Regulation on the approval and publication of railway tariffs

Order of the Minister for Transport
of 23 June 1951
on the approval and publication of railway tariffs.
The Minister of Transport hereby orders pursuant to § 25 (3) of Act No. 97 / 1950 Coll., on Railways ("the Act '):
§ 1.
Approval.
(1) Routes operated by Czechoslovak State Railways, a national enterprise, are approved by the Ministry of Transport, and other Routes are approved by the Public Regional National Committee.
(2) In the case of tariffs which are also subject to decisions under the pricing rules, the relevant procedure shall only be carried out under those rules. the decision shall be given, unless otherwise provided for in the relevant regulations, by the Ministry of Transport, in agreement with the Ministry of the Interior, if it is on the fares of municipal enterprises. This decision under the pricing rules is also approved under the law.
(3) Approval is not necessary to correct the printing errors in the tariff.
§ 2.
Publishing.
(1) Tariffs must be published. There is no need to publish tariffs for the purposes of internal rail service, public administration, social, educational or educational purposes.
(2) The tariff, its amendments and cancellations are published:
(a) a notice in the published tariff notice; if the tariff or its amendments have been issued as a separate book, a notebook or a sheet, it is sufficient to notify the issue and surrender of such tariff or amendments to the schedule;
(b) a notice in the station or in the vehicle, if it is of local importance and this method of publication was permitted when the tariff was approved; such authorisation may be granted provided that the tariff is subsequently printed in the journal referred to in point (a).
(3) Corrections to printing errors shall be made to the public in accordance with the effectiveness of one of the methods referred to in paragraph 2.
(4) If the tariff changes are unclear, the Ministry of Transport or the Regional National Committee may require the railway undertaking to re-publish the tariff.
§ 3.
The efficiency of the tariff.
(1) The introduction and cancellation of the tariff, as well as any changes thereto, which entail an increase in fare, freight or other burden for transport users shall take effect at the earliest on the 15th day of the national rail and at the earliest on the 8th day of the publication of the local rail; The Ministry of Transport or the Regional National Committee may reduce these deadlines to up to 3 days.
(2) Changes to a tariff which do not entail an increase in fare, freight or other burden for transport users shall take effect at the earliest on the date of publication.
(3) For corrections to print errors, the corrected text has been published correctly from the outset.
§ 4.
International transport.
(1) The provisions of international agreements apply to the approval and publication of international transport tariffs.
(2) In the absence of such contracts or provisions, the provisions of this Regulation shall apply; However, the Ministry of Transport may allow derogations from the provisions of this Regulation.
§ 5.
The ratio to the timetable.
The provisions of this Regulation are without prejudice to the provisions of the Transport Regulations (Section 24 of the Act).
§ 6.
Obligations of the railway undertakings.
(1) A railway undertaking, before submitting a proposal for a tariff of greater economic importance to the Ministry of Transport or to the Regional National Committee, is obliged to hear representatives of economic operators and other transport users concerned by the tariff adjustment. The railway undertaking shall submit a draft tariff so that the time limit set for the publication and the start of effectiveness can be maintained.
(2) The railway undertaking shall be obliged to surrender free of charge to the Ministry of Transport and, if the relevant regional national committee is approved, two copies of the tariff submitted for sale.
§ 7.
Repeal clause.
All provisions contrary to this Regulation shall be repealed.
§ 8.
Efficiency.
This Regulation shall enter into force on the day of its publication.
