GOVERNMENT REGULATION
of 18 December 2000
on the conditions for granting subsidies from the state budget to support the regeneration of panel settlements
The Government orders the implementation of Act No. 218 / 2000 Coll., on Budgetary Rules and on the Amendment of Certain Related Laws (Budget Rules):
§ 1
Subject matter
(1) This Regulation regulates the conditions for granting subsidies from the state budget (hereinafter referred to as "subsidies') to the adjustment aimed at the regeneration of existing panel settlements, which is their transformation into multipurpose units and the universal improvement of the living environment.
(2) The subsidy is not intended for repairs of residential panel houses 1)
§ 2
Definition of terms
This Regulation shall mean:
(a) a housing house built by panel technology housing building, which predominates by housing function, built in one of the typical construction systems mentioned in the specific legislation, laying down conditions for state financial support for repairs, modernization or renovation of housing houses built by panel technology, (1) with the exception of a housing building which, by its construction arrangement, complies with the requirements for family housing and in which more than half of the floor area of rooms and spaces is intended for housing and has a maximum of three separate apartments, no more than two above-ground and one underground floors and attic;
(b) a complex part of the territory of the municipality built by houses built by panel technology with a total of at least 150 flats;
(c) adjustments to the work of planning and implementation in the fields of social, economic, urban, architectural and technical adaptations and modernisation towards the gradual regeneration of existing panel settlements in multi-purpose units, including:
1. processing of the control plan of the panel housing site or part thereof,
2. the construction of transport and technical infrastructure, including the remediation of local road connections, pedestrian roads, public spaces and cycling paths, the construction of new connections of local car roads, pedestrian roads, public spaces and cycling paths, the construction of noise barriers, the construction of parking spaces and parking spaces, including the required number of parking spaces for disabled people's vehicles, measures to maintain or increase the overall proportion of unpaved areas due to the protection of microclimate and the slowdown of the drains, the removal of high-voltage mains and their replacement by cable lines, sanitation and the addition of public lighting, the adoption of local flood control measures, the conversion of residential boilers into noble fuels, the use of renewable energy sources in residential boilers and related projects; or
3. the adaptation of public spaces, including remediation and replenishment of areas for fire-fighting, areas of public greenery associated with the planting of grown trees and the grounding of areas, the remediation of existing areas and the establishment of new children's sandfields, passages and park rest areas and benches, the modification and construction of public recreational areas and the related project work;
(d) a project for the regeneration of a panel settlement, processed under the conditions laid down in the Progress in the processing of a panel settlement regeneration project listed in the Annex to this Regulation, monitoring the comprehensive improvement of the housing environment of the panel settlement and including the adjustments referred to in (c).
§ 3
Conditions for obtaining the subsidy
(1) The subsidy may be awarded to the municipality in whose territory the housing estate is situated.
(2) The subsidy may be granted if the following conditions are met:
(a) the municipality has a territorial plan issued by the municipality (2) and a project for the regeneration of a panel settlement;
(b) the municipality shall participate in the financing of the adjustments provided for in Article 2 (c) at least 30% of their budgetary costs;
(c) no State financial aid under special legislation has been granted for the adjustments.
(3) The subsidy for the same type of adjustment may be granted only once within a single housing site.
(4) The subsidy may also be granted for adjustments already initiated if the conditions of this Regulation are met.
§ 4
Amount of subsidy
The subsidy may be granted up to 70% of the budgetary cost of the adjustments provided for in the application.
§ 5
Procedure for granting the subsidy
(1) The subsidy may be granted at the request of the municipality submitted to the Ministry of Local Development (hereinafter referred to as the Ministry).
(2) The application submitted in the Ministry's form shall be accompanied by:
(a) a project for regeneration of the panel housing site;
(b) proof of the town planning;
(c) proof of approval of the regeneration project of the panel settlement by the municipality representative,
(d) proof of ownership of buildings and land;
(e) completed forms of the Ministry of Finance for financing programmes from State budget, pre-accession and structural funds of the European Communities, NATO funds and loans with State guarantee;
(f) a final territorial decision, proof of the issue of the regulatory plan, territorial consent, final building permit, public contract for the execution of the construction, certificate of an authorised inspector, consent to the implementation of the notified construction, or declaration that no decision has been issued by the building authority within the legal period of a decision prohibiting the implementation of the notified construction;
(g) permit to build the relevant communication, 4)
(h) proof of own funds of at least 30% of the budgetary costs;
(i) a statement by the municipality that, at the date of submission of the subsidy application, it has no commitments beyond its maturity in relation to the State budget and the State funds.
