GOVERNMENT REGULATION
of 11 December 2000
amending Government Decree No 79 / 1994 Coll., on the pay ratios of armed forces, security forces and services, customs authorities, fire protection officers and employees of certain other organisations (Staff Regulations), as amended
The Government hereby orders pursuant to § 23 (b), (c), (d) and (e) of Act No. 143 / 1992 Coll., on the salary and remuneration of on-call time in budgetary and in certain other organisations and bodies, as amended by Act No. 40 / 1994 Coll. and Act No. 217 / 2000 Coll.:
Government Decree No 79 / 1994 Coll., on the pay ratios of employees of armed forces, security bodies and services, customs authorities, members of the Fire Protection Corps and of employees of certain other organisations (Staff Regulations), as amended by Government Decree No. 143 / 1995 Coll., Government Decree No. 72 / 1996 Coll., Government Decree No. 327 / 1996 Coll., Government Decree No. 354 / 1997 Coll., Government Decree No. 249 / 1998 Coll. and Government Decree No. 127 / 2000 Coll., are amended as follows:
1. in Article 1 (1), points (d) and (g) shall be deleted; at the end of point (e), the comma shall be replaced by "a" and at the end of point (f) shall be "a";
Points (e) and (f) shall be renumbered as points (d) and (e).
2. Paragraph 1 (2) reads as follows:
"(2) An employee under this Regulation shall mean an occupational soldier, a member of the service (hereinafter referred to as" member '), an employee and a civil servant, where he is classified in:
(a) the armed forces of the Czech Republic;
(b) Ministry of Defence,
(c) The police of the Czech Republic,
(d) Prison services;
(e) the Ministry of Justice, if it is a civil servant who is continuously overseeing the execution of the detention and imprisonment;
(f) Security Information Service,
(g) Fire department of the Czech Republic,
h) Ministry of the Interior, if it is an employee assigned to the General Directorate of the Fire Department of the Czech Republic and in educational, technical and purpose facilities of the Fire Department of the Czech Republic,
(i) the customs authority;
(j) the Office for Foreign Relations and Information; and
(k) an organisational component of the State or in a contribution organisation in which the pay relationship is governed by law, as an employee, if the founder of that branch of the State or of a contribution organisation is the Ministry of Defence. ';
(3) Paragraph 2, including the title and footnote 2, shall be deleted.
4. In Article 3, the following shall be added at the end of the text of paragraph 1: "the work referred to in Annex 1 to this Regulation (hereinafter referred to as" the catalogue ") '.
5. In Paragraph 3 (2), the words "internal regulation 'are replaced by" internal salary regulation ("internal regulation') '.
6. In Article 4 (1), the first sentence is replaced by the following sentence: "The employer shall place the staff member in the grade of the staff member in accordance with Article 4 (1) of the Act, in which the most demanding work is included in the catalogue, the performance of which the employer requires on the staff member. '
7. In Section 5, the heading reads: "Allocation of staff members to grade '.
8. In Article 5 (1), the words "Until the period applicable for the inclusion of a staff member in the grade (hereinafter referred to as" deductible practice ') of the relevant grade shall be replaced by the words "The employer shall include the staff member in the grade of the grade concerned, depending on the number of hours applicable to that grade (hereinafter referred to as" deductible practice'). The employer shall include a period 'in the period of deductible practice.
9. in Paragraph 5 (1) (d), the word "a" shall be replaced by a comma at the end.
10. in Article 5 (1) (e), including footnotes 5), 10) and 10 (a):
"(e) maternity leave, other maternity leave or parental leave or permanent childcare to the extent appropriate to the length of maternity leave and other maternity leave or parental leave valid at the time of such care under special legislation, (5) but not more than a total of six years; those periods shall not be counted if the staff member or staff member was simultaneously preparing for a profession in a daily study10) or in a preschool, 10a); and

10) Sections 20 (1) and 27a (2) of Act No. 29 / 1984 Coll., on the System of Primary Schools, Secondary Schools and Higher Vocational Schools (Education Act), as amended by Act No. 138 / 1995 Coll.
