of 11 January 2002
amending Act No. 551 / 1991 Coll., on the General Health Insurance Company of the Czech Republic, as amended, Act No. 280 / 1992 Coll., on departmental, branch, corporate and other health insurance companies, as amended, and Act No. 592 / 1992 Coll., on Insurance against General Health Insurance, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on the General Health Insurance Company of the Czech Republic
Act No. 551 / 1991 Coll., on the General Health Insurance Company of the Czech Republic, as amended by Act No. 592 / 1992 Coll., Act No. 10 / 1993 Coll., Act No. 60 / 1995 Coll., Act No. 149 / 1996 Coll., Act No. 48 / 1997 Coll., Act No. 305 / 1997 Coll., Act No. 93 / 1998 Coll., Act No. 127 / 1998 Coll., Act No. 69 / 2000 Coll., Act No. 132 / 2000 Coll., and Act No. 220 / 2000 Coll., is amended as follows:
1. In Paragraph 6 (4), the words "Parliament's Chamber of Deputies after the Government has expressed 'are replaced by the words" Parliament's Chamber of Deputies after the date of consideration of the draft State budget and the State Final Account'.
2. In Article 24 (2), the second sentence is replaced by the following sentence, including footnote 8: "The use of information from the insurance undertaking's information system for other purposes may only be done in the manner and under the conditions laid down by this law or by a specific legislation. 8)

3. In Section 24, paragraph 3 is added, including footnote 8b:
"(3) (b) information on the health care provided to its insured persons who are registered with it by other medical devices, including the prescription of medicinal products and medical devices. This information shall be provided free of charge by the insurance company to the registrant.
8b) Paragraph 18 (3) (a) of Act No. 48 / 1997 Coll., on Public Health Insurance and on the amendment and addition of certain related laws. '.
Amendment of the Act on departmental, branch, corporate and other health insurance companies
Act No. 280 / 1992 Coll., on departmental, branch, corporate and other health insurance companies, as amended by Act No. 10 / 1993 Coll., Act No. 15 / 1993 Coll., Act No. 60 / 1995 Coll., Act No. 149 / 1996 Coll., Act No. 48 / 1997 Coll., Act No. 93 / 1998 Coll., Act No. 127 / 1998 Coll., Act No. 225 / 1999 Coll. is amended as follows:
1. In Paragraph 15 (2), the following shall be added at the end of the sentence of the first sentence: "following the dates of discussion of the draft State budget and the State Final Account '.
2. In Article 15, the following is added at the end of paragraph 3: "following the dates of the discussion of the draft State budget and the State Final Account '.
3. In Paragraph 21 (2), the second sentence is replaced by the following sentence, including footnote 20: "Use data from the occupational insurance company's information system for other purposes can only be done in the manner and under the conditions laid down by this law or by a specific legislation. 20)

4. In Article 21, the following paragraph 3 is added, including footnote 21:
"(3) The employer's insurance undertaking shall, on written request, submit information on the health care provided to its insured persons who are registered with it by other health care institutions, including the prescription of medicinal products and medical devices, to a medical practitioner or a child's practitioner. This information shall be provided free of charge by the occupational insurance undertaking to the registrant.
21) Paragraph 18 (3) (a) of Act No. 48 / 1997 Coll., on Public Health Insurance and on the amendment and addition of certain related laws. "
5. In Paragraph 22, the following sentence is added at the end of paragraph 2: "Such conduct is not the procedure of an occupational insurance undertaking in relation to courts and law enforcement authorities in the exercise of the rights of an occupational insurance undertaking under the law '.
Amendment to the General Health Insurance Insurance Act
Act No. 592 / 1992 Coll., on Insurance against General Health Insurance, as amended by Act No. 10 / 1993 Coll., Act No. 15 / 1993 Coll., Act No. 161 / 1993 Coll., Act No. 324 / 1993 Coll., Act No. 42 / 1994 Coll., Act No. 241 / 1994 Coll., Act No. 59 / 1995 Coll., Act No. 149 / 1996 Coll., Act No. 48 / 1997 Coll., Act No. 127 / 1998 Coll., Act No. 29 / 2000 Coll., Act No. 118 / 2000 Coll., Act No. 258 / 2000 Coll., Act No. 492 / 2000 Coll., and Act No. 138 / 2001 Coll., is amended as follows:
1. In Article 23, the following paragraph 2 is inserted after paragraph 1, including footnote 25c:
"(2) Data relating to individual natural or legal persons to whom the persons referred to in paragraph 1 become aware of their activities may be communicated to other bodies only if this law or specific legislation so provides. (c)
25c) For example, Act No. 551 / 1991 Coll., on the General Health Insurance Company of the Czech Republic, as amended, Act No. 280 / 1992 Coll., on departmental, branch, corporate and other health insurance companies, as amended, Act No. 101 / 2000 Coll., on the Protection of Personal Data and on the amendment of certain laws, as amended. "
Paragraphs 2 to 9 shall be renumbered paragraphs 3 to 10.
2. In Paragraph 23 (7), the second sentence is replaced by "paragraph 6 '.
EFFECTIVE
This Act shall take effect on the day of its publication.
