced from biomethanol, used as an addition to motor gasoline and covered by CN code 2909 19 90; the proportion of ethyl tercbutyl ether, which is considered to be biofuel, is 47 percent of the total volume of ethyl tercbutyl ether and the proportion of methyl tercbutyl ether, which is considered to be biofuel, is 36 percent of the total volume of methyl tercbutyl ether,
(i) biodiesel of fatty acid methyl esters ("FAME") or other fatty acid mono-alkyl esters, produced from vegetable oil, animal fat or other biomass with the characteristics of diesel, intended for the propulsion of combustion compression ignition engines, falling within CN codes 3826 00 10 and 3826 00 90;
(j) synthetic fuel hydrocarbon fuel used in transport produced by chemical and technological processes from biomass or from other raw materials for the production of alternative fuels such as paraffinic diesel produced by synthesis or hydrogenation for the propulsion of combustion compression ignition engines including paraffinic diesel produced from hydrocarbons based on hydrogenated vegetable oils or other oils and biomass fats falling within CN code 2710 19 43;
(k) mixed diesel fuel containing at least 30 per cent by volume FAME ("composite diesel") listed under the Combined Nomenclature codes 3826 00 90 or 2710 20 11 intended for the propulsion of combustion diesel engines, diesel fuel containing at least 30 per cent by volume of hydrogenated vegetable oils listed under the Combined Nomenclature codes 2710 19 43, 2710 20 11 and 3826 00 90 intended for the propulsion of combustion diesel engines, a mixture of at least 70 per cent by volume bioethanol with motor petrol ("ethanol E85") intended for the propulsion of combustion diesel engines listed under the Combined Nomenclature codes 3824 99 92 or 2207 20 00 and bioethanol containing not more than 5 per cent by weight of the complex enrichment additives intended for the propulsion diesel engines ("ethanol E95") indicated under the Combined Nomenclature code 3824 99 92 or 2207 20 00,
(l) diesel fuel B10 diesel with a FAME content of more than 7 per cent by volume but not more than 10 per cent by volume, for the propulsion of compression ignition engines and listed under the Combined Nomenclature code 2710 20 11,
(m) diesel fuel with a high FAME content of diesel fuel with a FAME content of between 14 and 20 per cent by volume (hereinafter referred to as "B20") or diesel fuel with a FAME content of between 24 and 30 per cent by volume (hereinafter referred to as "B30"), intended for the propulsion of combustion diesel engines and listed under the Combined Nomenclature code 2710 20 11,
(n) liquefied petroleum gases (LPG) gases, including biomass gases, intended for the propulsion of combustion positive ignition engines listed under the Combined Nomenclature codes 2711 12 19, 2711 12 94, 2711 12 97, 2711 13 91, 2711 13 97 and 2711 19 00,
(o) compressed natural gas (CNG) gas intended for the propulsion of spark-ignition internal combustion engines referred to in CN code 2711 21 00,
(p) liquefied natural gas (LNG) gas intended for the propulsion of combustion positive ignition engines referred to under CN code 2711 11 11 00,
(q) biomethane modified biogas intended for the propulsion of combustion engines, as specified under Combined Nomenclature code 2711 29 00, the quality and purity of which meets the qualitative parameters of natural gas as specified under Combined Nomenclature code 2711 21 00,
(r) compressed biomethane (hereinafter referred to as "bio-CNG") compressed modified biogas intended for the propulsion of combustion engines referred to under Combined Nomenclature code 2711 29 00, the quality and purity of which satisfies the qualitative parameters of compressed natural gas referred to under Combined Nomenclature code 2711 21 00,
(s) liquefied biomethane (hereinafter referred to as "bioLNG") liquefied modified biogas intended for the propulsion of internal combustion engines covered by CN code 2711 19 00, the quality and purity of which satisfies the qualitative parameters of liquefied natural gas covered by CN code 2711 11 11 00,
(t) hydrogen gas intended for the propulsion of combustion positive ignition engines or for fuel cells with a proton-exchange membrane referred to under CN code 2804 10 00,
(u) gas oils for the propulsion of non-road mobile machinery, in particular in the fields of agriculture and construction, gas oils listed under the Combined Nomenclature codes 2710 19 43, 2710 20 11, 2710 19 46, 2710 20 16 and 2710 19 47 including gas oils with added FAME up to a maximum of 7 per cent volume.
