DECLARATION
of 26 November 2002
laying down protection zones for the source of natural mineral water in Byňov and defining specific protection measures (Ordinance on protection zones for the source of natural mineral water in Byňov)
According to Section 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Places and on the amendment of certain related laws (the Spa Act) (hereinafter referred to as the Act):
Definition of protection zones and determination of specific protection measures
(Paragraph 21 (1) of the Law)
(1) In order to protect the source of natural mineral water, which is covered by a drilling well HV-5 located on land parcel No 1353 / 2, the cadastral territory of Byňov, the district of České Budějovice, the region of South Bohemia (hereinafter referred to as "the source"), 1), protection zones of grades I and II are established.
(2) Level I protection zone is the immediate vicinity of the source output. It is situated on land parcel No 1353 / 2, the cadastral territory of Byňov, and is defined by a circle with a radius of 10 m with a centre in the well HV-5.
(3) The Level II protection zone is established to protect part of the infiltration territory of the base resource structure (Section 23 (1) of the Act). It is defined by the area of the hydrological water catchment area of Stropnice between the profile under the bridge via Stropnice near the village of Byňov above the left-hand entrance from the Pattlák pond (upper profile) and the profile under the bridge via the Stropnice near the settlement of Terezín (village of Petřikov) and the area of the lower part of the water catchment area of the Nakolický creek under the Nakolický pond. This definition is graphically marked in the Basic map of the Czech Republic, scale 1: 50 000,2), annexed to this decree.
(Articles 22 (2) and 23 (3) of the Law)
(1) Level I protection zone constitutes a zone of physical protection of the source.
(2) The following shall be prohibited in Level II protection zone:
(a) to operate landfills of hazardous waste, 3)
(b) mine minerals and peat, 4)
(c) carry out mining activities and activities carried out in a mining manner, where it is linked to interference with the land, (5) with the exception of activities related to the protection, exploitation and further development of the source;
(d) to treat harmful substances to a greater extent, 6)
(e) discharge of waste water into groundwater, 6)
(f) establish rendering plants, slaughterhouses, waste incineration plants;
(g) to build production ducts for hazardous defective substances. 6)
(3) The activities referred to in paragraph 2, if carried out in Level II protection zone, will be completed within 1 year of the entry into force of this Decree.
(Paragraph 24 (2) of the Law)
The Class I protection zone shall be fenced and marked with a "Natural mineral water source physical protection zone. No unauthorized entry."
Final provisions
The definition of the II-degree protection zone in the Basic map of the Czech Republic in the scale 1: 10 000 is available at the Ministry of Health and the City Office of the New Hrad.
This Decree shall take effect on 1 January 2003.
