DECLARATION
of 13 December 2005
amending Decree No. 182 / 1991 Coll., implementing the Act on Social Security and the Act of the Czech National Council on Social Security for the Bodies of the Czech Republic, as amended
The Ministry of Labour and Social Affairs provides, pursuant to § 58 (a) of Act No. 114 / 1988 Coll., on the jurisdiction of the Czech authorities in social security, as amended by Act No. 144 / 1991 Coll., Act No. 582 / 1991 Coll., Act No. 118 / 1995 Coll. and Act No. 91 / 1998 Coll., and under § 177a (1) of Act No. 100 / 1988 Coll., on Social Security, as amended by Act No. 37 / 1993 Coll., Act No. 307 / 1993 Coll. and Act No. 360 / 1999 Coll.:

Decree No. 182 / 1991 Coll., implementing the Act on Social Security and the Act of the Czech National Council on the Jurisdiction of the Bodies of the Czech Republic in Social Security, as amended by Act No. 482 / 1991 Coll., Act No. 582 / 1991 Coll., Decree No. 28 / 1993 Coll., Decree No. 137 / 1994 Coll., Decree No. 139 / 1998 Coll., Decree No. 552 / 2002 Coll., Decree No. 206 / 1995 Coll., Decree No. 320 / 1999 Coll., Decree No. 73 / 1997 Coll., Decree No. 72 / 2001 Coll., Decree No. 552 / 2002 Coll., and Decree No. 365 No. 365 / 2004 Coll., is amended as follows:
1. In Article 28 (2), the words "or the person referred to in the third sentence of Article 49 (4) 'shall be inserted after the words" a party to the trade union'.
2. In Paragraph 36 (4), "CZK 3,920 'is replaced by" CZK 4,200', "CZK 9,124 'is replaced by" CZK 9,900', "CZK 2,170 'is replaced by" CZK 2,300' and "CZK 5,624 'is replaced by" CZK 6,000'.
3. In Paragraph 37 (2), "CZK 6,000 'is replaced by" CZK 6,500'.
4. In Paragraph 49, at the end of paragraph 4, the sentence "A care service shall also be provided free of charge to persons who:
(a) are involved in rehabilitation under Act No. 119 / 1990 Coll., on judicial rehabilitation, as amended by Act No. 47 / 1991 Coll., or in which a condemning judicial decision for the offences referred to in § 2 of Act No. 119 / 1990 Coll., as amended by Act No. 47 / 1991 Coll., was revoked before the date of its effectiveness, or were involved in rehabilitation under § 22 (c) of Act No. 82 / 1968 Coll., on judicial rehabilitation, provided that the wrongful exercise of custody or imprisonment was at least 12 months in total;
(b) have been classified in a forced labour camp or in a labour unit where the decision to include it has been annulled pursuant to Article 17 (1) of Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, or in a military forced labour camp, where the order for inclusion in that camp has been revoked pursuant to Article 18 (1) of the Act No. 87 / 1991 Coll., as amended by Act No. 267 / 1992 Coll. and Act No. 78 / 1998 Coll., or in a central monastery with a regime similar to the forced labour camps, provided that the total period of residence in those establishments was at least 12 months. "
5. Annex 2 shall read as follows:

"Annex No 2 to Decree No 182 / 1991 Coll.
Disability justifying the granting of exceptional benefits
1. Exceptional Class I benefits (TP card) are granted in the following cases of disability:
(a) loss of grip capacity or significant limitation of upper limb function (for example, on the basis of anatomical loss, paralysis, mild oedema);
(b) anatomical loss of several fingers on both legs or leg loss at the joints of Lisfrank or Chopart and above, up to and including the lower leg;
(c) a significant reduction in the function of one lower limb (for example, on the basis of functionally significant paresis, arthrosis of the knee and hip joints, or stiffening of the knee or hip joints, post-entrapment condition, leg or femur paddles),
(d) limitation of the function of two limbs (for example, based on light hemiparesis or paraparesis, arthrotic involvement of the carrier joints of both lower limbs, heavier forms of osteoporosis, polyneuropathies, joint instability or inflammatory involvement of joints),
(e) shortening of one lower limb exceeding 5 cm;
(f) disease of the spine, post-surgery and injury to the spine with persistent signs of nerve and muscle irritation, insufficiency of the muscle corset and limitation of the mobility of two sections of the spine;
(g) vascular involvement of one lower limb with severe blood circulation disorder (e. g. trophic changes, mild oedema, claudication, severe varicose complex),
(h) seizures of various aetiology associated with repeated impaired consciousness, dizziness.
2. Exceptional grade II benefits (ZTP card) are granted in the following cases of disability:
(a) anatomical loss of one lower limb in the knee or thigh;
(b) anatomical loss of two lower limbs at the level of Lisfrankov or Chopart's joint and above;
(c) functional loss of one lower limb (for example, on the basis of severe paralysis or plegia of this limb, severe malfunction of the function of two supporting joints with loss of the opacifying function of the limb, condition after implantation of hip or knee joint entrapment with significantly impaired function of the operated limb),
(d) simultaneous functionally significant anatomical losses of part of one lower and one upper leg or both upper legs at leg and forearm level;
(e) a significant reduction in the function of two limbs with severe musculoskeletal disorders in neurological, inflammatory, degenerative or systemic diseases of the musculoskeletal apparatus (for example, on the basis of moderate hemiparesis or paraparesis, a significant reduction in hip and knee joint mobility by usually half the range of joint excursions);
(f) disease of the spine, post-operative conditions and injuries to the spine with moderate paresis, severe muscle atrophy or severe spinal deformities with reduced chest excursion, stiffening of three spinal sections;
(g) severe binding of the blood vessels of both lower limbs with significant trophic impairment and significant functional mobility impairment,
(h) chronic defects and internal disorders which significantly complicate movement capacity (for example, defects and heart disease with recurrent circulatory insufficiency, respiratory insufficiency of a severe degree, kidney failure at dialysis stage, accompanied by severe physical complications, oncological diseases with adverse associated signs of movement and orientation),
(i) two-way practical deafness or two-way total deafness, which means the total loss of a Fowler hearing of 85% or more, more than 70 dB;
(j) combined hearing and vision impairment (deafness) functionally within the range of bilateral moderate inaudibility, which means the loss of a Fowler hearing of 40 to 65%, and a bilateral strong visual weakness, which means visual acuity with the best possible correction on a better eye, where the maximum is less than 6 / 60 and the minimum is equal to or better than 3 / 60, or a bilateral concentrated visual field restriction of 30 to 10 degrees, even if the central islet is not affected,
(k) bilateral severe loss of vision, meaning visual acuity with correction, where the maximum is less than 3 / 60, a minimum equal to or better than 1 / 60.
3. Exceptional Grade III benefits (ZTP / P card) are granted in the following cases of disability:
(a) anatomical loss of the lower leg high in the thigh with an anatomically unfavourable stump or hip;
(b) the anatomical loss of both legs in the legs and above, or the loss of the essential parts of the upper and lower legs at the level of the humerus and femur or the two upper legs at the level of the arm,
(c) functional loss of one lower and one upper limb (such as hemiplegia or severe hemiparesis) or both lower limbs (such as paraplegia or severe paraparesis, severe destruction of the knee and hip joints),
(d) severe mobility disorder due to severe involvement of several functional units of the motion train with a dependency on the wheelchair; functional total means the torso, spine, pelvis, limb,
(e) disproportional growth disorders accompanied by severe deformities of the limbs and chest, provided that the height after growth does not exceed 120 cm;
(f) long-term multi-organ failure of two or more organs, where it significantly reduces movement or orientation;
(g) incomplete (practical) vision of both eyes, which means visual acuity with the best possible correction of 1 / 60, 1 / 50 to light or visual field limitation of up to 5 st. around central fixation, even if central acuity is not affected, or complete vision of both eyes, which means loss of vision involving conditions ranging from total loss of light-sensitivity to maintenance of light-sensitivity with incorrect light projection;
(h) two-way practical deafness or two-way total deafness in children until completion of compulsory education;
(i) moderate, severe and deep mental retardation or dementia, if IQ is worse than 50, mental illness with long-term severe orientation and communication disorders;
(j) the combined severe hearing and vision impairment (deafness) functionally in the range of both-sided severe audiences to deafness, which means loss of hearing according to Fowler is less than 65%, and bilateral severe loss of vision.
4. Exceptional advantages of Grade I, II or III may also be granted in cases of diseases and defects other than those referred to in points 1 to 3, where they substantially restrict movement or orientation, depending on the extent and severity of the functional consequences comparable to those referred to in points 1 to 3. "
6. Annex 5 shall read as follows:

"Annex No 5 to Decree No 182 / 1991 Coll.
Disability justifying the provision of allowance for apartment, payment for use of wheelchair-free apartment and garage, purchase, general repair and modification of motor vehicle
For the purposes of the allocation of cash allowances for the adaptation of the apartment, the payment for use of the wheelchair-free apartment and garage and for the purchase, general repair and modification of the motor vehicle, the following shall be considered as a severe defect in the load or motion train:
(a) amputation loss of the lower leg in the thigh;
(b) amputation loss of both lower limbs in the legs and above;
(c) functional loss of both lower limbs on the basis of complete polio (plegie) or severe paralysis;
(d) ankylose of both hip joints or of both knee joints or of a substantial limitation of the momentum of both hip or knee joints for severe contractions in the surrounding area,
(e) the simultaneous rigidity of all spine sections with a severe mobility restriction of at least two lower leg supporting joints;
(f) severe functional mobility disorder due to the involvement of several functional units of the movement system with possible dependency on the wheelchair; a functional total means the hull, pelvis, limb,
(g) disproportional growth disturbances linked to the deformities of the limbs and chest, if the height of the affected body does not exceed 120 cm after the end of growth;
(h) anatomical or functional loss of the limb '.

Efficacy
This Decree shall take effect on 1 January 2006.
