THE LAW
of 16 November 1990
on metrology
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
GENERAL PROVISIONS
The purpose of the Act is to regulate the rights and obligations of natural persons who are entrepreneurs and legal persons (hereinafter referred to as "entities') and public authorities, to the extent necessary to ensure the consistency and accuracy of measuring instruments and measurements.
(1) The bodies and authorities of the State shall use the basic measuring units referred to in paragraph 2, their labelling, multiples and parts provided for in the Decree, and other units, their labelling, definitions, multiples and parts provided for in the Decree. In international contact, measurement units corresponding to international commercial practices may be used.
(2) The basic metering units (7) are:
(a) time unit - second (s),
(b) unit of length - meter (m),
(c) unit of mass - kilogram (kg),
(d) electric current unit - amperage (A),
(e) thermodynamic temperature unit - kelvin (K),
(f) the substance quantity unit - mol (mol),
(g) unit of luminous intensity - candela (cd).
(3) Basic metering units (7) are defined as follows:
(a) the second is defined by the determination of a fixed numerical value of the frequency of the latter, the transition between two levels of the very fine structure of the base state of the caesium 133, situated in a resting state equal to 9 192 631 770, expressed in Hz, which is equal to negative 1;
(b) the meter is defined by the fixed numerical value of the light speed in vacuum c, which is equal to 299 792 458, if expressed in m / s unit, where the second is defined by the latter;
(c) the kilogram is defined by determining the fixed numerical value of Planck's constant h, which is equal to 6,626 070 15 × 10-34, if expressed in J unit s, which is equal to kg m2 s-1, where the meters and seconds are defined by means of c and the latter;
(d) the amperage is defined by the fixed numerical value of the elementary charge e, which is equal to 1,602 176 634 × 10-19, if expressed in unit C, which is equal to A s, where the second is defined by means of the latter;
(e) kelvin is defined by the fixed numerical value of the Boltzmann constant k, which is equal to 1,380 649 × 10-23, if expressed in J K-1 unit, which is equal to kg m2 s-2 K-1, where the kilogram, meter and second are defined by h, c and hh;
(f) one mole contains exactly 6,022 140 76 × 1023 elementary entities; This number is the fixed numerical value of the Avogadro constant (NA), if expressed in mol-1 unit, and is called the Avogadro number; The mass (n) of the system is the number of specified elementary entities; An elementary entity may be an atom, molecule, ion, electron, any other particle or specified particle grouping;
(g) the candela is defined by the fixed numerical value of the light efficiency of monochromatic radiation at a frequency of 540 × 1012 Hz (Kcd), which is equal to 683 when expressed in lm W-1 unit, which is equal to cd sr W-1 or cd sr kg-1 m-2 s3, where the kilogram, meter and second are defined by h, c and 002.
Measuring instruments
(1) The measuring instruments are used to determine the value of the measured variable. Together with the necessary auxiliary measuring devices, for the purposes of this Act, the following shall be subdivided into:
(a) ethalons;
(b) work meters established (hereinafter referred to as "fixed meters");
(c) work meters not specified (hereinafter referred to as "work meters");
(d) certified reference materials and other reference materials, provided that they are intended to function as an etalon or as a fixed or work gauge.
(2) Etalon of a measuring unit or scale of a particular variable is a measuring instrument used for the implementation and storage of that unit or scale and for its transmission to meters of lower accuracy. Etalon storage means all operations necessary to maintain the metrological characteristics of the etalon within the specified limits.
(3) The measured gauges are those laid down by the Ministry of Industry and Trade (hereinafter referred to as "the Ministry") by a decree on compulsory verification taking into account their importance
(a) in contractual relations, such as when selling, hiring or donating a case, when providing services or when determining the amount of compensation or other property damage,
(b) for the determination of penalties, charges, tariffs and taxes;
(c) health protection,
(d) for environmental protection;
(e) occupational safety; or
(f) in the protection of other public interests protected by specific legislation.
(4) Working meters are meters that are not an etalon or a specified meter.
(5) Certified reference materials and other reference materials are materials or substances of a well-defined composition or properties, used in particular for the verification or calibration of instruments, the evaluation of measurement methods and the quantitative determination of the properties of materials.
(6) In doubt, the Office for Technical Standardisation, Metrology and State Testing (hereinafter "the Office ') shall determine the classification of the measuring instrument in one of those categories of measuring instruments, in the case of measuring instruments intended or used to measure ionising radiation and radioactive substances, in agreement with the State Office for Nuclear Safety.
