on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland
on the construction of the road bypass of the cities of Český Těšín - Cieszyna
and establishing a new road border crossing
On 26 May 1986, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Polish People's Republic on the construction of the road bypass of the cities of Český Těšín - Cieszyn and on the establishment of a new road border crossing was signed in Szczecin. The Agreement entered into force on 10 October 1986 pursuant to Article 10 thereof.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the Polish People's Republic
on the construction of the road bypass of the cities of Český Těšín - Cieszyna
and establishing a new road border crossing
The Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland,
in order to protect the cities of Český Těšín and Cieszyn from the harmful consequences of car transport and improve the conditions of road traffic and border control
agree on the following:
1. The Contracting Parties will build a road tour of the cities of Český Těšín and Cieszyna on their territory and will establish a new road border crossing for all types of international road transport in 1986-1990.
2. The Contracting Parties undertake not to prejudice the current operation of the Czechoslovak-Polish state border by building a bypass.
1. Each Contracting Party shall build on its territory the objects used for common border control located on the exit and subsequent access communication.
2. The Polish People's Republic will build a common border bridge over the Olš River and part of the communication foothold in the territory of the Czechoslovak Socialist Republic.
The relevant foreign trade undertakings of the Contracting Parties shall conclude a contract on the construction of the objects referred to in Article 2.
The costs of building a common bridge over the Olše River shall be divided accordingly according to the length of the bridge in each Contracting Party. The costs of building the other buildings referred to in Article 2 shall be borne by each of the Contracting Parties in their territory.
1. The bridge construction will be deemed to have been completed on the basis of the takeover protocol.
2. A panel composed of four representatives of each Contracting Party shall be set up in order to prepare a protocol for taking over the work.
3. The bridge shall be owned by each Contracting Party in the part located within its territory. The bridge will be maintained by the People's Republic of Poland.
The competent authorities of the Contracting Parties shall, by special agreement, lay down the conditions for the maintenance of the bridge.
The security of the construction of the road bypass and border inspection facilities will be taken into account by the competent authorities of the Contracting Parties in the national economic plans for 1986-1990.
1. The Contracting Parties shall determine and communicate to each other, on the date of signature of this Agreement, which organisational and investment units are responsible for carrying out the tasks arising from the implementation of the Agreement, and shall at the same time communicate the composition of the Commission in accordance with Article 5 (2).
2. Organisational and investment units referred to in paragraph 1 shall coordinate and prepare a construction schedule, propose the date of opening a new road border crossing for operation and consult each other during construction and coordinate all issues related to the implementation of the Agreement.
3. In order to implement this Agreement, the Contracting Parties will use forms of cooperation within the Standing Czechoslovak Commission for Transport.
The day of the opening of the new road border crossing will be closed the crossing on the Bridge of Liberty and limited traffic on the crossing on the bridge of Družby in Český Těšín - Cieszyna in principle to small border traffic. The determination of the number and character of other road crossing points between the Czechoslovak Socialist Republic and the Polish People's Republic in the area concerned with a view to their possible reduction will be discussed by the competent authorities of the Contracting Parties no later than one year before the planned opening of the new road crossing point in České Těšín - Cieszyna.
All payments resulting from the provisions of this Agreement shall be made in accordance with the payment agreements between the Czechoslovak Socialist Republic and the People's Republic of Poland.
This Agreement shall be subject to approval under the laws of each Contracting Party and shall enter into force on the date of the exchange of notes confirming such approval. The Contracting Parties agree on the provisional application of the provisions of this Agreement from the date of its signature.
This Agreement shall be concluded for an unlimited period.
This Agreement was drawn up in Szczecin on 26 May 1986 in duplicate, each in the Czech and Polish languages, the two texts being equally authentic.
