GOVERNMENT REGULATION
of 18 December 2000
on working hours and rest periods for workers with unevenly distributed working hours in transport
The Government orders pursuant to Section 5 of Act No. 65 / 1965 Coll., Labour Code, as amended:
The working and rest hours of road transport drivers and persons who, as members of the crew of a motor vehicle, provide transport services for the carriage of passengers or goods by road, and provide continuous rest between two shifts of staff who drive or accompany the vehicle in urban public transport, 1) operate the track and organise transport, shall be governed by an international contract binding on the Czech Republic and published in the Collection of Laws or in the Collection of International Contract .2)
The working time in the various weeks for workers providing motorways, roads and local roads must not exceed 60 hours during the winter period and when the effects of the calamity are resolved. The winter period shall be from 1 November to 31 March of the following year. A calamity situation means a significant deterioration or interruption of the infrastructure due to a blizzard and intense long-term snow, the formation of continuous frost, fog, tightness, freezing rain, wind, flood and flood water and other similar situations.
The employer may reduce continuous rest between two shifts up to 6 hours or, if the previous shift was less than 6 hours, up to the duration of that shift, for a period of at least 3 hours during the winter or in the event of the liquidation of the calamity situation.
The employer shall plan working hours during the winter or in the event of the liquidation of the effects of the calamity situation, so that the staff member ensuring the mobility of motorways, the mobility and the workability of roads and local roads shall have a continuous rest of 32 hours in a period of 2 weeks consecutive.
(1) The length of the shift for staff who operate the runway, organise railway transport, drive or accompany the railway vehicle on the national, regional or railway track, 3) may not exceed 13 hours. In the case of the time needed for the transfer from the agreed place of work to another place of work before the start of work or the time required for the transfer from the place of work to another place of work during the course of work or the time needed for the transfer from the place of work to the agreed place of work after the end of work, the length of the shift may not exceed 15 hours.
(2) The length of the shift of staff of the fire-fighting rescue service on the national, regional and special3 track may not exceed 16 hours.
The employer shall plan the working hours so that the staff member who operates the track organises railway transport or accompanies the railway vehicle on the national and regional track, (3) has continuous rest between the end of the one shift and the beginning of the next shift for at least 11 hours consecutive within 24 hours, unless otherwise specified. Staff who operate or organise railway services or accompany a railway vehicle on a national or regional track, 3) may be reduced to up to 6 hours by continuous rest. If the previous shift was less than 6 hours, the continuous rest may be reduced after consultation with the relevant trade union body for up to the duration of the shift, but for at least 3 hours, provided that the employer provides the worker with the possibility of sleeping on the bed.
The employer may, after consultation with the relevant trade union body, schedule working hours for staff in urban mass transportation (1) so that the continuous rest period will be at least 24 hours within 7 days consecutive, and for a period of 3 calendar weeks consecutive, that rest will be at least 105 hours.
(1) whose work cannot be interrupted shall be included in the working time. The length of the working hours of staff with two-shift, three-shift and continuous working arrangements who drive or accompany a vehicle in urban public transport may not exceed 40 hours per week.
The employer may agree with a fire-fighting serviceworker on a national, regional or special3) on an occupational emergency within a maximum of 950 hours, with an employee of railway company security within a maximum of 750 hours and an employee providing operation4) on national and regionalroads (3) on a maximum of 600 hours if there is a removal of the consequences of natural or exceptional accidents in railway transport, 5) in a calendar year.
The shift of the maintenance staff of the Special Railway 3) working at night may not exceed 10 hours within 24 hours consecutive.
(1) Length of shift
(a) a member of the basic crew of an aircraft may not exceed 14 hours;
(b) a member of a reinforced flight crew may not exceed 16 hours;
(c) a member of a double crew may not exceed 20 hours.
(2) The length of the working shift provided for in paragraph 1 may be extended if this is necessary for the safe completion of the flight as a result of circumstances occurring after the shift begins.
(3) The working time of a crew member shall not exceed 60 hours, 28 calendar days consecutive 200 hours, 90 calendar days consecutive 500 hours. During the calendar year, the working hours of the crew member shall not exceed 2 000 hours, of which the flight hours shall not exceed 900 hours.
(4) The essential crew of an aircraft shall be the minimum number of crew members determined for a given type of aircraft by the Civil Aviation Authority, a duplicated crew in which all basic crew members' duties are duplicated in such a way as to allow replacement of all basic crew members for part of the shift, and an enhanced crew of the aircraft crew whose number of members must allow replacement of each crew member for part of the shift.
(1) The employer shall plan the working time of the member of the crew of the aircraft in such a way that he / she has a continuous rest between the end of the one shift and the beginning of the next shift for at least 11 hours consecutive within 24 hours.
(2) A member of an aircraft crew may be reduced to the rest provided for in paragraph 1, provided that the employer ensures that the crew member can sleep in a bed for at least 8 hours.
(3) The employer shall plan the working time of the member of the flight crew in such a way that the continuous rest period after 7 days in succession is 48 hours, with a rest period of at least 7 calendar days in a period of one calendar month and days off once during the calendar month shall be for Saturday and Sunday. The rest period shall be at least 96 calendar days in a period of one calendar year.
The length of the shift of a crew member may not exceed 14 hours. The maximum length of weekly working hours shall not exceed 72 hours. The master of the vessel shall be considered as a member of the crew.
(1) The employer shall plan the working hours of the crew of the vessel in such a way that the crew member shall have continuous rest between the end of one shift and the beginning of the subsequent shift for at least 6 hours consecutive within 24 hours.
(2) The employer shall schedule working hours in such a way that the crew member of the vessel shall have continuous rest for a maximum period of nine weeks of at least 35 hours for each week worked.
(3) The employer shall schedule working hours so that the person providing the service of vessels in ports shall have continuous rest for at least 70 hours after two weeks. The service of the vessel in ports shall be those providing loading and unloading, repairs and supplies of vessels and other operations associated with the operation of the vessel.
The employer may agree on an on-call call within a maximum of 600 hours per calendar year with the crew member of the vessel and the operator of the vessels in ports.
This Regulation shall enter into force on 1 January 2001.