The Authority may, at the request of the user of a specified gauge, exempt a specified specific designation gauge from the type-approval and verification requirement for a specified period.
Continuity of measuring instruments
(1) For the purposes of this Act, the linkage of measuring instruments means the inclusion of those meters in an uninterrupted sequence of the transfer of the value of the variable starting with the highest metrological quality standard for the purpose.
(2) State etalons have the highest metrological quality in the state for the relevant field of measurement. They shall be approved by the Office, which shall also determine the way in which they are produced, stored and used. The State which provides this activity under this Act is responsible for the creation, development and maintenance of state etalons. State etalons are kept by the Czech Metrology Institute or by the competent bodies appointed by the Office for this activity. The Czech Metrology Institute coordinates the construction and development of state etalons and their preservation. State etlons are mainly linked to international etlons preserved under international agreements or to state etlons of other states with an adequate metrological level.
(3) The provisions of paragraph 2 shall apply mutatis mutandis to other highest metrological quality ethons in the State in the field of measurement, where no national etalon is approved.
(4) A protection zone may be established in the vicinity of their storage in accordance with specific regulations for the protection of state etalones. 1)
(5) The main ethalons form the basis of the connection of measuring instruments between the subjects and are subject to mandatory calibration. Calibration of main etalons is carried out at the request of the user by the Czech Metrology Institute or accredited calibration laboratories and foreign bodies that guarantee a comparable metrological level. The timing of the subsequent calibration of the main etalon shall be determined by the user of this main etalon according to the metrological and technical characteristics, method and frequency of use of the main etalon. When the Czech Metrology Institute is asked to calibrate the main etalon in the measurement fields in which specified meters are declared, it is required to carry it out or it can provide this calibration abroad.
(6) The method of connecting the working meters shall be determined by the user of the measuring instruments. Calibration of work meters may be ensured by their users by means of their main etalons or by other domestic or foreign entities having the main etalons of the relevant quantities established in accordance with paragraph 5.
APPROVAL OF MEASUREMENT TYPE
Approval of types of gauges produced in the Czech Republic
(1) The measuring instruments subject to type-approval are defined by the Ministry by a decree before production. On request, other newly produced measuring instruments may also be approved.
(2) Approval of the type of meter is carried out by the Czech Metrology Institute. It shall determine whether the gauge will be able to perform the function for which it is intended. This requirement shall be deemed to be met if the gauge has the required metrological and technical characteristics laid down by a measure of a general nature. Measures of a general nature in addition to the required metrological and technical characteristics of a specified gauge shall also determine the type-approval tests. The type-approval procedure for measuring instruments shall be determined by the Ministry by means of a decree. The minimum number of samples of the gauge needed for the type-approval of the gauge provided free of charge by the manufacturer shall be determined by the Czech Metrology Institute.
(3) On the basis of technical tests and other findings, the Czech Metrology Institute shall issue a certificate that the gauge is approved as a type and shall assign a type approval mark to be placed on the gauge by the manufacturer if the Ministry so provides. The requirements of the certificate of approval of a measuring instrument and the graphic form of the approval mark shall be laid down in the Decree. The validity of the measuring instrument type-approval certificate shall expire 10 years after the date of issue. At the request of the manufacturer or importer, the Czech Metrology Institute may extend this period for a further 10 years; the number of meters that can be produced according to the approved type is not limited.
(4) Where the cost-effectiveness of the approval or its technical feasibility would not be proportionate to the importance of the type of measuring instrument in question, the Czech Metrology Institute may inform the manufacturer that this type of approval is not subject to.
(5) The validity of the type-approval certificate shall be suspended if the characteristics relevant for its approval have been affected by changing the design of the measuring instrument, the material used or the technology of its manufacture. The manufacturer of a measuring instrument of an approved type must notify the Czech Metrology Institute in advance of these changes. The Czech Metrology Institute shall then decide whether a new type approval is necessary or whether the original type approval remains valid. The Czech Metrology Institute may suspend the validity of the certificate of approval of a measuring instrument or cancel it itself if the measuring instruments produced do not conform to the approved type.
(6) The Czech Metrology Institute repeals the type-approval certificate if the gauge corresponding to the type approved shows a general defect in service which makes the gauge inappropriate for the intended use.
(7) Non-approved measuring instruments may not be put into circulation if this type is to be approved.
(8) The Czech Metrology Institute is entitled to check with the manufacturer whether the gauges are manufactured according to approved types.
