DECLARATION
of 9 December 2005
amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended
The Ministry of Transport provides, pursuant to § 46 (2) of Act No. 13 / 1997 Coll., on Road, as amended:
Decree No. 104 / 1997 Coll., implementing the Road Law, as amended by Decree No. 300 / 1999 Coll., Decree No. 355 / 2000 Coll., Decree No. 367 / 2001 Coll., Decree No. 555 / 2002 Coll., Decree No. 305 / 2005 Coll. and Decree No. 325 / 2005 Coll., are amended as follows:
1. in Article 14 (1) (a), a comma and the words "technical equipment and its components intended to measure, select and control the payment of the infrastructure charge shall be inserted after the words" road signs. "
2. Paragraph 26 (1), including footnote 8a, reads as follows:
"(1) The rest shall be built as part of motorways and express roads according to the nature of the operation and in accordance with the Czech technical standards listed in Annex 1. The rest is situated in areas outside the crossroads. The basic equipment of the break-off shall include parking areas for at least 25 passenger vehicles, 10 lorries, 4 buses, sanitary facilities with adequate capacity provided for by specific legislation8a) and continuous year-round operation, a source of drinking water and electricity, resting areas with tables, benches and garbage containers.
8a) For example Decree of the Ministry of Regional Development No. 369 / 2001 Coll., on general technical requirements for the use of buildings by persons with reduced mobility. "
3. in Articles 39 (2) (e) and 5 (d) and 51c (2) (d) and (e), the words "or names, as the case may be, shall be inserted after the word" name. "
4. In Article 39 (5) (f), the words "competent authority of the Czech Police" are deleted.
5. in § 40 (5) (b), (6) (b), (10) (b) and (11) (b), the words "birth number" are replaced by the words "date of birth, telephone."
6. § 47a, including the title and footnote 12a:
Definition of the continuously built territory of the municipality in the determination of the road protection zone
(Paragraph 30 (3) of the Law)
(1) The territory of the municipality which is built is a territory which fulfils the following conditions:
(a) there are 5 or more buildings in the territory to which a descriptive or registration number has been assigned and which are registered in the real estate register 12a);
(b) between adjacent buildings the distance is not more than 75 m.
(2) The boundary of the continuously built territory consists of a closed packaging line comprising a set of buildings referred to in paragraph 1 and located on the same side of the infrastructure.
(3) The contiguous territory of the municipality is defined only on the sides of the relevant infrastructure (motorways, roads or local roads of Class I and Class II), on each side of the relevant infrastructure separately.
12a) § 2 (1) (b) (1) of Act No. 344 / 1992 Coll., on the cadastral property of the Czech Republic (cadastral law), as amended. "
7. in Article 51c (2) (b), the words "axle pressures" are replaced by the words "immediate axle loads (10)."
8. in Article 51c (2) (c), the words "State recognition" shall be replaced by "registration."
9. in § 51c (3) (c) and (d):
"(c) data on the maximum permissible vehicle mass, the maximum permissible vehicle axle mass, the immediate vehicle mass and the measurement of vehicle dimensions and load;
(d) found to exceed the maximum permissible axle load and the maximum authorised mass as a percentage, ';
10. in § 51c (3) (f) and (g):
"(f) the name and, where applicable, the name, surname, date of birth, place of permanent residence of the driver of the vehicle, indication of the State;
(g) registration mark, factory mark and vehicle type, State distinguishing mark, ';
11. in Article 51c (3) (i):
"(i) the company of the carrier, including its registered office, identification number,"

13. Annex 9 to the Order reads:
"Annex No 9 to Decree No 104 / 1997 Coll.
Description and model of licences of persons responsible for the performance of the national supervision and supervision of roads
I. The ID of the person responsible for the performance of the national road surveillance authority and of the national highway and express roads shall have a rectangular shape of 70 x 100 mm and shall contain the following technological parameters and protective features:
1. Printing Technology: offset in combination with book printing
2. Colour: green reflective and black
3. Protective features:
3.1 embossing
3.2 guilloche
3.3 micropismo
3.4 in UV spectrum, illuminating colour
3.5 "Flower" price paper with water label positive x negative, containing two invisible fibres shining in UV spectrum
3.6. Transparent mark
3.7 numbering in black, green in UV spectrum.
4. The card with two-sided printed text according to the model below is heat-fixed to transparent foil (dimension 75 x 105 mm) to prevent damage to the licence by gluing the photograph and gluing it with a holographic adhesive (text CZECH REPUBLIC).
II. The card of the person responsible for the performance of the state surveillance shall be of rectangular shape with dimensions of 70x100 mm and shall contain the following technological parameters and protective features:
1. Printing Technology: offset in combination with book printing
2. Colour: blue reflective and black
3. Protective features:
3.1 embossing
3.2 guilloche
3.3 micropismo
3.4 in UV spectrum, illuminating colour

Transitional provision
The construction procedure concerning the construction of rest facilities initiated before the decree is effective shall be completed according to the existing regulations.
This Decree shall take effect on 1 January 2006.
