DECLARATION
of 25 November 2025
on regulatory reporting
Pursuant to Section 98a (2) (e) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll.:
Subject matter
This decree sets out the formalities and breakdown of the regulatory reports, including their models, depreciation rates for regulatory purposes and rules for drawing up regulatory reports and deadlines for submitting them.
Definition of the concept of an operating asset
Operating assets for the purposes of this decree shall mean the fixed tangible and intangible assets necessary to ensure the licensed activity reduced by:
(a) outstanding fixed assets;
(b) goodwill;
(c) advances granted on long-term intangible assets;
(d) outstanding fixed assets;
(e) advances granted on fixed assets;
(f) asset items;
(g) the valuation difference for the assets acquired;
(h) long-term financial assets; and
(i) greenhouse gas emission allowances.
Breakdown and formalities of regulatory reports
(1) Regulatory reports are broken down into reports
(a) assets and changes in assets and liabilities;
(b) investment expenditure;
(c) profit or loss;
(d) costs;
(e) revenue;
(f) financial flows;
(g) incentive programmes;
(h) changes in energy equipment;
(i) balance sheet;
(j) technical;
(k) tariff statistics;
(l) thermal energy supply systems, price locations and price calculations; and
(m) parameters for determining the regulated value of the gas installation.
(2) The list of regulatory reports is set out in Annex 1 to this Decree.
(3) The regulatory statements for each licensed activity are indicated by the following activity number:
(a) number 12 - electricity distribution; the particulars and breakdown of such statements, including their models, are set out in Annex 2 to this Decree,
(b) No 13 - electricity transmission; the particulars and the breakdown of these statements, including their models, are set out in Annex 3 to this Decree,
(c) No 14 - Trade in electricity; the particulars and the breakdown of those statements, including their models, are set out in Annex 4 to this Decree,
(d) number 15 - the activities of the market operator; the particulars and breakdown of such statements, including their models, are set out in Annex 5 to this Decree,
(e) number 16 - the activities of the Electroenergy Data Centre; the details and breakdown of these statements, including their models, are set out in Annex 6 to this Decree,
(f) number 22 - gas distribution; the particulars and the breakdown of such statements, including their models, are set out in Annex 7 to this Decree,
(g) number 23 - gas transport; the details and breakdowns of these statements, including their models, are set out in Annex 8 to this Decree,
(h) number 25 - gas storage; the details and breakdowns of these statements, including their models, are set out in Annex 9 to this Decree,
(i) number 31 - heat generation; the details and breakdowns of these statements, including their models, are set out in Annex 10 to this Decree; and
(j) number 32 - the distribution of heat energy; the details and breakdown of these statements, including their models, are set out in Annex 10 to this Decree.
Rules for drawing up regulatory reports
(1) Unless otherwise specified, the regulatory reports shall be processed in the year "i-1 'for the calendar year" i-2' where the year "i 'means the year for which the Energy Regulatory Authority decides on prices and, where appropriate, as a calendar year plan in accordance with the model of that statement.
(2) The licence holder shall draw up and submit the regulatory reports separately for each of the licensed activities, with the exception of those Nos 31 and 32.
(3) Unless otherwise stated, the licence holder shall report data in the regulatory statements in accordance with the Czech Accounting Standards. The minimum period of depreciation of the specified property used by the licence holder for the activity number 12, 13, 15, 16, 22, 23, 31 or 32 is set out in Annex 11 to this Decree.
Assets and changes in assets and liabilities
(1) In the accounts of assets and changes in assets and liabilities, the licence holder shall report:
(a) the property of the licence holder;
(b) the assets disposed of;
(c) depreciation,
(d) long-term tangible and intangible assets in use ("assets activated");
(e) property acquired by the transformation of a commercial corporation;
(f) changes in the classification of assets;
(g) assets transferred because of organisational changes;
(h) property acquired from subsidies; and
(i) liabilities and other liabilities.