(9) The Czech Metrology Institute may provide for restrictions in the type approval certificate to the extent laid down by the Ministry by the Decree.
(10) The type-approval shall not be subject to measuring instruments already in use and newly categorised as specified measuring instruments.
Approval of types of imported meters
(1) Newly imported types of fixed meters are subject to mandatory type-approval. Types of new imported meters other than reference materials may be approved under this Act upon request. Paragraph 6 shall apply mutatis mutandis to the approval of imported meters unless otherwise specified.
(2) The application for the type-approval of an imported measuring instrument is submitted to the Czech Metrology Institute by the importer (hereinafter referred to as "importer"), unless the type has already been approved at the request of a foreign manufacturer before the importation. If it is not possible or economical to submit samples, the importer shall be obliged to allow the Czech Metrology Institute to establish the conditions applicable to the type-approval of the gauge in another way sufficient for the purpose of type-approval.
(3) Where a measuring instrument has been manufactured and put into circulation in one of the Member States of the European Union or the European Economic Area or in a State with which an international recognition agreement is negotiated which the Czech Republic is bound, in accordance with the relevant provisions of that State, and the Czech Republic is subject to a type-approval requirement, the results of the metrological findings made in that State shall be recognised if they guarantee the metrological level required by the legislation in the Czech Republic and if these results are available to the Czech Metrology Institute.
(4) The gauges referred to in paragraph 3 shall be considered as measuring instruments the type of which has been approved under this Law.
Certification of reference materials
(1) Certified reference materials are materials the composition or properties of which have been certified by the Czech Metrology Institute or by an authorised metrology centre or have been certified by an accredited manufacturer of certified reference material.
(2) By certification of reference material, the value of one or more properties of the material or substance is confirmed by a process ensuring continuity to the correct implementation of the unit, expressing the value of the property specified in the certificate. The requirements of the certificate shall be laid down by the Ministry by decree.
(3) The certification of the reference material shall be issued with a certificate indicating one or more values of the characteristics and their uncertainties and confirming that the specified procedures for validating the characteristics and continuity have been followed.
(4) Certified reference materials shall be used for the verification of specified gauges or calibration of major etalones. Where certified reference materials cannot be used for technical reasons, other reference materials may be used.
(5) The Ministry provides by decree for a more detailed procedure for the preparation and certification of reference material.
(6) Manufacturers or importers who put into circulation certified reference materials and other reference materials shall be required to include in the documentation their metrological characteristics.
VERIFICATION AND CALIBRATION OF MEASUREMENT
Verification and calibration
(1) The verification of the specified gauge shall confirm that the specified gauge has the required metrological characteristics. This requirement shall be deemed to be met if the gauge has the required metrological characteristics laid down by a general measure. Measures of a general nature, in addition to the required metrological characteristics of a specified gauge, shall also be determined by the tests for its verification. The procedure for verifying specified meters shall be determined by the Ministry by a decree.
(2) The verified determined gauge shall provide the Czech Metrology Institute or Authorised Metrology Centre with an official mark or issue a certificate of verification or use both of these methods. The graphical form of the official mark and the particulars of the certificate shall be determined by the Ministry by a decree.
(3) The manufacturer's conformity marking and marking shall also be considered as the official mark of the initial verification under this Act, placed on a designated measuring instrument which has been placed on the market under the special legislature5).
(4) Damage or modification of the official marks in force shall be prohibited.
(5) When calibration of the working meter, its metrological characteristics are generally compared to the etalon; If not available, certified or other reference material may be used provided that the principles of measuring continuity are respected.
(6) Where a measuring instrument has been manufactured and put into circulation in one of the Member States of the European Union or the European Economic Area or in a State with which an international recognition agreement is negotiated which the Czech Republic is bound, in accordance with the relevant provisions of that State, and where a requirement for initial verification is made in the Czech Republic, the results of the metrological findings made in that State shall be recognised if they guarantee the metrological level required by the legislation in the Czech Republic and if such results are available to the Czech Metrology Institute.
(7) The gauges referred to in paragraph 6 are considered as measuring instruments for which initial verification has been ensured under this law.
(8) For selected types of specified meters, the validity of the verification is extended based on the positive result of the statistical selection test. The Ministry shall determine by decree the types of measuring instruments whose validity of the verification is extended on the basis of the positive result of the statistical selection test and the period by which the validity of the verification is extended for each of the selected types of measuring instruments.
