on the medical fitness assessment for the issue or validity of an arms licence and the contents of the first aid kit of the shooting range operator
According to Section 79 (5) of Act No. 119 / 2002 Coll., on firearms and ammunition and amending Act No. 156 / 2000 Coll., on the Verification of Firearms, Ammo and Pyrotechnic Articles and on the Amendment to Act No. 288 / 1995 Coll., on Firearms and Ammo (Firearms and Ammo Act), as amended by Act No. 13 / 1998 Coll., and Act No. 368 / 1992 Coll., on Administrative Charges, as amended, and Act No. 455 / 1991 Coll., on Trade (Trade Act), as amended, (the Act on Weapons), (hereinafter "the Act '):
Assessment of medical fitness for the issue or validity of an arms licence
(Paragraph 20 (6) of the Law)
(1) The medical fitness assessment for the issue of a firearms licence or the possession of a group D weapon licence (hereinafter referred to as "medical fitness"), which is one of the conditions for possession or carrying of weapons and ammunition under the law, is issued on the basis of:
(a) a request by a natural person for an arms licence; and
(b) an application by the holder of an arms licence for the extension of groups of arms licences already issued; or
(c) an application by the holder of a D or F armaments licence pursuant to Paragraph 20 (2) of the Act; or
(d) a change in the health status of the holder of the firearms licence, where the assessor has identified a change in the health status or has reason to suspect that the holder is suffering from a disease, defect or condition (hereinafter referred to as "disease") which excludes or limits the possession or carrying of a weapon or carrying a pyrotechnic survey;
("the applicant ').
(2) The medical assessment is the result of a medical examination by the medical assessor or, where appropriate, a clinical psychological examination and other necessary examinations (hereinafter referred to as "professional examinations") carried out on request by the assessor, unless otherwise specified.
(1) Medical fitness is assessed during medical examinations
(a) input which are carried out in connection with the issue of an arms licence of the relevant group or extension;
(b) periodic, which are carried out on holders of the D or F-group firearms licences once every 30 months; or
(c) exceptional ones which are carried out in the case of:
1. the finding or reasonable suspicion that there has been a change or loss of medical fitness in connection with the change or development of the health status of the holder of an armaments licence; or
2. When the validity of the report is limited by the date stated therein (Paragraph 6 (3)).
(2) The necessary content of each inspection is:
(a) the identification of the applicant's anamnestic health data with a targeted focus on the exclusion of diseases which exclude or restrict medical fitness; diseases which exclude or restrict medical fitness are listed in Annex 1 to this Decree,
(b) comprehensive physical examination, including indicative examination of hearing, visual acuity, colour, field of vision, balance, indicative examination of neurological and orthopaedic;
(c) any additional necessary professional examination where it is necessary for the applicant to rule out suspected diseases which restrict or exclude the applicant's medical fitness; diseases which restrict medical fitness and for which the assessment may only be given subject to expert examination by a specialist are listed in Annex 1, Parts I and II, Section 2 of this Decree; and
(d) a professional examination whenever the applicant is in the continuous care of another doctor or clinical psychologist for a disease which limits the medical fitness to drive motor vehicles.
(3) The expert examination shall be carried out to the extent necessary to assess and make recommendations to the medical assessor for the medical fitness of the applicant.
(4) The examination shall use the results of the applicant's medical condition as far as their professional content and the period that has elapsed since their detection permit.
(5) In cases of expert examination as referred to in paragraph 2 (c) and (d), the doctor or clinical psychologist carrying out this examination shall be based on or extract from the medical file assessing the physician.
(6) If the medical assessor is a medical professional providing preventive care to the employer, which is not a medical practitioner with whom the applicant is registered for medical care, the medical assessor shall also base his opinion on the information provided in the register of the registrant, which shall request the applicant for medical examination.
(1) In the case of a medical fitness assessment for the issue of a group B armour pass and, if not for an applicant who fulfils the conditions for possession of a group C, D, E or F armour pass, the assessor shall always require a professional examination by the physical practitioner.
(2) A physical practitioner shall carry out an expert assessment for the purpose of making recommendations on the basis of knowledge of the health status of the applicant and the health claims associated with the use of a particular weapon or ammunition on the shooting range.
(1) The information on the health status of the applicant, the results and conclusions of the examinations, the records of diseases which exclude or restrict medical fitness and the technical recommendations, including any restrictions resulting from the established health status and the recommended or necessary compensation mechanisms, are part of the applicant's medical documentation.
(2) In addition to the information referred to in paragraph 1, the assessor shall clearly indicate in the medical file that he or she is a person who holds or applies for or has previously applied and has not been recognised as fit for health. If the medical assessor is a medical professional providing the employer with preventive care for racing, he shall simultaneously send the data found to the registrant's medical practitioner. This information is part of the written information transmitted to the newly elected physician in the event of a change of physician. 1)
Disability cannot be recognised and a positive assessment cannot be issued if the applicant:
(a) suffer from diseases which exclude medical fitness; the diseases which exclude medical fitness are listed in Annex 1, Parts I and II, Section 1 of this Decree; or
(b) is not disabled in accordance with the conclusions of the recommendations of the expert examinations [§ 2 (2) (c) and (d)].
