GOVERNMENT REGULATION
of 30 November 2020
amending Government Regulation No 221 / 2019 Coll., on the implementation of certain provisions of the Investment Incentives Act
The Government orders pursuant to § 2 (4), § 3 (1) and § 6a (7) (a) of Act No. 72 / 2000 Coll., on investment incentives and on the amendment of certain laws (Act on Investment Incentives), as amended by Act No. 192 / 2012 Coll. and Act No. 210 / 2019 Coll.:
Government Decree No. 221 / 2019 Coll., on the implementation of certain provisions of the Investment Incentives Act, is amended as follows:
1. In Paragraph 3 (1) (a), the amount "100 000 000 CZK" is replaced by "80 000 000 CZK" and the amount "50 000 000 CZK" is replaced by "40 000 000 CZK."
2. In Article 3, at the end of paragraph 4, the words "or, in the case of a strategic investment action, where a product of strategic importance for the protection of the life and health of persons listed in Annex 2 to this Regulation is to be the subject of the production of an investment in production 'shall be added.
3. Paragraph 3 (7) reads as follows:
"(7) The value of the fixed tangible and intangible assets referred to in paragraphs 1, 2 and 5 shall be reduced by half if the beneficiary of the investment incentive is a medium-sized entrepreneur (9) or a quarter if the beneficiary is a small entrepreneur (9). The number of new jobs referred to in paragraphs 5 and 6 shall be halved if the beneficiary of the investment incentive is small or medium-sized enterprises (9). ';
4. In Section 4, the text "No 1 'is inserted after the word" Annex'.
5. In Article 5 (1), the words "except for an investment in production where a product of strategic importance for the protection of life and health of persons listed in Annex 2 to this Regulation is to be produced shall be inserted after the word" production, "'.
6. In the first sentence of the Annex to the form, the words "the Investment Incentives Act 'are replaced by the words" Act No 72 / 2000 Coll., on Investment Incentives, as amended', the words "the Government Regulation 'are inserted after the words" No 221 / 2019 Coll.' and the words "the Investment Incentives Act 'are inserted.
7. In the Annex to the form in the section marked "II. INVESTMENT ACTION DATA ', point 14 reads as follows:

8. The Annex is renumbered Annex 1 and Annex 2 is added, including the title and footnote 10:

21. Digital neonatal incubators with intelligent diagnostic functions, the possibility of an autonomous function and connection to information networks.
22. Sterilisers.
23. Incubators, especially for cell therapy.
24. Medical laboratory technique.
25. Means for prosthetics and orthotics.
26. Resources for rehabilitation and handling, in particular rehabilitation robots and robotic manipulation and assistance techniques.
27. Surgical covers, sterile suture material, sterile fabrics, sterile clothing.
28. Information and communication means for health, telemedicine and eHealth.
29. Equipment of medical and dental facilities, operating rooms and premises, veterinary facilities, including operating tables.
30. Nanofiber medical devices for scaffold, wound cover and tissue replacement.
31. Materials for regenerative medicine that exceed the commonly achieved parameters and properties.
32. Laboratory and medical devices for regenerative medicine.
33. Medical devices for non-invasive diagnostics and measurement of biological quantities that exceed commonly achieved parameters.

35. New generation medical devices for physical interventions.

37. Apparatus for the destruction of tumor and other tissues by means of high performance photocopied ultrasound, electromagnetic field, laser radiation, or other forms of non-ionising radiation, shock wave devices.

40. Defibrillators with higher safety and efficiency.
41. Apparatus for disinfection by physical means.
42. Products for regenerative medicine.
43. Resources for reconstruction surgery.

46.1. peripheral blood-flow support devices,

Transitional provision
Regulation No 221 / 2019 Coll., as effective before the date of entry into force of this Regulation, applies to investment incentives that have not been definitively terminated before the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on the 15th day following its publication.