(9) Statistical selection tests shall be carried out for the purpose of extending the validity of the verification by the Czech Metrology Institute according to general measures which determine the procedures and conditions of the tests and the criteria of their positive result for each selected type of measuring instrument. The application for a statistical selection test may be submitted not earlier than 2 years and not later than 1 year before the expiry of the previous verification of the specified gauge.
(10) The applicant for the renewal of the verification shall be obliged to inform the persons concerned by the measurement, within 3 months of the date of issue of the renewal report.
Cash-packed goods and bottles of a kind used as measuring containers for prepackaged goods
(1) For the purposes of this Act, cash-packed goods means a combination of the product and packaging into which the product is cash-packed. The product is packaged in cash if it is placed in any kind of packaging without the buyer being present, the quantity of the product contained in the packaging, expressed as volume or weight, having a pre-determined value which cannot be changed without opening or apparent breaching the packaging.
(2) By decree, the Ministry may determine the nominal volumes or weights of pre-packaged goods which may only be marketed in such nominal volumes or masses.
(3) Packages of pre-packaged goods are entitled to place on the market goods marked "e" if:
(a) they have a system in place to check the accuracy of the quantities, ensuring compliance with the requirements laid down in the Decree, including evidence of frequency and measurement results, have notified the Czech Metrology Institute in writing of the placing on the market of pre-packaged goods marked with the symbol "e" and at the same time have forwarded to the Czech Metrology Institute documentation containing production control procedures for the quantity of goods in the package,
(b) the tolerances for the contents of the pre-packaged goods laid down in the Order are complied with;
(c) the particulars provided for in the Order appear on the packages of cash packaged.
(4) Importers shall be entitled to place pre-packaged goods marked "e" on the market provided that they have shown to the Czech Metrology Institute that the foreign packing centre complies with the requirements set out in paragraph 3.
(5) The metrological inspection of pre-packaged goods marked "e" to determine whether the conditions laid down in paragraph 3 are met is carried out by the Czech Metrology Institute; where the conditions are met, issue a certificate the formalities of which are laid down by the Ministry by means of a decree, issue a protocol confirming the validity of the certificate at the time of repeated checks.
(6) Manufacturers and importers of bottles used as graduated packaging for pre-packaged goods ("bottles") are entitled to place on the market bottles bearing the symbol "3" if:
(a) have a certificate of metrological control of bottles issued by the Czech Metrology Institute, except in the cases provided for in Section 12 (1); the methods and methods of metrological control of bottles and the formalities for certificates of metrological control of bottles shall be laid down by the Ministry by decree;
(b) tolerances in the volume of bottles are respected;
(c) indicate on the bottles the identification mark provided for by the Decree.
(7) Metrological inspection of bottles marked "3" to determine whether the conditions laid down in paragraph 6 are met is carried out by the Czech Metrology Institute.
(8) The Czech Metrology Institute is entitled to take samples for substitution from packers or importers of pre-packaged goods marked with the symbol "e" and from manufacturers or importers of bottles marked with the symbol "3" for metrological control. For the samples taken, the Czech Metrology Institute will provide compensation at the level of the selling price. The refund shall not be granted if the packer, producer or importer surrenders it. No refund entitlement shall be granted if the pre-packaged goods bearing the symbol "e 'or the bottles bearing the symbol" 3' do not comply with the requirements laid down in the Order.
(9) The distributor shall act in such a way as to prevent the distribution of prepackaged goods or bottles marked with the symbol "3 'which do not comply with the requirements laid down in this Act and the implementing legislation concerning the nominal volumes and weights and the mandatory particulars given on packages of prepackaged goods marked with the symbol" e' and on bottles marked with the symbol "3 '.
Placing of meters into circulation
(1) The manufacturer of the measuring instruments shall be obliged to ensure verification of the measuring instruments before they are put into circulation and after they have been repaired. The manufacturer of the certified reference material shall be obliged to submit the reference material for certification before it is put into circulation unless it is an accredited manufacturer.
(2) Initial verification of imported fixed meters and certification of imported reference materials intended as certified reference materials is provided by their user, unless already provided by an importer or a foreign manufacturer.
Use of gauges
(1) Specified measuring instruments may be used for that purpose only for the duration of the verification carried out. However, these gauges shall no longer be subject to new verification if they have clearly ceased to be used for the purposes for which they were declared as specified.
(2) The Czech Metrology Institute is entitled to detect for users compliance with the obligations to submit specified meters for verification. If the measuring instrument is found to be in use without valid verification, the measuring instrument shall seal or cancel the official mark.
