DECLARATION
of 15 November 2006
implementing certain provisions of the Social Services Act
The Ministry of Labour and Social Affairs provides according to § 119 paragraph 2 of Act No. 108 / 2006 Coll., on Social Services:

METHOD OF EVALUATION OF THE COMPETENCE OF THE ESSENTIAL ENVIRONMENTAL NEED
§ 1
(1) The ability of a person to manage basic living needs is assessed for the purpose of determining the degree of dependency according to the activities defined for each essential living needs in Annex 1 to this Decree.
(2) The ability of a person to manage basic living needs for the purpose of determining the degree of dependency is assessed in the natural social environment and in view of the age of a natural person.
(3) The assessment of the ability of a person to manage the basic needs of life shall be carried out:
(a) body structure; and
(b) mental, mental, sensory, circulatory, respiratory, haematological, immunological, endocrine, metabolic, digestive, secretive, neuromusculoskeletal, including coarse and fine motor, and voice, speech and skin function,
in relation to the extent and weight of functional failure.
(4) A failure to manage basic life needs shall be considered a condition where the failure of functional abilities reaches a level of complete or severe failure, where, despite the use of retained natural person's potential and competences and the use of commonly available equipment, means, objects, daily needs or household equipment, public spaces or using a medical device, life needs cannot be managed in an acceptable standard. An inability to cope with basic living needs shall also be considered as a condition where a regime ordered by a specialist doctor providing specialised health services does not allow the basic living needs to be implemented in an acceptable standard. Acceptable standard means the management of the basic needs of life in quality and in a manner that is normal and normal and allows this need to be managed without the daily assistance of another person.
§ 2
(1) In assessing the ability of a person to manage basic life needs, it shall be assessed whether, due to long-term unfavourable health conditions, the extent of mental, mental, physical and sensory functions is sufficient to regularly manage the basic life needs and whether a natural person is able to recognise, perform and check the accuracy of the basic life needs. In doing so, account shall be taken of whether the long-term adverse health condition has a lasting effect on functional capacity, the outcome of rehabilitation and adaptation to disability.
(2) For persons who are continuously deteriorating and improving health status, the reference period applicable to the assessment of dependence usually lasts one year. the functional ability to manage the essential life-expectancy shall be determined in such a way as to correspond to the predominant extent of competence over the reference period.
§ 2a
If a person is unable to manage at least one of the activities defined in Annex 1 to this Decree for the ability to manage the basic living needs due to the long-term unfavourable health condition, he / she is unable to manage the basic living needs regardless of the cause of the long-term unfavourable health condition.
§ 2b
If a person under 18 years of age does not yet have the capacity to manage one of the essential needs of life or activity, as defined in Annex 1 to this Decree, due to the low age and the corresponding degree of biopsychosocial development, for the purposes of assessing the degree of dependency, it is not considered to be a person who is unable to cope with the basic needs of life. This does not apply if, because of the long-term unfavourable health condition, a person requires the daily special care of another natural person when managing the essential needs of life or certain activities as defined in Annex 1 to this Decree.
§ 2c
In assessing essential life needs for the purpose of determining the degree of dependency, basic life needs, which have been found to be unable to cope because of the long-term unfavourable health condition, are added together.

SCOPE OF THE ACTIVITIES PROVIDED UNDER THE BASIC ACTIVITIES FOR SINGLE SPECIES OF SOCIAL SERVICES AND MAXIMAL AMOUNTS FOR THE PROVISION OF CERTAIN SOCIAL SERVICES
§ 3
Basic social advice
(1) Basic social advice under Section 37 (2) of the Social Services Act is provided in the provision of social services to the extent of the following:
(a) providing information to address the adverse social situation through the social service;
(b) providing information on the choice of type of social services according to the needs of persons and on other forms of assistance, such as the benefits of assistance in material distress and social welfare;
(c) providing information on the fundamental rights and obligations of a person, in particular in relation to the provision of social services, and on the possibilities for the use of commonly available resources to prevent social exclusion and to prevent dependency on social services;
(d) providing information on the possibility of supporting family members in cases where they participate in the care of a person.
(2) The basic social advice for the provision of social services of personal assistance, care services, relief services and day care centres may also provide activities providing support to carers and activities consisting in training carers' skills to manage the care of those dependent on their assistance.
§ 4
Professional social advice
Basic activities in the provision of professional social advice shall be provided to the extent that:
(a) facilitating contact with the social environment:
brokerage of downstream services,
(b) socio-therapeutic activities:
providing advice on social systems, law, psychology and education orientation;
this basic activity may be provided by providing advice in at least 2 of these areas;
(c) assistance in the exercise of rights, legitimate interests and in the provision of personal matters:
1. assistance in the handling of routine issues;
2. assistance in restoring or strengthening contact with the natural social environment;
(d) activities providing support to carers and activities consisting of training carers' skills to manage the care of those dependent on their assistance.
