Government Regulation on the conditions for providing special prices for voice communication and Internet access services to persons with special social needs

of 13 December 2021
on the conditions governing the provision of special prices for voice communications and Internet access services to persons with special social needs
The Government orders pursuant to § 38 (8) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 261 / 2007 Coll. and Act No. 374 / 2021 Coll.:
§ 1
Documents proving the status of a person with special social needs
(1) A low-income person to demonstrate compliance under Section 38 (4) of the Electronic Communications Act shall submit to the universal service provider a confirmation that he is receiving a benefit of state social assistance with a living component or a member of the household of that beneficiary under the State Social Assistance Benefit Act and shall provide an identity document for inspection.
(2) A person with disabilities to demonstrate compliance under Section 38 (4) of the Electronic Communications Act shall submit to the universal service provider an identity document for inspection and, in the case of:
(a) under Article 43 (4) (a) of the Electronic Communications Act, the ZTP card with the symbol of the designation of a person with complete or practical deafness under Article 34 (3) of the Act on the provision of benefits to disabled persons;
(b) according to Article 43 (4) (b) of the Electronic Communications Act, the ZTP / P licence pursuant to Article 34 (4) of the Act on the provision of benefits to disabled persons;
(c) pursuant to Article 43 (4) (c) of the Electronic Communications Act, a certificate issued by the Labour Office of the Czech Republic that it is entitled to a care allowance at the level of dependency II, III or IV; if it is a minor, the consumer in whose personal care the minor is, shall provide proof that he is the parent of that person, or the decision of the competent authority to give custody of the child in the care of parents pursuant to Article 7 (10) of the State Social Support Act;
(d) in accordance with Article 43 (4) (d) of the Electronic Communications Act, the documents referred to in (a) or (b) issued to a minor who is raised or personally cared for by the consumer; the consumer in whose personal care the minor is present evidence that he is the parent of that person, or the decision of the competent authority to give custody of the child replacing the care of the parent pursuant to Article 7 (10) of the State Social Support Act.
(3) A person with a disability who is not a national citizen of the Czech Republic and does not hold the documents referred to in paragraph 2 shall present similar documents issued by the State of which he is a citizen or the State of his last residence, together with the translation of such documents into the Czech language, and shall also submit an identity document for inspection.
(4) The documents referred to in paragraph 2 (a) and (b) may be replaced by another authentic instrument certifying the issue of this document, its particulars and its period of validity, if indicated therein.
(5) The universal service provider shall be entitled to obtain a copy or extract from the documents referred to in paragraphs 1 to 4. The person who has provided these documents shall confirm the accuracy of the information contained in such an extract by signature.
§ 2
Amount of the price advantage
The amount of the price advantage for a person with special social needs shall be such that the loss of the universal service provider shall amount to a maximum of CZK 200, including value added tax per calendar month.
§ 3
Forms of the list of persons maintained by the universal service provider
(1) The universal service provider shall keep a list of persons to whom the special price or the special tariff pursuant to Article 43 (2) (b) of the Electronic Communications Act (hereinafter referred to as the "special tariff") has been granted and provided, containing:
(a) the name and, where applicable, the name, surname, date of birth, address of the place of permanent residence and, if not a national citizen of the Czech Republic, the address of the place of residence of that person in the Czech Republic; If the consumer is subject to Article 43 (4) (d) of the Electronic Communications Act, the list shall include the name or, where appropriate, the names, surnames, date of birth and address of the place of residence of the minor whom he is raising or personally caring for;
(b) the telephone number or other identifier for which the special price or the special tariff has been admitted and provided;
(c) the date of commencement and the date of termination of the special price or special tariff;
(d) the period of validity of the document referred to in Article 1 (2), if indicated;
(e) the amount of the price advantage granted in each calendar month and per calendar year in total;
(f) the price plan; and
(g) information on whether it is a disabled person or a low-income person.
(2) The documents referred to in Article 1 are annexed to the list of persons kept by the universal service provider.
§ 3a
Forms of the list of persons kept by the Office
The list of persons to whom a special price or special tariff has been granted and provided by the Office pursuant to Section 38 (5) of the Electronic Communications Act contains:
(a) the name and, where applicable, the name, surname, date of birth and address of the place of permanent residence and, if not a national citizen of the Czech Republic, the address of the place of residence of that person in the Czech Republic,
(b) the telephone number or other identifier for which the special price or the special tariff has been granted and provided;
(c) the date on which the special price or special tariff is started;
(d) the date of termination of the special price or special tariff;
(e) information on whether it is a disabled person or a low-income person; and
(f) the name of the universal service provider.
§ 3b
Method of keeping the list by the Office and conditions of access to that list
(1) The Office shall keep a list of persons to whom a special price or special tariff has been awarded and provided in the form of a programme application. Access to the list shall be granted to universal service providers for the purpose of transmitting data to the extent specified in Section 3a.
(2) The Programme Application of the Office referred to in paragraph 1 shall be accessible on the basis of communication with the universal service provider's information system through an application programme interface (API) requiring authentication using a certificate issued by the Office to the universal service provider.
(3) A universal service provider providing a special price or a special tariff shall have access only to the data in the list which it has entered itself and to the information whether and to what time a special price or special tariff has been provided to the person it intends to provide or to the special tariff by another universal service provider.
§ 3c
Form, manner and time limits for the transmission of data to the list kept by the Office
(1) The universal service provider shall transmit the data referred to in Article 3a and their changes to the Office's programming application in accordance with Article 3b (2) at the latest on the day on which it commences the provision of a special price or special tariff to a person with special social needs or the day on which it becomes aware of the change.
(2) Information on the date of termination of the provision of the special price or special tariff shall be transmitted by the universal service provider to the programme application in the manner and in the form referred to in paragraph 1 at the latest on the date on which the provision of the special price or special tariff is terminated.
§ 3d
Storage times for lists of persons
(1) The universal service provider shall keep the data in the list of persons referred to in Article 3 for the duration of the provision of a special price or special tariff and for a period of 5 years from the end of the last settlement period for the application of a request for reimbursement of loss from the provision of special prices.
(2) The Office shall keep the data in the list of persons referred to in Article 3b for the duration of the provision of a special price or special tariff and for a period of 5 years from the end of the last settlement period for the application of a request for reimbursement of loss from the provision of special prices.
§ 4
Transitional provision
If a disabled person draws special prices under this Regulation from the same universal service provider who has provided him with special prices and who has demonstrated his claim under Government Regulation 109 / 2008 Coll., on the conditions for providing special prices for a publicly available telephone service, as effective before the date of entry into force of this Regulation, he no longer proves his claim under this Regulation.
§ 5
Repeal
They shall be deleted:
1. Government Decree No. 109 / 2008 Coll., on the conditions for providing special prices to the publicly available telephone service.
2. Government Decree No. 354 / 2012 Coll., amending Government Decree No. 109 / 2008 Coll., on the conditions for providing special prices to the publicly available telephone service.
3. Government Regulation No. 119 / 2014 Coll., amending Government Regulation No. 109 / 2008 Coll., on the conditions for providing special prices to the publicly available telephone service, as amended by Government Regulation No. 354 / 2012 Coll.
§ 6
Efficacy
This Regulation shall take effect on 1 January 2022.
