DECLARATION
Ministry of Transport and Communications
of 18 December 2001
amending Decree of the Ministry of Transport and Communications No. 28 / 2001 Coll., laying down the postal conditions of the basic services and the essential quality requirements in their provision by the holder of the postal licence (Decree on the basic services of the holder of the postal licence)
According to § 41 (2) of Act No. 29 / 2000 Coll., on Postal Services and on the amendment of certain laws (Act on Postal Services), the Ministry of Transport and Communications provides for the implementation of § 6 (6) and § 22 (4) of this Act:
Čl. I
Decree No. 28 / 2001 Coll., laying down the postal conditions of the basic services and the essential quality requirements in their provision by the holder of the postal licence (Decree on the basic services of the holder of the postal licence), is amended as follows:
1. in Paragraph 3 (2), including footnote (1a):
"(2) The contents of the postal consignment may not be:
(a) explosives;
(b) radioactive substances;
(c) narcotic and psychotropic substances;
(d) toxic and corrosive substances;
(e) contagious biological substances;
(f) solid carbon dioxide;
(g) pressure vessels, compressed or liquefied gases and gases in solutions;
(h) oxidising, flammable and other chemicals and preparations classified as hazardous under specific legislation, 1a)
(i) live vertebrate animals.
(1a) Article 2 of Act No. 157 / 1998 Coll., on Chemicals and Chemicals and on the amendment of certain other laws, as amended.
2. in Article 3 (3), point (a) shall be deleted;
Points (b) to (e) shall be renumbered as points (a) to (d).
3. In Article 5 (2) (d), the word "supply 'is replaced by" address'.
4. in Article 5 (2) (e), the word "delivery" is replaced by the word "address."
5. In the second and third sentences of Paragraph 24 (4), the amount "CZK 1501" is replaced by "CZK 1 489."
6. In the second and third sentences of Section 24 (5), the amount "7 502 CZK 'is replaced by" 7 443 CZK'.
Article 24 (7) reads as follows:
"(7) The amount referred to in paragraph 6 shall be the sum of a fixed amount of CZK 1 985 and an amount of CZK 224 for each and every kilogram of the weight of the postal consignment."
8. In the second sentence of Article 24 (9), the words "at the time of submission 'shall be inserted after the words" have been negotiated'.
9. in Paragraph 36 (2) (a), the word 'largest' is replaced by 'decisive';
10. in Paragraph 37 (3) (a), the word 'largest' is replaced by 'decisive';
11. In Paragraph 46, the following sentence is added at the end of paragraph 3: "When this special envelope is used, the consignor may require that the certificate also states the hour and minute of delivery of the postal consignment; in such a case, it shall affix the subject matter of the service with the endorsement" The exact time of delivery. "';
12. In the first sentence of Paragraph 60 (12), the words "in the event of a requirement under Paragraph 46 (3), an hour and a minute," shall be inserted after the word "day."
13. In the first sentence of Paragraph 64 (10), the words "in the event of a requirement under Paragraph 46 (3), an hour and a minute," shall be inserted after the word "day."
14. in § 93 (2), the words "under § 91 (2) (c)" are replaced by the words "under § 92 (2) (c)";
15. The fifth Title, including the title, reads:

§ 96
Foreign Policy - Afghanistan
(1) The consignor shall, in accordance with Article 17 (3), add to the subject matter of the service:
(a) in the case of the main services referred to in § 20 (1) (a) to (d), (f) and (g): 2 customs declarations,
(b) in the case of the main service referred to in Article 20 (1) (i): 1 customs declaration.
(2) The consignor shall, pursuant to Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English.
(3) The main service provided for in Article 20 (1) (i) cannot be chosen if the contents of the postal consignment are liquid, porcelain or other fragile goods.
(4) The maximum permissible mass referred to in Paragraph 25 (2) shall be 20 kg.
(5) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 150 cm, sum of all three dimensions 300 cm.
(6) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 97
Foreign conditions - Albania
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor pursuant to Article 17 (3) shall complete the customs declarations, the customs sticker or the customs flag in Albanian, English or French.
(3) The maximum permissible mass referred to in Paragraph 25 (2) shall be 30 kg.
(4) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(5) The consignor may apply for an additional service in accordance with Paragraph 45 (1) (b).
(6) The consignor may, in accordance with Paragraph 36 (4), request special care when handling a postal consignment.
(7) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 98
Foreign conditions - Algeria
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, in accordance with Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in Arabic or French.
(3) The sender may choose the main service in accordance with Paragraph 20 (1) (h). The maximum allowed price according to § 24 (10) in this case is CZK 13991. According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price according to Paragraph 24 (10) in this case is CZK 80 377.
(5) The maximum permissible mass referred to in Article 25 (2) is 20 kg.