(1) The opinion, other than those laid down in specific legislation1a, shall include the arms licence group for which the applicant or holder is assessed and the place of residence 1b).
(2) A medical opinion based on an initial, periodic or exceptional medical examination must be clear and must not contain a diagnosis. The assessment conclusion shall be as follows:
(a) is medically fit; or
(b) is not medically fit; or
(c) be medically fit using the relevant medical devices which are always explicitly mentioned in the opinion or accompanied. ';
(3) The period of validity of the medical opinion must be indicated in the opinion whenever the health status of the applicant requires the issue of an arms licence with a shorter duration than that laid down in the law or for the period when the term of the periodic medical examination is set [Paragraph 2 (1) (b)].

The first aid kit provided by the shooting range operator (2) contains the medical devices and medicines listed in Annex 2.
Efficacy
This Decree shall take effect on 1 January 2003.

Diseases which exclude or restrict medical fitness for the issue or validity of Group A and B firearms licences
Diseases that exclude medical fitness
1. organic mental disorders including symptomatic disorders, except postencephalic syndrome,
2. mental and behavioural disorders caused by the consumption of psychoactive substances (except for isolated uncomplicated intoxication),
3. schizophrenia, schizophrenia and delusions.
Diseases that restrict medical fitness
1. postencephalic syndrome,
2. mental and behavioural disorders:
(a) mental and behavioural disorders due to the use of psychoactive substances (excluding isolated, uncomplicated acute intoxication).
Note: Assessment of potential fitness requires at least three years of abstinence from cessation of treatment and is subject to evaluation by both a psychiatrist and a psychologist,
(b) affective disorders (mood disorders),
(c) severe neurotic, stress and somatoform disorders, anxiety and phobic disorders, adaptation disorders,
(d) personality and behaviour disorders,
(e) severe behavioural disorders associated with physiological disorders and somatic factors;
(f) personality structure and dynamics disorders:
• (fa) disturbances in attention for prolonged loads,
• fb) psychomotor disorders,
• fc) disturbances in perception, thinking, memory, decision making,
• fd) Emotional disorders:
- tendencies towards pathic anxiety reactions,
- unmanaged aggression, self-mutating, host, destructive or self-destructive tendencies,
- explosion, impulse, etc.,
• (f) social adjustment disorders:
- the tendency to transpose standards, regulations and laws,
- recurring conflicts with authorities,
- the tendency to raise conflicts with others,
• (ff) self-evaluation disorders: impaired ability to adequately evaluate your physical and mental options (such as self-evaluation, strong behavior, excessive risk-taking and self-demonstration, etc.),
• fg) impaired ability to follow the principle of reality in the negotiations and to anticipate the development of social situations and the consequences of own actions;
3. Organic Diseases with Psychopathological Symptoms
4. a reduced level of intellect,
5. Epilepsy, epileptic syndromes uncompensated or partially compensated, i.e. that the duration of the seizure-free period is less than 1 year or the condition after the first epileptic seizure, if antiepileptic therapy has been initiated, for at least 1 year after the seizure,
6. diseases not covered by this Section which, by their nature, restrict the safe control of arms and the handling of arms and ammunition for collector's and sports purposes.
Diseases which exclude or restrict medical fitness for the issue or validity of a C, D, E and F arms licence
Diseases that exclude medical fitness
1. organic mental disorders including symptomatic disorders, except postencephalic syndrome,
2. mental and behavioural disorders caused by the consumption of psychoactive substances (except for isolated acute intoxication),
3. schizophrenia, schizophrenia and delusions
4. mental retardation,
5. systemic atrophy primarily affecting the central nervous system,
6. extrapyramidal and movement disorders,
7. degenerative diseases of the nervous system not included above,
8.
9. reduction of visual acuity below 6 / 12 on each eye separately after correction,
10. Hearing disturbances preventing speech communication at a distance of less than 6 metres;
11. diseases in the inner ear accompanied by disturbances of balance.
Diseases that restrict medical fitness
1. postencephalic syndrome,
2. Mental and behavioural disorders - see section I Section 2, item 2,
3. Organic Diseases with Psychopathological Symptoms
4. a reduced level of intellect,
5. diseases of the nervous system:
(a) demyelinating central nervous system diseases,
(b) diseases which indisputably exclude or restrict the safe control of the weapon and the handling of arms and ammunition:
• nerve disease, nerve roots and knitting,
• polyneuropathy and other peripheral nervous system diseases,
(c) epilepsy, epileptic syndromes or post-epileptic seizure condition, if antiepileptic treatment has been initiated, 10 years after discontinuation of treatment;
6. eye diseases and eye adnex:
(a) other diseases in the eye and eye adnex which indisputably restrict the safe control of the weapon and the handling of arms and ammunition;
(b) a reduction in visual acuity below the reduction in visual acuity referred to in Section 1, with one-octopus allowed if the remaining eye has a visual acuity of 6 / 6 corrected,
7. Ear and nipple disorders:
(a) eagerness,
(b) other ear diseases that restrict the safe control of weapons and the handling of weapons and ammunition.
Note: In contentious cases, detailed audiological and vestibular examination is required,
8. Musculoskeletal and connective tissue diseases affecting the function of the upper extremities, endocrine diseases and the transformation of substances, as well as other diseases which indisputably exclude or restrict the safe control of arms and ammunition.