§ 5
Personal assistance
(1) Basic activities in the provision of personal assistance shall be provided to the extent that:
(a) assisting in managing normal self-care tasks:
1. aid and support for food and drink,
2. help in dressing and undressing including special aids,
3. assistance in spatial orientation, independent movement in both internal and external space;
4. assistance for moving to the bed or cart;
(b) assistance for personal hygiene:
1. assistance in the operation of personal hygiene,
2. assistance in the use of toilets,
(c) aid for food security:
assistance in food and drink preparation,
(d) assistance in ensuring the functioning of the household:
1. help with cleaning and maintenance of household and personal belongings,
2. purchases and routine errands,
(e) educational, educational and activity activities:
1. assistance and support to a family in childcare;
2. Assistance for the restoration or consolidation of family contact and assistance and support for other activities promoting social inclusion;
3. assistance with training and strengthening of motor, mental and social skills,
(f) facilitating contact with the social environment:
This appropriation is intended to cover expenditure on studies, meetings of experts, information and publications directly linked to the achievement of the objective of the programme.
(g) assistance in the exercise of rights, legitimate interests and in the provision of personal matters:
1. assistance in communication leading to the exercise of rights and legitimate interests,
2. assistance in the handling of common affairs,
(h) assistance in ensuring the safety and possibility of staying in the natural social environment: supervision that a person dependent on assistance does not endanger himself or his surroundings.
(2) The maximum amount of remuneration for the provision of personal assistance according to the time actually used to ensure the operation is:
(a) CZK 165 per hour if the service is provided to a person not exceeding 80 hours per month;
b) 145 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
If the provision of the service, including the time necessary to ensure the operation, does not last an hour, the amount of the remuneration shall be reduced proportionally.
§ 6
Maintenance
(1) Basic activities in the provision of care services shall be provided to the extent of the following:
(a) assisting in managing normal self-care tasks:
1. aid and support for food and drink,
2. help in dressing and undressing including special aids,
3. assistance for spatial orientation, independent movement in the internal space;
4. assistance for moving to the bed or cart;
(b) assistance for personal hygiene or the provision of conditions for personal hygiene:
1. assistance in the operation of personal hygiene,
2. help in basic hair and nail care,
3. assistance in the use of toilets,
(c) provision of food or assistance in providing food:
1. provision of meals corresponding to age, the principles of rational nutrition and the needs of diet;
2. import or delivery of food,
3. assistance in food and drink preparation,
4. preparation and administration of food and drink;
this basic activity may only be provided to the extent of the operations referred to in points 3 and 4;
(d) assistance in ensuring the functioning of the household:
1. normal cleaning and maintenance of the household,
2. helping to ensure a large cleaning of the household, such as seasonal cleaning, post-painting cleaning,
3. water delivery,
4. heating in the stove, including delivery and preparation of the toaster, maintenance of heating equipment,
5. routine purchases and errands,
6. large purchases such as weekly purchases, purchase of clothing and necessary household equipment,
7. washing and ironing of bed linen and, where appropriate, small repairs;
8. washing and ironing of personal laundry and, where appropriate, minor repairs;
(e) facilitating contact with the social environment:
1. accompanying the children to the school, the school establishment, the doctor and accompanying them back;
2. accompanying adults to school, school facilities, employment, doctors, public authorities and institutions providing public services and accompanying them,
(f) assistance in the exercise of rights, legitimate interests and in the provision of personal matters:
1. assistance in communication leading to the exercise of rights and legitimate interests,
2. assistance in the handling of common affairs,
(g) assistance to ensure the safety and ability of staying in the natural social environment: supervision that a person dependent on assistance does not endanger himself or his surroundings.
(2) The maximum remuneration for providing the care service is:
(a) according to the time actually used to ensure the operations referred to in paragraph 1 (a) and (b), (c) (3) and (4) and (d) (1) (5) and (e) to (g)
1. 165 CZK per hour, if the service is provided to a person not exceeding 80 hours per month,
2.145 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
If the provision of such operations, including the time necessary to ensure them, does not last for an hour, the amount of the remuneration shall be reduced proportionally,
(b) for the act referred to in paragraph 1 (c) (1)
1. 290 CZK per day for providing a full daily diet in the range of at least 3 main meals,
2. 135 CZK for lunch,
including operational costs related to food preparation,
(c) 65 CZK for the operation referred to in paragraph 1 (c) (2),
(d) 180 CZK for the operation referred to in paragraph 1 (d) (6),
(e) 110 CZK per kilogram of laundry for the operations referred to in paragraph 1 (d) (7) and (8).