(6) The maximum permissible dimensions referred to in Article 26 (4) are:
(a) in the case referred to in Paragraph 27 (1): length 100 cm, sum of all three dimensions 300 cm,
(b) in the case referred to in Paragraph 27 (2): length 150 cm, sum of all three dimensions 300 cm.
(7) The consignor may apply for a measure under Paragraph 82 (2) in the case of the main services referred to in § 20 (1) (i) and (j).
§ 99
Foreign conditions - Andorra
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, pursuant to Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in French.
(3) The sender may choose the main service in accordance with Paragraph 20 (1) (h). The maximum allowed price according to § 24 paragraph 10 in such case is CZK 198 464. According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) In the case of the service referred to in Article 27 (2), the consignor shall provide the subject-matter of the service and the guide with the note "Livrable en gare de la Tour de Carol (Pyrenées-Orientales)."
(5) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price according to § 24 paragraph 10 in such case is CZK 198 464. According to Article 27 (2), the sender cannot apply for a reduced price service.
(6) The maximum permissible mass referred to in Paragraph 25 (2) shall be 20 kg.
(7) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 150 cm, sum of all three dimensions 300 cm.
(8) Paragraph 24 (6) does not apply; in the case of the main service referred to in Article 20 (1) (i), the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(9) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 100
Foreign conditions - Angola
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, in accordance with Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in French or Portuguese.
(3) The maximum permissible mass referred to in Article 25 (2) shall be 20 kg.
(4) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 150 cm, sum of all three dimensions 300 cm.
(5) Paragraph 24 (6) does not apply; in the case of the main service referred to in Article 20 (1) (i), the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(6) If the consignor applies for a supplementary service under § 45 (1) (a), he may also apply for a supplementary service under § 45 (1) (b).
(7) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 101
Foreign conditions - Anguilla
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, in accordance with Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English or French.
(3) The main service referred to in Article 20 (1) (i) may be chosen only if the postal consignment is to be delivered to the Valley according to its address.
(4) If the postal consignment is to be delivered to the Valley according to its address, the consignor may choose the main service in accordance with § 20 (1) (j). The maximum allowed price according to § 24 paragraph 10 in this case is CZK 15 281.
(5) In the case of the main service referred to in Article 20 (1) (j), the postal consignment shall not be transported to the country of destination in the fastest manner; Paragraph 27 (1) and (2) shall not apply.
(6) The maximum permissible mass referred to in Article 25 (2) shall be:
(a) in the case referred to in Article 27 (1): 20 kg,
(b) in the case referred to in Article 27 (2): 10 kg.
(7) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(8) The consignor may apply for a measure under Paragraph 82 (2) in the case of the main services under Section 20 (1) (i) and (j).
§ 102
Foreign conditions - Antigua and Barbuda
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, pursuant to Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English.
(3) The main service referred to in Article 20 (1) (i) may be chosen only if the postal consignment is to be delivered to All Saints, Antigua or Barbuda according to its address.
(4) The maximum permissible mass referred to in Paragraph 25 (2) shall be 20 kg.
(5) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(6) Paragraph 24 (6) does not apply; in the case of the main service referred to in Article 20 (1) (i), the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(7) A supplementary service under Paragraph 45 (1) (a) cannot be requested for the main service under Paragraph 20 (1) (i).
§ 103
Foreign conditions - Argentina
(1) The consignor shall, in accordance with Paragraph 17 (3), add 2 customs declarations to the subject matter of the service.
(2) The consignor shall, in accordance with Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in French or Spanish.
(3) The sender may choose the main service in accordance with Paragraph 20 (1) (h). The maximum allowed price according to § 24 paragraph 10 in such case is CZK 198 464. According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price according to § 24 paragraph 10 in such case is CZK 198 464.
(5) The maximum permissible mass referred to in Article 25 (2) is 20 kg.
(6) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(7) If the postal consignment contains the goods referred to in § 3 (4), the provisions of § 24 (4) to (6) shall not apply; in that case, the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(8) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 104
Foreign conditions - Armenia
(1) The consignor shall, in accordance with Article 17 (3), attach to the subject-matter of the service 3 customs declarations.
(2) The consignor shall, pursuant to Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English, French or Russian.
(3) The sender may choose the main service in accordance with Paragraph 20 (1) (h). The maximum allowed price according to § 24 paragraph 10 in this case is CZK 12.404. According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price referred to in Article 24 (10) shall be:
a) in the case referred to in § 27 (1): 49 616 CZK,
b) in the case of § 27 (2): 14 884 CZK.
(5) The maximum permissible mass referred to in Article 25 (2) is 20 kg.
(6) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(7) If the postal consignment contains the goods referred to in § 3 (4), the provisions of § 24 (4) to (6) and (9) shall not apply; in that case, the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(8) The consignor may apply for an additional service in accordance with Paragraph 45 (1) (b).
(9) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 105
Foreign conditions - Aruba
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, in accordance with Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English, Dutch or Spanish.
