GOVERNMENT REGULATION
of 20 February 2013
amending Government Regulation No. 135 / 2009 Coll., providing a one-time contribution to mitigate certain injustices caused by the Communist regime
The Government hereby orders pursuant to Paragraph 8 (1) of Act No. 198 / 1993 Coll., on the illegality and resistance of the Communist regime, as amended by Act No. 220 / 2011 Coll.:
Government Regulation No. 135 / 2009 Coll., providing a one-off contribution to mitigate certain injustices caused by the Communist regime, is amended as follows:
1. In Article 1, the following paragraph 2 is inserted after paragraph 1, including footnotes 2 and 3:
"(2) National citizens of the Czech Republic who have been included in the road banners of the groom's army, the auxiliary technical banners and the military bays (hereinafter referred to as" forced labour military camp ') are also entitled to the allowance provided for in § 18 (1) of Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, as amended by Act No. 267 / 1992 Coll. and Act No. 78 / 1998 Coll., where they have been granted a special pension allowance for inclusion in the military camp of forced labour (2) or a claim for compensation under another law issued for the implementation of Act No. 198 / 1993 Coll., on the illegality of the Communist regime and on resistance against it, as amended by Act No. 220 / 2011 Coll.3).
2) Article 5 of Act No. 357 / 2005 Coll., on the award of participants in the national struggle for the creation and liberation of Czechoslovakia and certain survivors of them, on the special contribution to the pension of certain persons, on the lump sum of certain participants in the national struggle for liberation between 1939 and 1945 and on the amendment of certain laws, as amended.
3) Government Decree No. 102 / 2002 Coll., on the payment of one-off financial compensation to mitigate certain injustices caused by the Communist regime to persons assigned to military forced labour camps. '.
Paragraph 2 shall become paragraph 3.
2. In Paragraph 1 (3), the word "or 'is replaced by a comma.
3. In Paragraph 1, at the end of paragraph 3, the words "or inclusion in a forced labour military camp 'shall be added.
4. In Article 2, the following paragraph 2 is inserted after paragraph 1:
"(2) The Ministry of the Interior shall decide on the entitlement to the payment of the contribution on the basis of a written request from the person referred to in Section 1 (2), which shall accompany the application with documents certifying its entitlement. The application may be lodged no later than 31 December 2013, otherwise entitlement to the payment of the allowance shall cease. '.
Paragraph 2 shall become paragraph 3.
5. In § 3, the words "or 2 are added at the end of the text; this is not the case if the widow of a citizen of the Czech Republic fulfils the conditions laid down in § 1 (2), whose application for a contribution referred to in § 1 (1) has been rejected in time."
Transitional provision
Where a person has been granted a right to receive a contribution pursuant to Government Regulation No. 135 / 2009 Coll., as effective before the date of entry into force of this Regulation, he may not be entitled to pay the contribution again on the basis of the same facts.
Efficacy
This Regulation shall enter into force on the day of its publication.