10a) Paragraph 44 (4) of Act No. 111 / 1998 Coll., on Higher Education and on the amendment and addition of other laws (Act on Higher Education). '
11. in Article 5 (1), the following point (f) is added:
"(f) personal care of a long-term severely disabled minor child or children who have required exceptional care, unless they have been placed in an institution for such children, but not more than six years in total, including the period counted under point (e)."
12. in Article 5 (4):
"(4) For the purpose of a staff member's advance to a higher grade, the period of work required in the grade to which the staff member is classified shall be included in the notable practice in full. ';
13. in Article 6, the following paragraph 3 is added:
"(3) Staff members who are 10b) under the special legislation of the health professional and who are engaged in the profession of employment in relation to a contribution organisation set up by the Ministry of Defence shall be entitled to the salary rate referred to in paragraph 1 plus an amount equal to 10% of the salary rate of the highest grade in the grade to which the staff member is classified; This amount shall be rounded up to the whole ten crowns.
10b) § 53 of Act No. 20 / 1966 Coll., on the Care of People, as amended by Act No. 258 / 2000 Coll. Decree No 77 / 1981 Coll., on health professionals and other health professionals. '.
14. in Article 7, paragraph 3, including footnote 11, is deleted;
Paragraph 4 shall become paragraph 3.
15.
Management supplement
A lead employee who is the statutory body of the employer, the head of the organisational body of the State (hereinafter referred to as the "statutory body ') and the head of the employer's staff, (11) who is not subject to the management fee provided for in Article 5 (1) of the Act, shall be subject to the management fee set out in Annex 3 to this Regulation, depending on the degree of management and the complexity of the management work.
11) Paragraph 9 (1) and (3) of the Labour Code. '
16. Article 9 shall be deleted;
17. in Article 10 (3), the words "Staff referred to in Article 1 (2) (a), (b), (c), (f) and (g)" shall be replaced by the words "Staff referred to in Article 1 (2) (a) to (e) and (g), (i) and (k)";
18. Paragraph 10 (5) is deleted.
Paragraphs 6 to 13 shall become paragraphs 5 to 12.
19. Paragraph 10 (6) reads:
"(6) Staff of the armed forces and of the security corps posted within the United Nations' multinational forces or international police forces outside the territory of the Czech Republic shall be granted a surcharge of USD 700 to USD 3 000 per month for the duration of their stay abroad. The conditions for determining the amount of the surcharge and the amount of the surcharge within this margin shall be determined by the Minister of Defence or the Minister of Interior, under the jurisdiction of the staff member. ';
20. in Article 10 (12), the headings "6 and 8 to 12" are replaced by "5 and 7 to 11."
21. in Article 12 (5), "paragraph 7" is replaced by "paragraph 6";
22. Article 13 is deleted.
23. In Paragraph 14 (5), the words "pilot (s) of an aircraft, air navigator, cabin engineer or cabin engineer-operator and air traffic controller 'shall be inserted after the words" coach'.
24. In Paragraph 14, the following paragraph 6 is inserted after paragraph 5, including footnote 18:
"(6) A member in a fourth or higher grade for whom he does not meet the established qualification requirement may be kept in that grade by the employer, provided that he is qualified under the special legislation (18).
18) Article 15 of Act No. 186 / 1992 Coll., on the service relationship of members of the Czech Police. § 5 and 6 of Decree No. 161 / 2000 Coll., adjusting certain details of the service of members of the Police of the Czech Republic. Section 32 of Act No. 154 / 1994 Coll., on the Security Information Service. Section 2 and Sections 4 to 7 of Decree No. 259 / 1997 Coll., adjusting certain details of the service of customs officers. '
Paragraph 6 shall become paragraph 7.
25. Article 16 is deleted.
26. Annex 2 reads as follows:

1. Further salary pursuant to Section 12 of the Decree of the Government No 79 / 1994 Coll., on the pay ratios of armed forces, security forces and services, customs authorities, fire protection officers and employees of certain other organisations (Staff Regulations), as amended by the Decree of the Government No 143 / 1995 Coll. and the Decree of the Government No 72 / 1996 Coll., will be granted only half the amount to which employees would otherwise be entitled in 2001.
2. The additional salary calculated in accordance with point 1 shall be rounded up to the whole hundred crowns.
This Regulation shall enter into force on 1 January 2001.
