DECLARATION
of 4 November 2025
amending Decree No 78 / 2014 Coll., on the formalities for the certification of employees of social security institutions and sickness insurance authorities responsible for checking the performance of obligations imposed on employers and self-employed persons
According to § 7 (4) of Act No. 324 / 2025 Coll., the Ministry of Labour and Social Affairs provides for a compulsory contribution to products saving for old age and amending related laws (Act on the compulsory contribution to products saving for old age):
Decree No 78 / 2014 Coll., on the formalities for the identification of employees of social security institutions and sickness insurance authorities responsible for checking the performance of obligations imposed on employers and self-employed persons, is hereby amended as follows:
1. In the introductory sentence, the word "a 'is deleted and the words" and according to Act No. 324 / 2025 Coll., on the compulsory contribution to products saving for old age and amending related laws (Act on the compulsory contribution to products saving for old age) are added at the end of the text.'
2. In Section 1 of the Introductory Part of the provision, the words "and the Sickness Insurance Act 'are replaced by the words", the Sickness Insurance Act and the compulsory contribution to the old age savings products'.
3. in Article 1 (d), the words "for the issue of a civil document (1)" shall be replaced by the words "under the Decree implementing the Civil ID Act and certain provisions of the Travel Documents Act and the Basic Register Act."
footnote 1 is deleted.
4. In Article 1 (g), the words "and Act No. 187 / 2006 Coll., on sickness insurance, as amended." 'shall be replaced by the words "Act No. 187 / 2006 Coll., on sickness insurance, as amended, and Act No. 324 / 2025 Coll., on compulsory contribution to products saving for old age.';
Transitional provision
1. The card of the employee of the social security institution and of the sickness insurance authority responsible for checking the performance of the duties imposed on employers and self-employed persons issued under Decree No 78 / 2014 Coll., as effective before 1 January 2026, shall expire on 31 December 2025. If a certificate issued pursuant to Decree No 78 / 2014 Coll., as in force before 1 January 2026, has been submitted in the course of checking the performance of the obligations imposed on employers and self-employed persons before 1 January 2026 and if this check continues after 31 December 2025, the scope of the control authorisation after 31 December 2025 shall apply only to the fulfilment of the obligations specified therein; This restriction shall not apply if, after 31 December 2025, a licence issued pursuant to Decree No 78 / 2014 Coll., as effective from 1 January 2026 is submitted.
Efficacy
This Decree shall take effect on 1 January 2026.