Composition and quality of fuel
(1) The composition and quality required are satisfied if they correspond to:
(a) the engine gasoline ČSN EN 228 and meets the quality indicators set out in Annex 1 to this Decree;
(b) diesel fuel ČSN EN 590 and meets the quality indicators set out in Annex 2 to this Decree;
(c) FAME EN 14214,
(d) mixed diesel fuel CSN 65 6508,
(e) diesel fuel B10 ČSN EN 16734,
(f) diesel with a high content of FAME ČSN EN 16709,
g) ethanol E85 ČSN EN 15293,
h) ethanol E95 ČSN 65 6513,
i) LPG ČSN EN 589,
j) CNG and Bio-CNG ČSN 65 6517 and ČSN EN 16723-2 and meet the quality characteristics set out in Annex 3 to this Decree,
(k) LNG and bio-LNG ČSN EN 16723-2 and meet the quality indicators set out in Annex 3 to this Decree;
(l) biomethane CSN 65 6514 and CSN EN 16723-2,
m) paraffinic diesel CSN EN 15940,
n) Hydrogen for direct use CSN ISO 14687 or hydrogen for fuel cells with proton exchange membrane CSN EN 17124,
(2) The required quality of bioethanol for the addition to motor petrol is satisfied if it corresponds to EN 15376.
Method of monitoring and monitoring fuel composition and quality
(1) Monitoring of fuel composition and quality shall be carried out by analysis of samples taken. Sampling shall be carried out at and between production, supply, storage or sales points.
(2) The sampling and assessment of the test results for individual fuels must comply with the relevant Czech technical standard).
(3) In each sampling, the staff member of the Czech Trade Inspection Service (hereinafter referred to as "inspection ') responsible for carrying out the inspection tasks (hereinafter referred to as" inspector') shall draw up a certificate which shall contain:
(a) the registration number of the certificate of registered inspection;
(b) the designation of the person checked, namely:
1. if the natural person, name or surname, surname or business name, date of birth, identification number, if assigned, address of the place of permanent residence and, where applicable, place of business, address of the place of residence in the Czech Republic with a foreign person, if permitted, address of the place of registered residence in the Czech Republic or location of the organizational component of the enterprise in the Czech Republic, if established;
2. if a legal person, a business firm or a name, registered office and identification number has been assigned to a foreign person, the location of the organisational component of an enterprise in the Czech Republic, if it establishes it,
(c) the date, time and place of actual sampling;
(d) the identification of the dispenser or storage tank from which the sample was taken;
(e) the type of fuel designated according to the relevant Czech technical norem4),
(f) the seal number, the identification of the sample and its quantity and the total quantity of fuel sampled;
(g) the name and, where applicable, the name, surname, service card number and signature of the inspector and, where the sampling is carried out by the competent person invited, his name and, where appropriate, his or her name, surname and signature;
(h) the names, surnames and signatures of the other persons admitted to the sample.
(4) The certificate shall be made out in duplicate, which shall be signed by the inspector, by a controlled or compulsory person, invited by the competent sampling officer and other persons admitted. A copy of the certificate shall be kept by inspection. The second copy of the certificate shall be received by the person checked.
(5) The minimum number of fuel samples taken per year to assess their quality is set out in Annex 4 to this Decree. In the event that the number of non-compliant samples in the relevant fuel group is increased from 1 November to 31 October of the following calendar year to a proportion of more than 1,5% of the total number of samples taken in that fuel group, the minimum number of samples taken in that fuel group shall be increased by 50% for the following annual period from 1 November to 31 October against the values of the relevant fuel group set out in Annex 4 to this Regulation. In the event that the number of non-compliant samples in the relevant fuel group is increased from 1 November to 31 October of the following calendar year to a proportion of more than 2,0% of the total number of samples taken in that fuel group, the minimum number of samples taken in that fuel group shall be increased by 100% for the following annual period from 1 November to 31 October against the values of the relevant fuel group set out in Annex 4 to this Regulation.
