of 18 January 1949
amending and supplementing the provisions on official wearing of Judges.
The Government of the Czechoslovak Republic orders pursuant to § 49 of the Act of 24 July 1926, No 103 of the Coll., on the modification of the pay and certain service conditions of civil servants, pursuant to the Act of 6 October 1948, No 232 of the Coll., on the State Court, and pursuant to § 22 of the Act of 22 December 1948, No 319 of the Coll., on the depopulation of the judiciary:
(1) In any public hearing held before the Supreme Court or before a State Court, professional judges, folk judges and conceptual pragmatic officials of the Prosecutor-General and of the State Prosecutor-General shall, except as provided for in the following paragraph, be required to wear official clothing.
(2) Military professional judges and judges of the people of the military persons active in the service shall wear a uniform service in the main trial before the State Court and in the public sitting of the Supreme Court in cases where the first seat was decided by the State Court. The provisions of the previous sentence shall apply mutatis mutandis to officers of the judicial service working with the State Prosecutor.
(3) The judges and conceptual pragmatic officials of the public prosecutor's offices, acting before other courts, do not wear official clothing.
(4) The duty of the Judges of the Administrative Court to wear official clothing in all public proceedings before the Administrative Court is without prejudice to.
(1) The judges of the people working in the Supreme Court wear the official clothing of the judges of the second class (§ 8, paragraph 3 of the Decree of 12 March 1927, No 25 Coll., which determines on which occasions the judges are required to wear official clothing and which gives more detailed provisions on its presentation).
(2) The President, the Vice-President and the Presidents of the Chamber of the State Court wear the official attire of the third class (§ 8, paragraph 4 of Decree-Law No 25 / 1927 Coll.), the other Judges of the State Court wear the official attire of the second class.
(3) State Prosecutor and State Vice Prosecutor wear second class official clothing (§ 9, paragraph 3 of Government Decree No. 25 / 1927 Coll.).
(1) Official clothing for judges of the people at the Supreme Court and the State Court shall be treated as an inventory of official clothing on the State's cargo.
(2) The professional courts of the highest court or of the national court shall wear official garments of the second class during public proceedings before those courts. If they are not covered by such official clothing before such assignment, they shall be assigned as an inventory official clothing for that period. The provisions of this paragraph shall apply mutatis mutandis to conceptual pragmatic officials of the public prosecutor's offices and judges assigned by the service to the general prosecutor's office or to the state prosecutor's office.
Paragraph 3 of the Decree of 19 October 1948, No. 238 Coll., implementing certain provisions of the Law on the State Court, is hereby repealed.
This Regulation shall enter into force on 1 February 1949; they shall be carried out by the Prime Minister and the Minister of Justice.