§ 7
Emergency care
(1) Basic emergency care activities shall be provided to the extent that:
(a) provision or brokering of emergency assistance in a crisis situation:
1. the provision of continuous distance voice and electronic communication,
2. in the event of an acute threat to the life or health of brokering the medical emergency services, police or firefighters,
(b) socio-therapeutic activities:
social therapy activities, the provision of which leads to the development or maintenance of personal and social skills and skills promoting the social inclusion of persons,
(c) facilitating contact with the social environment:
support and assistance for the use of commonly available services and information resources,
(d) assistance in the exercise of rights, legitimate interests and in the provision of personal matters:
assistance in communication leading to the exercise of rights and legitimate interests.
(2) The maximum payment for emergency care is equal to the actual cost of operating technical means of communication.
§ 8
Guiding and pre-counting services
(1) Basic activities in the provision of guide and preset services are provided to the extent of the following:
(a) facilitating contact with the social environment:
1. accompanying children to school, school, doctor, interest and leisure activities and accompanying them back;
2. accompanying adults to school, school facilities, employment, doctors, interest and leisure activities, public authorities and institutions providing public services and accompanying them,
(b) assistance in the exercise of rights, legitimate interests and in the provision of personal matters:
1. assistance in the handling of routine issues;
2. assistance in communication leading to the exercise of rights and legitimate interests;
3. reading or other means of providing information to persons with communication disabilities.
(2) The maximum amount of remuneration for the provision of guide and preset services according to the time actually used to ensure the operation is:
(a) CZK 165 per hour if the service is provided to a person not exceeding 80 hours per month;
b) 145 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
If the provision of the service, including the time necessary to ensure the operation, does not last an hour, the amount of the remuneration shall be reduced proportionally.
§ 9
Support for separate housing
(1) The basic activities in providing support for separate housing shall be provided to the extent that:
(a) assistance in ensuring the functioning of the household:
1. help with cleaning and maintenance of household and personal belongings,
2. support for the acquisition of household-related habits;
3. assistance in the maintenance of domestic appliances,
4. food security assistance,
5. helping to ensure a large cleaning of the household, such as seasonal cleaning, post-painting cleaning,
6. support for money management, including assistance with purchases and routine errands,
(b) educational, educational and activity activities:
1. support for the management of family children,
2. vocational training with children;
3. training and strengthening of motor, mental and social skills,
4. Assistance for the restoration or consolidation of family contact and assistance and support for other activities promoting social inclusion;
5. Support for partner relations,
6. support for the acquisition of habits related to inclusion in the work process,
(c) facilitating contact with the social environment:
1. accompanying children to school, school, doctor, interest and leisure activities and accompanying them back;
2. accompanying adults to school, school facilities, employment, doctors, interest activities, public authorities and institutions providing public services and accompanying them,
3. support for the acquisition of habits related to inclusion in the normal social environment, including the use of commonly available services and information sources;
(d) socio-therapeutic activities:
social therapy activities, the provision of which leads to the development or maintenance of personal and social skills and skills promoting the social inclusion of persons,
(e) assistance in the exercise of rights, legitimate interests and in the provision of personal matters:
1. assistance in communication leading to the exercise of rights and legitimate interests,
2. help in the handling of common affairs.
(2) The maximum amount of remuneration for the granting of aid for separate housing according to the time actually consumed to ensure operations is:
(a) CZK 165 per hour if the service is provided to a person not exceeding 80 hours per month;
b) 145 CZK per hour if the service is provided to the person in the range of more than 80 hours per month;
If the provision of the service, including the time necessary to ensure the operation, does not last an hour, the amount of the remuneration shall be reduced proportionally.
§ 10
Relief services
(1) Basic activities in the provision of relief services shall be provided to the extent that:
(a) assisting in managing normal self-care tasks:
1. aid and support for food and drink,
2. help in dressing and undressing including special aids,
3. assistance for moving to a bed or cart,
4. assistance for spatial orientation, independent movement in internal and external space;
(b) assistance for personal hygiene or the provision of conditions for personal hygiene:
1. assistance in the operation of personal hygiene,
2. help in basic hair and nail care,
3. assistance in the use of toilets,
(c) provision of food or assistance in providing food:
1. provision of food for a reasonable period of service and adequate age, principles of rational nutrition and dietary eating needs;
2. aid in the preparation of food for a reasonable period of service,
(d) provision of accommodation, if it is a residence form of service:
1. accommodation,
2. cleaning, washing and minor repairs of bed and personal linen and dressing, ironing,
