DECLARATION
of 27 October 2006
amending Decree No. 330 / 2004 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended
The Ministry of Agriculture provides pursuant to § 88 (1) (b) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 131 / 2006 Coll., hereinafter referred to as "the Act ':
Decree No. 330 / 2004 Coll., on measures against the introduction and spread of harmful organisms of plants and plant products, as amended by Decree No. 662 / 2004 Coll., Decree No. 247 / 2005 Coll. and Decree No. 244 / 2006 Coll., is amended as follows:
1. in Paragraph 1 (2) (e), the words "European Communities" and "European Communities" shall be replaced by the words "Community."
2. The heading of Section 5 reads: "Authorisation of the handling of quarantine material (K § 8 (1), (2) and (4) of the Act)."
3. In Article 5, the following sentence shall be added at the end of paragraph 7: "Authorisation for possession, reproduction and other handling of quarantine material shall be issued for a period of five years from the date of issue."
4. In Section 15, the words "(K § 18 (2) of the Act) 'are replaced by" (K § 16 (2) and 18 (2) of the Act'.
5. In Paragraph 18 (1), the second sentence is deleted.
6. In Article 18 (2), the words "and for the customs procedure for free circulation in connection with the termination of the outward processing procedure," shall be inserted after the words "use,";
7. Paragraph 18 (4) is deleted.

Import phytosanitary checks
[Paragraph 22 (3) (d), (e) and (4) of the Act]
(1) The record of import phytosanitary checks shall be made on the phytosanitary movement document set out in Annex 9a, in one of the official languages of the Community.
(2) A copy of the document referred to in paragraph 1 shall be kept by the office of destination for one year from the date of completion of the inspection.
(3) Plants, plant products or other objects to which the provisions of Sections 14 (1) and (2) and 19 of the Act apply upon completion of the import phytosanitary checks on consignments or lots are set out in Annex 9 (A) (I) and (II). "
9. In Article 20 (1), point (d), the third sentence in paragraph 2 and paragraph 3 are deleted.
Paragraphs 4 to 6 shall become paragraphs 3 to 5.

Notification of importers
[Articles 24 (1), (2) and 25 (7) (c) of the Law]
(1) Importer of plants listed in Annex 9 Part A point III which, when placed on the market, bears plant passports pursuant to Article 14 (1) or (2) of the Act shall be notified in writing within 14 days of their sale or any other way of transferring them to another person to the plant health service of their customer; in the notification, the importer shall indicate the name and surname, permanent residence or, where applicable, residence or business name of the customer who is a natural person, or the name or business address of the customer who is a legal person, and the identification number if assigned. The address of the place of submission of the notification shall be published by the Plant Health Administration in the Bulletin.
(2) The details of the notification and the particulars referred to in Article 24 (2) (a) and (b) of the Act are set out in Annex 9b.
(3) The relevant items of the phytosanitary movement document (see Annex 9a) shall be completed and signed by the importer of the consignment or, where appropriate, by another person authorised by the importer under the supervision of the office of entry and after prior agreement of the authorities of entry and destination. "
11. The following Section 21a is inserted after Section 21, which includes the title:
Transport and storage requirements for lots and consignments
[K § 25 (7) (b) of the Law]
(1) The packaging or means of transport of the consignment or lot must be closed or with an intact seal so that the identity of the consignment or lot cannot be altered during transport to an approved place pursuant to Article 25 (3) of the Act and that the identity of the consignment or lot cannot be introduced or spread.
(2) The storage of the consignment or lot at the place referred to in Article 25 (3) of the Act must be carried out separately from the Community goods and consignments which are contaminated by harmful organisms or for which such suspicion exists. '
12. Paragraph 22, including the title, reads:
Place of import phytosanitary inspection
[Paragraph 25 (1) and 7 (d) of the Act]
(1) The minimum requirements for technical and professional equipment and installations of entry points pursuant to Article 25 (1) of the Act are set out in Annex 14.
(2) The minimum requirements for technical and professional equipment and equipment of the place referred to in Article 25 (2) of the Act and approved place referred to in Article 25 (5) of the Act are set out in Annex 15. '
13. The following Section 22a is inserted after Section 22:
Application for approval of the place of identity and health check of the consignment or lot
(K § 25a (1) of the Act)
The particulars of the application for approval of the place of identity and health check of the consignment or lot other than those provided for in § 25 (1) and (2) of the Act are set out in Annex 15a. '
14. In Article 25 (1), the words "which is in green," and the words "which is in brown," shall be inserted after the words "Part A". "
15. The following Section 26a is inserted after Section 26:
Communication of measures
[Paragraph 72 (10) (e) of the Law]
The measures carried out by the plant health administration for the plants set out in Annex 7 shall not be communicated to the Commission and the other Member States. ';
16. in Annex No 1 (B) (a) (4) to the right column, "Ireland a" is replaced by "Ireland."
17. In Annex 2 (A) (I) (c) (4) to the right column, "Mars." is replaced by "Marsh."
18. In Annex 6, "Directive 95 / 44 / EC 'is replaced by" Directive 95 / 44 / EC';

20. In Annex 9, Part A, point I, point 1.7 (b), in the left-hand column, the words "ex 4403 99 'are replaced by" ex 4403 99', and the words "4403 10 00 Crude wood, coated with paint, mordant, creosote or other protective equipment, whether or not stripped of bark or wood bark or roughly trimmed 'are replaced by the words" 4403 10 00 Crude wood, coated with paint, mordant, creosote or other protective equipment, other than bark or wood white or roughly trimmed'.
21. In Annex No 9 (B) (I) (6) (b), the words "4403 10 00 Crude wood, coated with paint, stains, creosote or other preservatives, whether or not stripped of bark or bark or wood bleached, or roughly trimmed 'are replaced by the words" 4403 10 00 Crude wood, coated with paint, stains, creosote or other preservatives, other than bark or wood bleached or roughly trimmed'.
22. the following Annexes 9a and 9b are inserted after Annex 9:

23. In Annexes 11 and 12, the words "and amending certain related acts, as amended, shall be inserted after the words" Act No. 326 / 2004 Coll., on Phytosanitary Care. "
24. In Annex No 12, the words "in Annex 9, Part A, point IV, of Decree of the Ministry of Agriculture No 330 / 2004 Coll.: 'are replaced by the words" in Annex 9, Part A, point III, of Decree No 330 / 2004 Coll., as amended:'.
25. Annex No 13 is deleted.
26. In Annex 14, the title and the first sentence shall read:
"Minimum requirements for technical and professional equipment and equipment of the point of entry referred to in Article 25 (1) of the Act for the conduct of import phytosanitary checks on consignments
The minimum requirements for technical and professional equipment and equipment of the point of entry referred to in Article 25 (1) of the Act for carrying out import phytosanitary checks on consignments shall be as follows: '.
27. In Annex No 15, the title and point 1 are as follows:
"Minimum requirements for technical and professional equipment and equipment of the place referred to in Article 25 (2) of the Act and approved place referred to in Article 25 (5) of the Act for carrying out identity and health checks of consignments
1. The premises of the place to carry out the identity check and health check of consignments other than the entry point referred to in Article 25 (1) of the Act must: '.
28. The fourth indent of point 4 of Annex 15 shall be as follows:
'- specify the period during which the health check of the imported consignments will be carried out at that place. ';
