DECLARATION
of 9 November 2006
amending Decree of the Ministry of Agriculture No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on Water and Sewerage for Public Use and amending certain laws (Law on Water and Sewerage), as amended by Decree No. 146 / 2004 Coll.
The Ministry of Agriculture provides pursuant to § 40 of Act No. 274 / 2001 Coll., on water and sewage for public use and on the amendment of certain laws (Act on water and sewage), as amended by Act No. 76 / 2006 Coll., for the implementation of § 5 (6), § 6 (11), § 8 (11), § 11 (2), § 12 (1), § 13 (5), § 17 (9), § 19 (10), § 20 (3) and § 36 (7):
Čl. I
Decree No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on Water and Sewerage for Public Use and amending certain laws (Water and Sewerage Act), as amended by Decree No. 146 / 2004 Coll., is hereby amended as follows:
1. in Paragraph 1 (e), the words "withholding waters" shall be replaced by the words "surface waters resulting from the effluent of precipitation waters (hereinafter referred to as" withholding water ")."
2. In Article 3 (f), the words "and the effect on the cost price of the supply of drinking water or waste water 'are deleted.
3. In Article 6 (2), at the end of the text in point (a), the words "and not more than the whole municipality or, where appropriate, several neighbouring municipalities, shall be added if the distance between the built-up territory or the built-up area of these municipalities is not more than 200 m '.
4. In Article 6 (5), "June 'is replaced by" July'.
5. In Article 7 (2), the words "and not more than a few municipalities in which the quality of the water supplied by the network can be considered to be approximately the same" shall be added at the end of the text in point (a).
6. Paragraph 7 (5), including footnote 2, reads as follows:
"(5) The records of surface and groundwater resources used for the treatment of drinking water supply ducts shall be kept according to their name, name and code number of the cadastral territory and the sampling number2) if allocated.
2) Paragraph 11 (2) of Decree No. 431 / 2001 Coll., on the content of the water balance, the method of its compilation and on the data for the water balance, as amended. "
7. footnote 4:
"4) § 8 (1) (a) (1) and § 8 (1) (b) (1) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll. '.
8. In Article 8 (5), the words "under the provisions of Section 5 of Decree No. 376 / 2000 Coll., laying down requirements for drinking water and the extent and frequency of its control 'are replaced by the words" under the special legislation (5a)'.
Footnote 5a:
"(5a) Paragraph 7 (2) of Decree No. 252 / 2004 Coll., laying down the hygiene requirements for drinking and hot water and the frequency and scope of control of drinking water, as amended by Decree No. 187 / 2005 Coll. ';
9. Paragraph 8 (6) is deleted.

11. in Article 10 (2) (c), the words "describing the use of all premises and rooms" shall be deleted;

