DECLARATION
of 31 October 2006
amending Decree No. 137 / 1998 Coll., on general technical requirements for construction
According to § 143 paragraph 1 (k) of Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended by Act No. 83 / 1998 Coll.:
In Decree No. 137 / 1998 Coll., on General Technical Requirements for Construction, Section 39, including the title and footnote 28a, reads as follows:
Lifts
(1) Building by type and needs are equipped with lifts 28a)
(a) intended for the transport of persons or of persons and costs;
(b) intended for the transport of costs;
(c) fire-fighting,
(d) evacuation.
(2) The elevators must be set up in housing houses with apartment entrances at level of the fifth and upper floors or attic at the same level. In the case of superstructures and condominiums, where the entrances to the apartments are at the level of the fifth above-ground floor or attic at the same level, elevators need not be set up even existing elevators to this floor.
(3) The design and dimensions of lift cages, shaft and cage doors of lifts referred to in paragraph 1 are set out in Czech technical standards. This shall be without prejudice to the requirements concerning the dimensions of the lift cage, the width of the shaft and the cage doors, the free space before the points of entry into the lift and the equipment of the lift cage intended for the carriage of persons with reduced mobility as specified in the separate Regulation (10).
(4) The layout and design of the lift machinery rooms are specified in Czech technical standards. The lift machinery spaces consist of either a separate fire station or a common fire station with an elevator shaft, if located above that shaft. The machinery spaces of evacuation and fire elevators shall be separated by fire from the machinery spaces of other elevators.

Transitional provision
The construction works for which the project documentation was processed before this decree was effective shall be treated in accordance with the existing legislation.
This decree shall take effect on the day of its publication.