(6) Fuel quality monitoring shall be carried out only by test methods of analysis established by the relevant Czech technical standards.
(7) Test analyses of fuel samples taken and their evaluation are carried out by an accredited person (5). The assessment of the analyses may be supplemented, at the request of the inspection, by an accredited person to assess the severity of the deficiencies identified for each quality indicator of the fuel samples taken in view of their negative impact on engine operation, safety or the environment.
Fuel quality indicators
When monitoring the composition and quality of fuel:
(a) in the case of motor gasoline, the characteristics listed in Annex 1 to this Regulation;
(b) for diesel fuel, the characteristics listed in Annex 2 to this Decree;
(c) for CNG, Bio-CNG, LNG and Bio-LNG, the indicators listed in Annex 3 to this Regulation;
(d) for other fuels, the indicators listed in Annex 5 to this Decree.
Summary report on the quantity and composition of each type of fuel sold by the service station operator
The summary report on the quantities and composition of each type of fuel sold by the service station operator in the previous calendar year or for the period of that year during which the activity was carried out shall contain:
(a) details of the service station operator transmitting the report, namely:
1. if the natural person, name or surname, surname or business name, date of birth, identification number, if assigned, address of the place of permanent residence and, where applicable, place of business, address of the place of residence in the Czech Republic with a foreign person, if permitted, address of the place of registered residence in the Czech Republic or location of the organizational component of the enterprise in the Czech Republic, if established;
2. if a legal person, a business firm or a name, registered office and identification number has been assigned to a foreign person, the location of the organisational component of an enterprise in the Czech Republic, if it establishes it,
(b) a clear identification of the individual service stations;
(c) information on the quantities of fuel sold at individual service stations listed in Annex 6 to this Decree;
(d) the name and, where appropriate, the name, surname and signature of the person responsible for processing the summary report.
Additives and their dosage
(1) For vehicles with engines designed for the use of leaded motor gasoline, an additive based on potassium salt, in particular alkylated sulfoamber acid, is used. The additive is dosed in such a way that the potassium concentration in one litre of gasoline is between 5 mg and 10 mg of potassium.
(2) Only fatty acid methyl esters to which additives have been added in advance, ensuring their oxidation stability, may be used to ensure the stability of the quality of diesel fuel with the addition of biofuel for diesel engines.
Method of transmission of data on the quantity of electricity consumed for charging vehicles at charging stations
The information on the quantity of electricity consumed for charging vehicles in charging stations in the previous calendar year shall be transmitted by the operator of the charging station using the form set out in Annex 7 to this Regulation.
Reports and summary reports on the results of the monitoring of fuel composition and quality
(1) The content of the report on the results of the monitoring of the composition and quality of fuel for the previous calendar month of the inspection is set out in Annex 8 to this Decree.
(2) The summary report on the results of the monitoring of the composition and quality of fuel for the previous calendar year by which the inspection is carried out contains the supporting documents set out in Annexes 9 to 15 to this Regulation. These materials shall be processed separately for each type of fuel on the basis of its specification. For motor gasoline, the specification is determined by the octane number using the research method and the maximum permissible sulphur content. For diesel, FAME, mixed diesel, high FAME, paraffinic diesel, LPG, CNG, bio-CNG, LNG and bioLNG, the specification is determined by the maximum permissible sulphur content.
Mutual recognition clause
Where that Decree lays down requirements which do not take into account the requirements laid down in the relevant provisions of European Union law, those requirements shall not apply to fuels which have been produced or placed on the market in a Member State of the European Union or Turkey or which have been produced in one of the States of the European Free Trade Association which is at the same time a Contracting Party to the Agreement on the European Economic Area, in accordance with their legislation, provided that the level of protection of legitimate interest corresponding to the achievement of that decree is guaranteed.
Technical Regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Repeal
They shall be deleted:
1. Decree No. 133 / 2010 Coll., on the requirements for fuel, on the method of monitoring and monitoring the composition and quality of fuel and on their registration (Decree on quality and registration of fuel).
2. Decree No. 278 / 2011 Coll., amending Decree No. 133 / 2010 Coll., on fuel requirements, on the method of monitoring and monitoring the composition and quality of fuel and on their registration (Decree on the quality and registration of fuel).