(3) A designated group of measuring instruments may be set up for mandatory verification by other legislation.
(4) The Czech Metrology Institute, for the purpose of verifying a specified measuring instrument whose type-approval certificate has expired, may permit its design change if this design change replaces a defective or worn part of a different part from the original part, but functionally identical to it, and does not affect
(a) the function of the designated gauge;
(b) the technical characteristics of the measured gauge applicable to the type approval; and
(c) the metrological characteristics of the measured gauge applicable to the type approval.
(5) The uniformity and accuracy of working meters is ensured by their user to the extent necessary by calibration, unless another method or method is more appropriate for the measuring instrument.
(1) At the request of the person who may be affected by his improper measurement, the user of the specified measuring instrument is required to request a check of the specified measuring instrument.
(2) The Czech Metrology Institute and bodies authorised under this Act to verify the type of measuring instruments specified and to issue a certificate annexed to the test report. The requirements of the certificate of examination and those of the test report shall be laid down by the Ministry by decree.
(3) The measured gauge shall be considered satisfactory if it has the metrological characteristics laid down in a general measure when tested. Measures of a general nature, in addition to the required metrological characteristics of a specified gauge, shall also determine the examination tests if they are different from the verification tests.
(4) The costs of checking a specified meter shall be borne by:
(a) the applicant for the examination where the specified gauge is found to be satisfactory at the time of the examination;
(b) the user of the specified gauge, where the specified gauge is found to be non-compliant at the time of the check.
RELATIONS TO THE FOREIGN
(1) A certificate in the form of a document or a foreign mark of verification, approval or certification of a measuring instrument, its type, or reference material issued by an international organisation or authority of another State, or a foreign document of metrological control of pre-packaged goods, or bottles, shall be recognised as evidence of verification or approval or metrological control of pre-packaged goods, or, where applicable, of a bottle carried out under this Act, if this results from an international contract which the Czech Republic is bound by.
(2) The provisions of this Act shall apply only if the international treaty to which the Czech Republic is bound does not provide otherwise. The Ministry sets out by decree the principle of ensuring the uniformity and correctness of measuring instruments and measurements resulting from international agreements by which the Czech Republic is bound.
TASKS OF STATE GOVERNANCE AUTHORITIES AND BODIES
Office for Technical Standardisation, Metrology and State Testing
(1) In the field of metrology the Office
(a) establish a programme of state metrology and ensure its implementation;
(b) representing the Czech Republic in international metrology bodies and organisations, ensuring the tasks arising from this membership and coordinating the participation of the institutions and organisations in the performance of these tasks as well as those arising from international treaties;
(c) authorise bodies to perform the verification tasks of specified meters, the certification of reference materials and official measurements, the authorisation of authorised entities to retain state etalones and control the fulfilment of the prescribed obligations for all such bodies; the authorisation may be withdrawn when the deficiencies in the performance of the obligations laid down are identified;
(d) carry out checks on the activities of the Czech Metrology Institute;
(e) monitor compliance with the obligations laid down by this law; when carrying out the check, it shall comply with a specific legislation; (2a)
(f) provide metrological expertise, issue certificates of competence for metrological staff and lay down the conditions for ensuring a uniform procedure for bodies responsible for the conservation of state etalones, authorised metrology centres and bodies responsible for the performance of official measurements;
(g) publish in the Bulletin of the Office for Technical Standardisation, Metrology and State Testing in particular bodies responsible for the preservation of state etalons, authorised metrological centres, bodies authorised for official measurements, state etalons, lists of certified reference materials and approved types of measuring instruments;
(h) carry out tasks in accordance with specific rules.
(2) The Office shall communicate to the authorities of the European Communities or to the competent authorities of the States with which international agreements are concluded, to the extent resulting from such agreements, information on the bodies responsible for type-approval and verification of measuring instruments.
Czech Metrology Institute
(1) Czech Metrology Institute
(a) carry out metrological research and conservation of state etalons, including the transfer of measurement unit values to meters of lower accuracy;
(b) carry out certification of reference materials;
(c) approve the types of measuring instruments and verify the measuring instruments specified;
(d) register the bodies which repair and, where appropriate, carry out the installation of the measured instruments;
(e) carry out state metrological surveillance at authorised metrology centres, at bodies authorised to carry out official measurements, at bodies producing or repairing specified measuring instruments, and where appropriate, at the use of measuring instruments;
(f) carry out research and development in the field of electronic communications and participate in international cooperation in this field;
(g) carry out metrological checks on pre-packaged goods marked "e" and bottles marked "3,"
(h) assess conformity and carry out product testing to the extent granted by authorisation or accreditation in accordance with legislation governing the field of technical requirements for products 2b);
(i) assess the technical competence of measuring equipment and technical equipment for electronic communications use;
j) issues measures of a general nature pursuant to § 6 (2), § 9 (1), § 9 (9) and § 11a (3);
k) provides expertise in metrology;
(l) carry out the statistical selection tests referred to in Article 9 (9),
(m) carry out checks on specified meters in accordance with § 11a.
