Decret of the President of the Republic
of 11 August 1945
on measures in the field of film.
In order to ensure and maintain professionally all means and equipment for the production, distribution and public projection of light cinematographic films and to be fully used for the benefit of the people and the state,
in the field of the production, dissemination and public projection of such films, employment is properly secured, maintained and further continuously and planned,
that such cultural and economic work is permanently deprived of all disruptive foreign and any harmful non-professional and in the interests of the people and the state of unreliable influence and factors;
and to allow for proper preparation and timely implementation of permanent arrangements in the field of production, expansion and public projection of illuminated cinematographic films according to the needs and interests of the people and the state;
on the proposal of the Government and in agreement with the Slovak National Council,
(1) Existing business operators referred to in § 1 (1) and (2) are required to submit to the Ministry of Information all the items of operation, means of operation, stocks of raw materials and other material, as well as all the operating facilities of the undertakings, including those owned, leased or used anywhere in the Czech and Moravian-Silesian State or in the customs territory of which the Ministry enters into the rights and obligations of existing operators (§ 2, paragraph 3).
(2) All assets of the undertakings referred to in Paragraph 1 (1) and (2) shall be transferred to the State which may transfer them in whole or in part to the legal entities set up by it.
(3) The property taken over under paragraph 1 shall be compensated under the directives issued by the Minister of Information in agreement with the Ministers of Finance, Industry, Internal Trade and the Supreme Bureau of Price. The Federal and public-law corporations will be compensated for the general price. The Czechoslovak State is liable for the liabilities of the undertakings assumed under this decree up to the value of the assets taken over.
(4) The refund shall not be granted for the property of persons who are considered to be statewide unreliable under the provisions of the Decree of 19 May 1945 of the President of the Republic, No 5 Coll., on the nullity of certain property-law acts of the time of non-freedom and on the national administration of the property values of Germans, Hungarians, traitors and collaborators, and of certain organisations and institutes, or persons convicted under the provisions of the Decree of the President of the Republic of 19 June 1945, No 16 Coll., on the punishment of Nazi criminals, traitors and their agents, and on extraordinary people's courts, where the judgment declared forfeiture of property. In doubt, the Ministry of Information will decide in agreement with the Ministry of Interior.
(1) The Minister of Information will use the proceeds obtained from the business under this decree mainly for the operation, construction and further development of Czechoslovak film industry in all its sectors. In matters of economic and financial importance, the Minister of Information shall decide in agreement with the Minister of Finance.
This Decision shall take effect on the day of its publication; It shall be implemented by the Minister of Information in agreement with the Ministers involved.