3. Decree No. 153 / 2017 Coll., amending Decree No. 133 / 2010 Coll., on fuel requirements, on the method of monitoring and monitoring the composition and quality of fuel and on their registration (Decree on quality and registration of fuel), as amended by Decree No. 278 / 2011 Coll.
Efficacy
(1) This Decree shall take effect on 1 January 2021, with the exception of Article 3 (1) (n), which shall take effect on 12 November 2021.
(2) Paragraph 3 (1) (o) expires on 12 November 2021.

Explanatory notes:
1) In the case of motor gasoline, the recommended shelf life is three months from the date of its sale.
2) The test methods shall be those specified in EN 228. The analytical methods specified in the standard replacing EN 228 may be taken over if it can be shown that the accuracy and accuracy of this method are at least the same as the accuracy of the superseded analytical method.
3) The values given in the specification are "true values." When setting their limit values, the terms CSN EN ISO 4259-1 and CSN EN ISO 4259-2 were applied, the minimum values were set, the minimum difference 2R above zero was taken into account. (R = reproducibility). The results of each measurement shall be interpreted on the basis of the criteria described in ČSN EN ISO 4259-1 and ČSN EN ISO 4259-2.
4) Unleaded petrol 98 is placed on the market with a minimum octane number of 88 determined by the engine method and a minimum octane number of 98 determined by the research method.
5) DVPE means dry vapour pressure equivalent (Dry Vapour Pressure Equivalent). The value of this variable may be affected by the mixing effect specified in the CSN EN 228, but the resulting value shall not exceed the maximum value of the vapour pressure for the specified period with the netting of the mixing effect specified in Table A.1 of the CSN EN 228.
6) The summer period starts on 22 April and ends on 30 September, the winter period starts on 16 November and ends on 21 March. The period from 22 March to 21 April and the period from 1 October to 15 November shall be transitional periods. The details of the procedure for the replacement of motor petrol at service stations between 22 April and 21 May are set out in ČSN EN 228.
7) Unleaded petrol with an ethanol content of up to 5 per cent by volume is placed on the market with a maximum oxygen content of up to 2,7 per cent by weight.
8) Other oxygen compounds means other monoalcohols and ethers with an end of distillation not higher than that specified in EN 228.

Explanatory notes:
1) For diesel fuel, the recommended shelf life is three months from the date of its sale.
(2) For the propulsion of diesel aggregates such as emergency sources of hospitals, rescue and fire brigades, only fossil diesel (diesel fuel-free diesel), preferably Arctic diesel, is recommended.
3) The test methods shall be those specified in EN 590. The analytical methods specified in the standard replacing EN 590 may be taken over if it can be demonstrated that the accuracy and accuracy of this method are at least the same as the accuracy of the superseded analytical method.
4) The values given in the specification are "true values." When setting their limit values, the terms CSN EN ISO 4259-1 and CSN EN ISO 4259-2 were applied, the minimum values were set, the minimum difference 2R above zero was taken into account. 5) For diesel for the Arctic climate on the market, the cetane number must correspond to ČSN EN 590. In Member States with severe winter conditions, a maximum distillation point of 65 per cent vol. at 250 ° C for diesel and gas oils may be replaced by a maximum distillation point of 10 per cent vol. at 180 ° C.
(6) It is appropriate to add appropriate additives to diesel fuels with a biofuel content of between 5 and 7 per cent vol. to ensure its stability.
7) The summer period starts on 15 April and ends on 30 September, the winter period starts on 16 November and ends on 28 (29) February. The period from 1 March to 14 April and the period from 1 October to 15 November shall be transitional periods. The details of the engine naft rotation process at service stations during the periods 1 October to 15 October and from 16 November to 30 November are set by ČSN EN 590.

Explanatory notes:
1) The total sulphur content after deorisation may not exceed 15 mg / m3. For CNG, bio-CNG, LNG and bio-LNG shock deorisation, it is recommended not to carry out a control sample due to a possible short-term purposeful increase in sulphur content above the specified maximum value.
2) The volume of gaseous fuel is expressed under standard reference conditions - pressure 101,325 kPa, temperature 288,15 K, and it is a real dry gas.
