on a referendum on the accession of the Czech Republic to the European Union and amending Constitutional Act No. 1 / 1993 Coll., the Constitution of the Czech Republic, as amended
Parliament has decided on the following constitutional law of the Czech Republic:

REFERENCE ON THE ACCESSION OF THE CZECH REPUBLIC TO THE EUROPEAN UNION
Čl. 1
General provisions
(1) Only a referendum can be decided on the accession of the Czech Republic to the European Union.
(2) The question for the referendum is: "Do you agree that the Czech Republic should become a Member State of the European Union under the Treaty of Accession of the Czech Republic to the European Union?"
(3) Every citizen of the Czech Republic who has reached the age of 18 has the right to vote in a referendum.
(4) The referendum and the outcome of the referendum are declared by the President of the Republic in a similar manner to that of the law.
(5) Should the referendum be held in the last six months of the parliamentary term of the Chamber of Deputies or the term of office of the representatives of the local authorities, the President of the Republic shall declare them to take place in conjunction with the elections to the Chamber of Deputies or the representatives of the local authorities.
Čl. 2
The President of the Republic shall declare a referendum within 30 days of the signing of the Treaty of Accession of the Czech Republic to the European Union in order to take place within a period beginning on the 30th day and ending on the 60th day following its publication.
Repeated referendum
Čl. 3
(1) If the accession of the Czech Republic to the European Union has not been approved in a referendum held pursuant to Article 2, a proposal for a referendum may be made by the Government or jointly by at least two fifths of Members or jointly by at least two fifths of Senators.
(2) The proposal for a referendum shall be submitted to the President of the Republic.
(3) The referendum may not be published until two years after the previous referendum has not approved the accession of the Czech Republic to the European Union.
Čl. 4
If the conditions for the announcement of a referendum are met, the President of the Republic shall declare a referendum within 30 days of the date of the submission of the application for its publication, in order to take place no later than 90 days from the date of the submission of the proposal; otherwise it shall decide not to issue a referendum within the same time limit.
Čl. 5
Result of the referendum
(1) The accession of the Czech Republic to the European Union is approved in a referendum if an absolute majority of the votes have answered the question for the referendum.
(2) The announced result of the referendum approving the accession of the Czech Republic to the European Union replaces Parliament's consent to ratify the Treaty of Accession of the Czech Republic to the European Union.
Čl. 6
The law shall lay down further conditions for the exercise of the right to vote in a referendum, as well as details of the design, announcement and implementation of the referendum and its outcome. To adopt this law, it needs to be approved by the Chamber of Deputies and the Senate.

Čl. 7
Constitutional Act No. 1 / 1993 Coll., Constitution of the Czech Republic, as amended by Constitutional Act No. 347 / 1997 Coll., Constitutional Act No. 300 / 2000 Coll., Constitutional Act No. 395 / 2001 Coll. and Constitutional Act No. 448 / 2001 Coll., is amended as follows:
1. in Article 62, the dot at the end is replaced by a comma and the following point (l) is added:
"(l) declares a referendum on the accession of the Czech Republic to the European Union and its outcome."
2. In Article 66, in the part of the second sentence in front of the semicolon, the point ", (l) 'shall be added after the letter" k)'.
3. In Article 87, at the end of paragraph 1, the dot is replaced by a comma and the following points (l) and (m) are added:
"(l) an appeal against the President's decision not to declare a referendum on the accession of the Czech Republic to the European Union,
m) whether the procedure for implementing the referendum on the accession of the Czech Republic to the European Union is in accordance with the Constitutional Law on the referendum on the accession of the Czech Republic to the European Union and with the law issued for its implementation. "