(3) The Ministry will select the applications for the grant and decide on the grant. The decision shall be notified without delay to the applicant.
§ 6
Conditions for drawing the subsidy
The use of the subsidy is only linked to the financing of the adjustments to which it was granted.
§ 7
The grant provided for in this Regulation shall be in accordance with a special law governing the procedure for assessing the compatibility of public aid with the obligations arising from the Europe Agreement establishing an association between the Czech Republic, of the one part, and the European Communities and their Member States, of the other part. 5)
§ 8
Control and penalties
Specific legislation shall apply to the control and compliance with the conditions for drawing a subsidy under this Regulation and to the application of penalties for unauthorised use or retention of a subsidy. 6)
§ 9
Efficacy
This Regulation shall enter into force on 1 January 2001.

Procedure for processing the project of regeneration of the panel estate and its contents
Procedure for processing the regeneration project of the panel settlement
1. Evaluation of the background materials in terms of usability for regeneration of panel housing. The background materials are:
(a) land planning documentation issued;
(b) urban development programmes;
(c) original documentation of the settlement, documentation of subsequent changes in the settlement, property identification of land, buildings, flats; where appropriate, other supporting documents, in particular studies on the completion of the housing site and modifications, including adjustments to ensure access and use by persons with reduced mobility;
(d) documentation of the completion or construction of the regeneration of certain parts of the estate.
2. Ensuring the participation of the population and of all locally concerned natural and legal persons, in particular:
(a) education in the public media (Czech and foreign experience);
(b) familiarisation of the population with the intention and consequences of the proposed modifications (including the issue of preliminary "motivation sketches");
(c) a poll between residents of the settlement and the adjacent territory and the natural and legal persons concerned;
d) Assessment of the results of the survey, comments and suggestions of citizens - partial sociological study, etc.
3. Accuracy of the principles of municipal development programmes (housing policy, social issues), particularly in relation to the problems of the settlement.
4. The development of a panel housing regeneration project, which will include, in addition to a sociological, urban study, etc., also an economic evaluation including a financing proposal (selection of all appropriate support programmes, preliminary negotiations with future investors and other relevant natural and legal persons involved in financing).
5. Discussing the project of regeneration of the panel settlement by the council of the village, incorporating changes.
6. Approval of the project of regeneration of the panel settlement, determination of the stages of entry of individual modifications.

1. The analytical part shall include an evaluation of the supporting materials referred to in points (a) to (g) and their addition by own research of the project processor. The basis for the analysis is:
(a) land planning documentation issued;
(b) previously developed projects, strategies;
(c) evaluation of the survey among residents of the settlement;
(d) an assessment of the state of the site from the aspects of the construction, functionally operational and spatial;
(e) the development of the population's age and social composition, the need for jobs, etc.;
(f) an analysis of the economic conditions of the adjustment, an indication of existing resources, including State aid programmes, the possibility of private investment and other resources;
(g) the characteristics of the individual modifications.
2. The design part consists of a text, drawing, economic and document part.
Text section contains
(a) the objective to be pursued by implementing the projects of regeneration of the panel settlement - adaptation, the time period in which the objectives should be achieved;
(b) the objectives in order of urgency;
(c) a proposal for the necessary amendments to the territorial planning documents, changes or acquisition of the regulatory plan; the proposal shall take into account the conditions for social, cultural and leisure activities; special attention will be paid to leisure opportunities for children and young people, conditions for job creation and other current issues will also be addressed.
The drawing part contains:
(a) the part of the land planning documentation issued;
(b) motivational sketches and proposals for the necessary changes to the planning documentation or proposals for the acquisition of a regulatory plan, proposals for individual modifications, etc.
The economic part contains
(a) a list of proposed modifications;
(b) an estimate of the costs of making each adjustment; quantification of possible subsequent profits;
(c) the timing of the adjustments;
(d) a proposal on how to finance adjustments in each year, specifying the sources of funding.
