GOVERNMENT REGULATION

amending Government Regulation No 426 / 2016 Coll., on conformity assessment of radio equipment when making them available on the market
The Government hereby orders pursuant to Section 4 of Act No. 90 / 2016 Coll., on the conformity assessment of specified products when making them available on the market:
Government Regulation No 426 / 2016 Coll., on conformity assessment of radio equipment when making them available on the market, is amended as follows:
1. in Paragraph 3 (3) (g), the words "emergency calls" shall be replaced by "emergency communications."
2. Point 3 of Annex 1, including footnotes 9 and 11, reads as follows:
'3. Air equipment, where such equipment falls within the scope of the directly applicable European Union Regulation laying down common rules in the field of civil aviation 9) and is intended exclusively for use in the air:
(a) aircraft, except unmanned aircraft, and their engines, propellers, parts and non-installed equipment;
(b) unmanned aircraft and their engines, propellers, parts and non-installed equipment, the design of which has been certified in accordance with the directly applicable European Union Regulation governing common rules in the field of civil aviation (11) and which are intended to operate only on frequencies allocated under the Radio Regulations of the International Telecommunications Union for Protected Air Use.
9) Regulation (EU) 2018 / 1139 of the European Parliament and of the Council of 4 July 2018 on common rules in the field of civil aviation and establishing a European Union Aviation Safety Agency, amending Regulations (EC) No 2111 / 2005, (EC) No 1008 / 2008, (EU) No 996 / 2010, (EU) No 376 / 2014 and Directive 2014 / 30 / EU of the European Parliament and of the Council and repealing Regulations (EC) No 552 / 2004 and (EC) No 216 / 2008 and Council Regulation (EEC) No 3922 / 91, as amended.
11) Article 56 (1) of Regulation (EU) 2018 / 1139 of the European Parliament and of the Council.
Efficacy
This Regulation shall take effect on 1 January 2022.