„§ 11
Operating log
(1) The operational log shall record the daily operational records of, or parts of, the water duct, the operator's activity data, including events that may affect the operation of the water duct or sewerage. Records of persons carrying out traffic checks and sampling of water and waste shall also be recorded in the operating log. In operations where daily service is not required, records shall be made at each inspection or operational intervention.
(2) If appropriate, the operating log may be broken down into the sub-operating logs.
(3) The operational records referred to in paragraph 1 may be replaced by continuous computer outputs of an automated management system. ';
13. The heading of Part Four reads:
"OBLIGATIONS OF THE APPLICATION FOR AUTHORIZATION FOR THE CONDUCTING OF WATER OR CANALIZATION AND THE RELEVANT OBSERVATION FOR WATER AND CANALIZATION
(Paragraph 6 (11) of the Law) '.
14. in Article 12 (2), the following points (d) and (e) are inserted after point (c):
"(d) an officially certified copy of a person's education document as provided for in Article 6 (2) (c) of the Act and documents enabling the assessment of the affinity of the field under Article 12a;
(e) the written consent of the natural person to be included in the application as the responsible representative of the operator, including the certified signature of the natural person, in the absence of the natural person submitting the application. ";
15. in Article 12, paragraph 3 is deleted;
16. The following Section 12a is inserted after Section 12:
„§ 12a
Relative field of water supply and sewerage
(Paragraph 6 (11) of the Law)
(1) A related field in the field of water and sewage education shall be that of secondary education with a graduate examination, which shall be focused on at least 4 of the following activities:
(a) knowledge of the legislation in the water supply and sewage sector;
(b) knowledge of processes related to water collection, treatment of drinking water, including hygiene and water transport;
(c) knowledge of processes related to waste water treatment, sludge management and waste water collection by sewer systems;
(d) knowledge of legislation related to the formation of the price of water and bulky;
(e) the ability to evaluate water analysis data, to identify possible defects in the adjustment process;
(f) ability to analyse the deficiencies of the distribution system and the water losses in the pipe network;
(g) the ability to evaluate the data of waste water analysis, the definition of the essential deficiencies of the sewer system and of the sewage treatment plant;
(h) the ability to carry out analyses in the area of the economy of operation and the formation of prices of water and water;
(i) the ability to assess economic development projects and the impact on operating costs in the water and sewage sectors.
(2) The provision of secondary education with a graduate examination, supplemented by an education accredited by the Ministry of Education, Youth and Sports, resulting in the composition of professional examinations, shall also be considered to be related to the field of education of water and sewage. ';
17. The heading of Part Five reads:
"IMPLEMENTATION OF THE CONTRACT ON WATER SUPPORT AND THE IMPLEMENTATION OF THE TREATY AND THE CONTENTS OF THE PLAN FOR THE FINANCING OF WATER AND CANALISATION AND RULES FOR ITS PROCESSING
(Paragraph 8 (11) and (15) of the Law) '.
18. After Paragraph 13, the following Section 13a is inserted:
„§ 13a
Content of the financing plan for the recovery of water pipelines or sewerage and the rules for its processing
(1) The plan for the financing of the recovery of water ducts or sewerage is processed to the extent of the data and in accordance with the rules set out in Annex No 18.
(2) The plan for financing the recovery of water ducts or sewerage is updated no later than 5 years after its processing. Each update carried out shall be an integral part of the initial plan for the financing of the renewal of pipelines or sewerage. ';
19. In Article 15, the following paragraph 13 is added:
"(13) The water treatment construction shall be designed according to the technical requirements based on the raw water quality indicators and the compliance of its category with the type of water treatment referred to in Annex 13. The design and construction of the water treatment building shall be carried out according to technical standards governing the water industry. '
20. Paragraph 19 (1) reads:
"(1) Waste water disposal (18) is proposed according to the calculation of the amount of waste water, the calculation of the quantity of treated precipitation water and the system of single or separate sewerage. ';
21. in Paragraph 19, paragraphs 10 and 11 are added:
"(10) In case a new part of the seabed sewerage sewerage sewerage from the new installation on stationary surfaces is connected to a single sewerage or to a separate sewerage sewerage sewerage, a new calculation shall be carried out in the project documentation to verify the capacity of the sewerage to remove an increased quantity of such waters. This calculation shall be the basis for the owner of the sewerage or, where the owner is empowered to do so, the operator to permit or refuse that connection.
(11) The distance of the revision and input shafts on the straight line of non-passable sewers shall be not more than 50 m, for transit sewers not more than 200 m. Revision, entrance and quarry shafts and sediments cannot be placed off the sewers' route. "
22. In Paragraph 22 (2), "surface 'is replaced by" crude'.
23. In Article 22, paragraphs 6 and 7 are added:
"(6) The raw water category is annually specified on the basis of the results of the raw water analyses according to the water quality control plan.
(7) The categorisation of raw water is not carried out for water without water treatment technology and water acceptance structures, with possible water health protection. "
24. In the heading of the 12th section, the words "(K § 17 (8) of the Act) 'are replaced by the words" (K § 17 (9) of the Act'.
25. in Paragraph 28, paragraph 2 is deleted;
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
26. in Paragraph 28 (2), "paragraph 2" is replaced by "paragraph 17 (4) (a) of the Act."
27. in Paragraph 28 (3), "paragraph 2" is replaced by "Paragraph 17 (4) (a) of the Act."
28. In the heading of section thirteenth, "(K § 19 (9) of the Act) 'is replaced by" (K § 19 (10) of the Act'.
29. The heading of Part Fourteenth reads:
"METHOD OF CALCULATION OF THE FIXED WATER AND STOCK COMPONENTS FOR PAYMENT IN THE TWO-SHEET FORM AND PROCEDURE AND THE SCOPE OF THE CALCULATION OF ALL THE PRICE CALCULATION ITEMS IN ACCORDANCE WITH THE PRICE RULES FOR AQUATIC AND STOCKS
(Articles 20 (3) and 36 (7) of the Act) '.
30. The following Section 35a is inserted after Section 35:
„§ 35a
The bill referred to in Paragraph 36 (5) of the Act shall be made in accordance with the procedure and to the extent specified in Annex 19. ';
31. In Paragraph 36 (2), the words "or names," shall be inserted after the word "name," and at the end of the text of point (a), the words "or the place of registered residence in the Czech Republic, or the address of residence abroad," shall be added.
32. in Article 36 (2), point (d) is deleted;
Points (e) and (f) shall be renumbered as points (d) and (e).
33. In Annex 9, Part 1 reads as follows:

„ČÁST 1

WATER WITH ADJUSTMENT TECHNOLOGY (WATER ADJUSTMENT):
(a) the inflow of crude water used for drinking water treatment;
(b) water during treatment with a technological line (operational analyses);

WATER WITHOUT ADJUSTMENT TECHNOLOGY (ONLY DEZINFIED):
(a) inflow of raw water before health protection (i.e. disinfecting in different ways),

In cases of unaltered water quality and a short supply line to the consumer, the water quality may only be monitored in the sampling profile according to points (b) and (c). ';

46, 47Pesticidy a dále součet koncentrací pesticidů, u kterých je pravděpodobné, že se budou vyskytovat v surové vodě, a to podle používaných pesticidů v daném území. Stanoví se pouze v případech odůvodněného podezření kontaminace zdroje surové vody pesticidní látkami.
49Suma specifických sloučenin:
benzo(b)fluoranten, benzo(k)fluoranten,
benzo(ghi)perylen, indeno (1,2,3-cd) pyren.

';