(2) The Czech Metrology Institute may authorise:
(a) a design change of a specified gauge under the conditions laid down in Article 11 (4);
(b) the short-term use of the specified measuring instrument between the end of the repair or installation and the verification with a limitation of that period.
(3) The Czech Metrology Institute notifies the authorities of the European Communities or the competent authorities of the States with which international agreements are concluded, to the extent resulting from these agreements, information on the issue, modification, revocation or restriction of certificates relating to the approval of measuring instruments.
Authorised metrology centres
(1) Authorised metrology centres are bodies authorised by the Authority, upon request, to verify specified measuring instruments or the certification of reference materials after examination of the level of their metrological and technical equipment by the Czech Metrological Institute and after examination of the qualifications of responsible staff, supported by a certificate of competence issued by an accredited person2b) or a certificate of competence issued by the Office. For the purposes of authorisation, the findings of accreditation may be used. The requirements of the authorisation application and the conditions for authorisation shall be laid down by the Ministry by decree. There is no legal claim for authorisation. Where an authorised body fails to comply with the obligations laid down by law or the conditions laid down in the authorisation decision, or if it so requests, the Authority shall suspend, amend or revoke the authorisation decision.
(2) The Office shall assign or withdraw an official mark for the verification of the measuring instrument to an authorised metrology centre. In decisions and certificates, the authorised metrology centre shall state its name and attach to the signature the stamp of the authorised metrology centre.
(3) Entities other than those authorised to do so shall not be entitled to use the designation of the authorised metrology centre, even as part of their name.
Authorization of employees of the Czech Metrology Institute
Staff of the Czech Metrology Institute are entitled to enter the premises and premises of controlled bodies in the performance of the tasks provided for by this law, to require the necessary information, documents and data as well as to ensure the conditions necessary for the performance of these functions. In doing so, they are obliged to maintain national, economic and professional secrecy, to comply with the specific legislation applicable to entry into individual premises. The staff of the Czech Metrology Institute shall be recorded with a special card or, where appropriate, a mandate issued by the Office. Controlled entities shall be obliged to enable them to carry out these tasks and to provide them with the necessary synergies.
Tasks of the bodies
Entities
(a) keep records of the measuring instruments used subject to reverification with the date of the last verification and submit those measuring instruments for verification;
(b) ensure consistency and accuracy of measuring instruments and measurements and are required to establish metrological conditions for the protection of workers' health, safety of work and the environment, appropriate to their activities.
Registration of entities
(1) Entities intending to repair or install specified meters are obliged to submit a registration application to the Czech Metrology Institute. If the applicant has the necessary preconditions for the proper performance of his activity, further detailed by the Order, the Czech Metrology Institute shall register and issue a certificate thereof. The requirements of the registration application and the registration certificate shall be laid down by the Ministry by decree. The Czech Metrology Institute shall cancel registration if the reasons for which it was carried out have ceased to exist. The subject is obliged to report to the Czech Metrology Institute a permanent cessation of registered activity.
(2) The registration referred to in paragraph 1 also arises in the vain expiry of the period and in the manner provided for in paragraphs 28 to 30 of the Freedom to Movement of Services Act.
Official measurements
The Authority may, in cases of special consideration, authorise the body, at its request, to carry out official measurements in a specified measurement field after verifying the level of its technical and metrological equipment. The conditions of performance are the use of meters for which metrological continuity is ensured, the certificate of competence of the official meter issued by an accredited person2b) or the certificate of competence issued by the Office and supervision by the Czech Metrology Institute. Official measurement means metrological performance, the result of which is issued by an authorised body by a document having the character of an authentic instrument. The Ministry shall determine its formalities by decree. Where an authorised body fails to fulfil the obligations laid down by law or the conditions laid down in the authorisation decision, the Authority shall suspend, amend or revoke the authorisation decision. The requirements of the authorisation application and the conditions for authorisation shall be laid down by the Ministry by decree.