(3) If the postal consignment is to be delivered to Oranjestad according to its address, the consignor may choose the main service in accordance with Section 20 (1) (h). In such a case, the maximum price declared pursuant to Paragraph 24 (10) shall be:
(a) if the postal consignment has content according to § 21 (4): 19 846 CZK,
b) if the postal consignment has a different content: 38 154 CZK.
According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price according to § 24 (10) in this case is CZK 31,457.
(5) The maximum permissible mass referred to in Article 25 (2) is 30 kg.
(6) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 200 cm, sum of all three dimensions 300 cm.
(7) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 106
Foreign conditions - Australia
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, pursuant to Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English.
(3) The sender may choose the main service in accordance with Paragraph 20 (1) (h). The maximum allowed price according to § 24 (10) is CZK 124 040. According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price according to § 24 (10) is CZK 124 040.
(5) The maximum permissible mass referred to in Article 25 (2) is 20 kg.
(6) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(7) Paragraph 24 (6) does not apply; in the case of the main service referred to in Article 20 (1) (i), the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(8) If the postal consignment contains the goods referred to in § 3 (4), the provisions of § 24 (4) to (6) and (9) shall not apply; in that case, the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(9) If the consignor applies for a supplementary service under § 45 (1) (a), he may also apply for a supplementary service under § 45 (1) (b).
§ 107
Foreign conditions - Azerbaijan
(1) The consignor shall, in accordance with Paragraph 17 (3), add 2 customs declarations to the subject matter of the service.
(2) The consignor pursuant to Article 17 (3) shall complete the customs declarations, the customs sticker or the customs flag:
(a) in the case of the main services referred to in § 20 (1) (a) to (d) and (f) to (h): French or Russian,
(b) in the case of main services pursuant to § 20 (1) (i) and (j): English, Azerbaijan, French, Russian or Turkish.
(3) The sender may choose the main service in accordance with Paragraph 20 (1) (h). The maximum allowed price according to § 24 paragraph 10 in this case is CZK 12.404. According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price according to § 24 (10) in this case is CZK 49 616.
(5) The maximum permissible mass referred to in Article 25 (2) is 30 kg.
(6) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 150 cm, sum of all three dimensions 300 cm.
(7) The consignor may apply for an additional service in accordance with Paragraph 45 (1) (b).
(8) The consignor may apply for the measure provided for in Paragraph 82 (2).
§ 108
Foreign conditions - Bahamas
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, pursuant to Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English.
(3) The maximum permissible mass referred to in Article 25 (2) shall be 20 kg.
(4) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(5) Paragraph 24 (6) does not apply; in the case of the main service referred to in Article 20 (1) (i), the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(6) The consignor may apply for a measure under Paragraph 82 (2) in the case of the main services under Section 20 (1) (i).
§ 109
Foreign conditions - Bahrain
(1) The consignor shall, in accordance with Paragraph 17 (3), add 2 customs declarations to the subject matter of the service.
(2) The consignor shall, in accordance with Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English or Arabic.
(3) The maximum permissible mass referred to in Article 25 (2) shall be 20 kg.
(4) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(5) The consignor may apply for an additional service in accordance with Paragraph 45 (1) (b).
§ 110
Foreign conditions - Bangladesh
(1) The consignor shall, in accordance with Article 17 (3), attach a customs declaration to the subject matter of service 1.
(2) The consignor shall, in accordance with Article 17 (3), complete the customs declarations, the customs sticker or the customs flag in English or French.
(3) The sender may choose the main service in accordance with Paragraph 20 (1) (h); This shall not apply if the contents of the postal consignment of goods subject to customs procedure in the country of destination. The maximum allowed price according to Paragraph 24 (10) is CZK 64 798. According to Article 27 (2), the sender cannot apply for a reduced price service.
(4) The sender may choose the main service in accordance with Paragraph 20 (1) (j). The maximum allowed price according to § 24 (10) in this case is CZK 64 798.
(5) In the case of the main service referred to in Article 20 (1) (j), the postal consignment shall not be transported to the country of destination in the fastest manner; Paragraph 27 (1) and (2) shall not apply.
(6) The maximum permissible mass referred to in Paragraph 25 (2) shall be 10 kg.
(7) The maximum permissible dimensions referred to in Paragraph 26 (4) shall be: length 105 cm, sum of all three dimensions 200 cm.
(8) In the event of damage or loss of the contents of the postal consignment, the provisions of § 24 (4) and (5) shall not apply; in the case of the main services referred to in Article 20 (1) (d), (f) and (g), the holder of the postal licence shall not be liable for damage or loss of the contents of the postal consignment.
(9) Paragraph 24 (6) does not apply; in the case of the main service referred to in Article 20 (1) (i), the holder of the postal licence shall not be liable for damage caused by loss, damage or loss of the contents of the postal consignment.
(10) The supplementary service referred to in Article 45 (1) (a) cannot be requested for the main service referred to in Article 20 (1) (i).