(2) In the accounts of assets and changes in assets and liabilities, the licence holder shall report the value of the assets acquired under contracts concluded by 31 December 2020 and used for the pursuit of the licensed activity which he is granted for use for consideration under the contract and which the licence holder is entitled or obliged to purchase, or to acquire, during or after the expiry of the contractual obligation or to acquire, the right of ownership after that period (hereinafter referred to as "financial leasing ').
(3) Assets and changes in assets and liabilities are identified as A.
Statement of investment expenditure
(1) Investment expenditure accounts shall report investment expenditure, investments in progress and related data by investment action.
(2) The statements of investment expenditure are indicated in point I.
Economic outturn accounts
(1) The statement of profit or loss shall include the proceeds and costs of the licence holder.
(2) The statements of profit or loss are identified by the letters HV.
Cost statements
(1) The cost statement for the licence holder for activity number 12, 22 or 23 includes the costs of carrying out the licensed activity, broken down into individual processes and subdivided into voltage levels for electricity distribution activities, transport types and network types for gas distribution activities.
(2) The statement of costs for the holder of the licence for activity number 13 contains the costs of carrying out the licensed activity, broken down by type of activity and type of technology.
(3) The statement of costs for the holder of the licence for activity number 14 contains the costs related to the activity of the obligated buyer of the trader.
(4) The cost statement for the licence holder for activity number 15 shall include the costs of carrying out the licensed activity of the market operator, broken down by activities related to the clearing of derogations, the organisation of the market, the payment and administration of support from supported sources, the issue of guarantees of origin and the registration and provision of data in connection with the directly applicable European Union Regulation on the integrity and transparency of the wholesale energy market (1).
(5) The cost statements are identified as N.
Income statement
(1) The licence holder for activity number 13 has data on revenue from congestion revenue on cross-border profiles and an overview of the use of such revenue.
(2) The statement of congestion revenue shall be marked "V."
Financial flow reports
(1) In the financial flow statement, the licence holder for activity number 14 shall report the actual cash flows for the year "i-2 'related to the promotion of renewable energy sources after each calendar month.
(2) Financial flow statements are identified by letters FA.
Statement of incentive schemes
(1) In the statement of the incentive schemes, the licence holder for the activity number 12, 13, 15, 16 or 23 shows values for the individual parameters of the incentive programmes according to the price regulation methodology (2).
(2) The statements of the incentive programmes are indicated by the letters MP.
Reports of changes in energy equipment
(1) In the energy plant change report, the licence holder shall report changes to the activity number 12, 13, 22, 23 or 32 of the energy plant operated by him within his designated territory. The licence holder shall report separately, for each of its designated territories, energy installations newly built, acquired or discontinued for its licensed activities, including energy installations removed.
(2) The reports of changes in energy equipment are indicated by L.
Balance sheet reports
(1) In the balance sheets, the licence holder for activity number 12 or 13 shall show the balance of energy in terms of part of the resources and part of the consumption for that part of the electricity system. In addition, balance sheets shall include maximum power at the interface of different parts of the electricity system operated by different licence holders.
(2) In the balance sheets, the licence holder for activity number 15 shows the value of losses in each distribution area for the purposes of assessing deviations.
(3) In balance sheets, the licence holder for activity number 22 shows the balance of the quantity of gas entering and leaving the system and the balance difference on the basis of the actual invoiced quantity of gas distributed in year "i-3."
(4) The balance sheets are marked with the letter B.
Technical reports
(1) In the technical statements, the licence holder for activity number 13 shall report data on system services related to ensuring the stability of the operation of the electricity system.
(2) In the technical statements, the licence holder for activity number 14 or 15 shall report data relating to the support of supported energy sources.
(3) In the technical statements, the licence holder for activity number 22, 23 or 25 shall report the maximum achieved, the reserved capacity and other details of the operation of the gas systems and gas storage units.
(4) The technical statements are indicated in D.
Tariff statistics reports
(1) In the tariff statistics reports, the licence holder for activity number 12 or 13 shall report data on the reserved capacity, the reserved power input, the measured maximum, the sampling points and the quantity of electricity supplied and withdrawn, including related sales.
