THE LAW
of 10 December 2009
amending Act No. 203 / 2005 Coll., on the Compensation of Certain Victims of the occupation of Czechoslovakia by the Union of Soviet Socialist Republics, the German Democratic Republic, the Polish People's Republic, the Hungarian People's Republic and the Bulgarian People's Republic
Parliament has decided on this law of the Czech Republic:
Act No. 203 / 2005 Coll., on the Compensation of Certain Victims of the occupation of Czechoslovakia by the Union of Soviet Socialist Republics, the German Democratic Republic, the Polish People's Republic, the Hungarian People's Republic and the Bulgarian People's Republic, is amended as follows:
1. In Paragraph 2 (1), at the end of point (d), the words "or on the basis of a Government Resolution (1a) shall be added to the amount of money equal to or greater than the amount referred to in Article 4 (2) '.
footnote 1a is replaced by the following:
"(1a) Resolution of the Government of the Czech and Slovak Federal Republic of 19 December 1991 No 822 on the principles of compensation for survivors of the entry, residence and departure of Soviet troops and of disabled citizens in connection with the entry, residence and departure of Soviet troops."
2. In Article 2 (5), the words "or on the basis of a Government Resolution (1a) 'shall be inserted after the words" another legislative provision (1)'.
3. In Article 4, the following paragraph 3 is added:
"(3) The amount of the entitlement provided for in paragraphs 1 and 2 shall be reduced by the amount which has been granted to the person entitled in accordance with the purpose referred to in Article 1 before payment of the entitlement as compensation under other legislation1) or by the Government Resolution 1a). ';
Transitional provision
The claims established by this Act in Article I must be applied in the form of a written application to the Ministry of the Interior no later than 31 December 2010, otherwise the claim will cease.
Efficacy
This Act shall take effect on the day of its publication.
