amending Decree of the Ministry of Transport and Communications No. 470 / 2000 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws
The Ministry of Transport and Communications provides pursuant to § 62 for the implementation of § 48 paragraph 4 of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence to drive motor vehicles and on amendments to certain laws:
Decree No. 470 / 2000 Coll., implementing Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the driving of motor vehicles and on amendments to certain laws, is amended as follows:
Section 21, including the title and footnote 6, reads as follows:
Method and scope of the examination
(Paragraph 48 (4) of the Law)
(1) The examination of the driver of a motor vehicle which is obliged to participate in the improvement of professional competence shall be carried out within 16 hours of the statutory training.
(2) A person who will be granted a driving licence for a motor vehicle whose driving licence is subject to training to improve proficiency and checking shall, upon application by the competent district authority, issue a driving licence at the same time as the driver's professional qualification certificate, in which he / she shall register the driving licence for the vehicles concerned.
(3) The examination referred to in paragraph 1 and its assessment shall be carried out in the manner and to the extent set out in paragraphs 1 to 6 of Section 17 for a group or subgroup of driving licences for which the driver has received training to improve professional competence.
(4) The driver referred to in paragraph 1 who drives a vehicle for the carriage of more than 9 passengers, including the driver or a vehicle for the carriage of goods of a total mass of more than 7,500 kg, shall further demonstrate the practical experience of driving and manoeuvring the vehicle when tested. The test shall be carried out within 10 minutes at the self-training site or other training area, excluding the operation of other vehicles.
(5) The provisions of paragraph 4 shall not apply to a driver for whom the driving of a motor vehicle is a type of work agreed in a contract of employment and his employment relationship lasts without interruption of at least the last 24 consecutive calendar months, or for whom the driving of a motor vehicle is the subject of a self-employed activity carried out under a special legislature (6) and carries out such activity without interruption of at least the last 24 consecutive calendar months.
(6) In the case of a driver driving a motor vehicle in an employment relationship and where driving a motor vehicle is a type of work agreed in the employment contract referred to in paragraph 5, the certificate of the duration of the employment relationship shall be issued by his employer to the driver. In the case of a driver in respect of whom the driving of a motor vehicle is self-employed in accordance with paragraph 5, the certificate of the duration of the employment relationship shall be accompanied by a declaration of honour.
