amending and supplementing Act No. 147 / 1983 Coll., on arms and ammunition
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Čl. I
Act No. 147 / 1983 Coll., on arms and ammunition is amended as follows:
1.
„§ 7
(1) Only persons over 18 years of age, civil integrity, physical, mental and professional competence for the use of a ball gun, may be issued an armaments licence provided that such person provides a guarantee that the weapons will not be misused. An armaments licence may be issued only for weapons intended for hunting or sporting purposes, or for weapons used in connection with the pursuit of a profession or profession, or in other cases of special concern for the protection of a person or property.
(2) The Federal Ministry of the Interior shall establish by decree which weapons shall be considered for the purposes of this Act as intended for hunting or sporting purposes and as being used in connection with the pursuit of a profession or profession.
(3) The provisions of paragraphs 1 and 2 shall also apply to the issue of authorisations for the possession and carrying of spherical weapons pursuant to Article 15 and to the issue of authorisations for transfers of ownership, transfer to use and lending of spherical weapons pursuant to Article 11, except as regards export weapons. "
2. the following paragraph shall be added after paragraph 3:
"(4) The district administration of the National Security Corps which has issued a mass permit for possession of spherical weapons shall withdraw that authorisation if the reasons for which it was issued cease to exist."
3. Paragraph 61 is renumbered paragraph 1 and paragraph 2 is added as follows:
"(2) A citizen may bring an appeal before the judge in accordance with paragraphs 7 and 8."
Čl. II
1. The arms licences issued by the District Administration of the National Security Corps before the date of application of this Act shall cease to be valid on 1 March 1990, with the exception of the ball gun licences intended for hunting or sporting purposes.
2. Holders of spherical weapons licences intended for hunting or sporting purposes shall be required to submit such weapons by 31 March 1990 for inspection by the district administration of the National Security Corps responsible for their permanent residence. If they fail to comply with this obligation, their arms licences shall cease to be valid on 31 March 1990.
3. Holders of ball and ball licences not intended for hunting or sporting purposes (point 2) are required to surrender ball and ammunition to the custody of the National Security Corps responsible for their permanent residence until 31 March 1990. Such persons may apply until 30 April 1990 for a new firearms licence; if they are not granted a new firearms licence, the provisions of Paragraph 53 (2) shall apply mutatis mutandis, with a period of two months being calculated from the date of the legal authority of the decision by which the request for a new firearms licence has not been granted.
4. Applications for a new arms licence, which have not yet been decided on at the date of entry into force of this Act, shall be assessed in accordance with Article 7, as amended by this Act. The same applies to the decision under Paragraph 8.
5. An organisation which has been issued a mass permit for possession of spherical weapons pursuant to Article 9 (1) shall be required to notify in writing, by 10 March 1990, to the district administration of the National Security Corps which issued such authorisation, the names, surname, address and birth numbers of its personnel or members who were responsible for the proper handling of the spherical weapons on 1 March 1990, as well as the personnel or members who carried them on that date.

This Act shall take effect on the day of its publication.
