DECLARATION
of 13 September 2004
amending Decree No. 332 / 2000 of the Ministry of Industry and Trade Coll., laying down certain procedures for the approval and verification of certain meters marked with EEC mark, as amended by Decree No. 260 / 2003 Coll.
The Ministry of Industry and Trade provides pursuant to Section 27 of Act No. 505 / 1990 Coll., on Metrology, as amended by Act No. 4 / 1993 Coll., Act No. 20 / 1993 Coll., Act No. 119 / 2000 Coll. and Act No. 137 / 2002 Coll., (hereinafter "the Act ') for the implementation of Sections 6 paragraphs 2, 3 and 9 and Sections 9 paragraphs 1 and 2 of the Act:
Decree No 332 / 2000 Coll., laying down certain procedures for the type-approval and verification of specified meters marked with EEC mark, as amended by Decree No 260 / 2003 Coll., is hereby amended as follows:
1. In Article 1 (1), the introductory part of the provision is replaced by the words "This decree (1) implements the relevant provisions of the European Community1a) and sets out the procedures for '.

"(1) It shall be issued on the basis and within the limits of the law, the content of which allows the relevant provisions of the European Communities to be incorporated by decree.
(1a) Council Directive No 71 / 316 / EEC of 26 July 1971 on the approximation of the laws of the Member States relating to common provisions for measuring instruments and methods of metrological control. Council Directive 83 / 575 / EEC of 26 October 1983 amending Directive 71 / 316 / EEC of 26 July 1971 on the approximation of the laws of the Member States relating to common provisions for measuring instruments and methods of metrological control. Council Directive 87 / 355 / EEC of 25 June 1987 amending Directive 71 / 316 / EEC of 26 July 1971 on the approximation of the laws of the Member States relating to common provisions for measuring instruments and methods of metrological control. Council Directive 88 / 665 / EEC of 21 December 1988 amending several Directives on the approximation of the laws of the Member States containing provisions on the publication of and testing and certificates in the Official Journal of the European Communities. '
footnote 1 shall be renumbered footnote 1b, including the footnote references.
2. In Article 2 (2), the words "established in a Member State of the European Union 'shall be inserted after the words" authorised representative'.
3. In Paragraph 2 (3), the comma after the word "State 'is replaced by a dot and the words" in the period prior to the accession of the Czech Republic to the European Union may be filed in one Member State or in the Czech Republic if the relevant international treaty so permits' are deleted.
4. In Paragraph 2 (5), the second sentence is replaced by the following: "In the cases specified in the separate legislature1b), the applicant shall, in all other cases, be allowed to place on each instrument or device conforming to the approved type the approval mark shown in the certificate."
5. in Article 4 (2), Annex 2, point 1.2 and Annex 2, point 2.2, the words "or authorised metrology centre" shall be inserted after the word "Institute."
6. Paragraph 4 (3), including footnote 4, reads:
"(3) In the case of measuring instruments bearing the EEC initial verification mark, the period of validity of the verification shall be laid down in a separate legislation.4)
4) Decree No 345 / 2002 Coll., setting out the measuring instruments for compulsory verification and the measuring instruments subject to type approval. '
7. In Article 4 (5) (c), "if 'is replaced by" whether'.
8. In Article 4 (6), the words "paragraphs 2 and 3 and points 1 and 2 of Annex 2 to this Decree, Institut 'shall be replaced by the words" this Decree and special legislation (1b), the Institute or the authorised metrology centre'.
9. In Annex 1, point 3.3, the words "and does not contain any other entry 'shall be inserted after the word" axis'.
10. In Annex No 1, point 5.1 is deleted.
Points 5.2 to 5.4 shall be renumbered 5.1 to 5.3.
11. In Annex 1, point 5.2, the words "points 5.1 and 5.2 'are replaced by the words" point 5.1'.
12. In Annex 1, points 6.1 to 6.4 read:
"6.1. EEC type-approval mark

13. In Annex 2, point 2.1, the words "or an authorised metrology centre 'shall be inserted after the words" the Institute'.
14. In Annex 2, point 2.3, the words "Institute, Institute 'may be replaced by" Institute or Authorised Metrology Centre, Institute or Authorised Metrology Centre'.
15. in Annex 2, point 3.1.1.1 (a), the words "and, where necessary, with one or two figures identifying further territorial divisions;" shall be deleted and the words "or authorised metrology centres" shall be added after the words "Institute."
16. In Annex 2, point 3.2.2, the example of the graphic design of the EEC initial verification mark is replaced by the following:
x - identification number of the relevant Institute or Authorised Metrology Centre '.
17. in Annex 2, point 3.2.3 reads:
"The Office for Technical Standardisation, Metrology and State Testing shall arrange for the exchange of drawings of EEC initial verification marks corresponding to the shapes in the accompanying models with the metrological services of the Member States. ';
Efficacy
This Decree shall take effect on 15 October 2004.