(2) In the tariff statistics reports, the licence holder for activity number 22 shows data on the reserved capacity, the quantity of gas distributed, the sampling points and other data on the quantity of gas delivered and withdrawn, including related sales.
(3) The statements of tariff statistics are marked T.
Reporting of thermal energy supply systems, price locations and price calculations
(1) In the thermal energy supply systems, price locations and price calculations, the licence holder shall report on the activity number 31 or 32, the calculation of heat energy prices processed in accordance with the price range setting out the conditions for the negotiation of thermal energy prices, operating assets and newly acquired assets, the smuggled or leased assets, the methods of dividing the economic eligible costs, the balance of the number of customers and the point of demand, the balance of production, the purchase and sale of heat energy, the inventory of the sources of the thermal energy supply system and the price locations and other related data.
(2) In the reports of thermal energy supply systems, price locations and price calculations, the licence holder shall report actual or planned data for each period of time according to the nature of the declaration.
(3) The licence holder shall report in the statement:
(a) the price location records planned for the current calendar year;
(b) the price location of the aggregate planned data for the current calendar year and the actual data for the previous calendar year, separately for each price location;
(c) the price locations planned for the current calendar year for the preliminary statement and the actual data for the previous calendar year for the resulting statement, separately for each price location;
(d) the price calculation of the planned data for the current calendar year and the actual data for the previous calendar year, separately for each price location; and
(e) the thermal energy supply system, the actual data for the previous calendar year, separately for each heat supply system.
(4) The statements of price locations and price calculations are marked "C."
Values of parameters for the determination of the regulated value of the gas installation
(1) In the statements of parameters for the determination of the regulated value of the gas installation, the licence holder for activity number 22 shows the investment prices of distribution gas installations and the specific consumption of gas of defined types of households.
(2) The statements of parameters for the determination of the regulated value of the gas installation are marked with the letters RH.
Dates for submission of regulatory reports by the licence holder
The licence holder shall submit the regulatory reports at the dates set out in Annex 1 to this Regulation.
Submission of regulatory reports by the local distribution system operator
(1) The local distribution system operator in the field of electricity, to which the Energy Regulatory Authority sets electricity distribution prices (3), shall compile and submit only the regulatory reports referred to in Annex 1 (1) (b). B to this decree.
(2) The local distribution system operator in the field of electricity, to which the Energy Regulatory Authority does not set electricity distribution prices (3), shall compile and submit only the regulatory reports referred to in Annex 1 (1) (b). C to this decree.
(3) The local gas distribution system operator, to which the Energy Regulatory Authority sets the price for the distribution system service (3), shall compile and submit only the regulatory reports referred to in Annex 1 (6) (b). B to this decree.
(4) The local gas distribution system operator, to which the Energy Regulatory Authority does not set the price for the distribution system service (3), shall compile and submit the regulatory reports referred to in Annex 1 (6) (b). C to this decree.
Transitional provisions
(1) The licence holder shall, for the purposes of the regulation, write down the assets put up for use by 31 December 2025 at least for the period laid down in Annex 10 to Decree No. 262 / 2015 Coll., as effective before the date of entry into force of that decree.
(2) The holder of the licence for activity number 31 or 32 shall draw up and submit for 2025 a statement of 31, 32-CL: a statement of the price location and a statement of 31, 32-AP: an account of the assets and liabilities referred to in Decree No. 262 / 2015 Coll., as effective before the date of entry into force of this decree.
Repeal
They shall be deleted:
1. Decree No. 262 / 2015 Coll., on regulatory reporting.
2. Decree No. 50 / 2017 Coll., amending Decree No. 262 / 2015 Coll., on regulatory reporting.
3. Decree No. 554 / 2020 Coll., amending Decree No. 262 / 2015 Coll., on regulatory reporting, as amended by Decree No. 50 / 2017 Coll.
4. Decree No. 513 / 2021 Coll., amending Decree No. 262 / 2015 Coll., on regulatory reporting, as amended.
Efficacy
This Decree shall take effect on 1 January 2026.
