amending and supplementing the Law on National Committees and regulating the competence of local national committees in central municipalities
The Czech National Council decided on this law:
Act No. 69 / 1967 Coll., on National Committees, as amended (Full version No. 28 / 1972 Coll., is amended as follows:
1.
"(1) In a municipality designated by the Regional National Committee on a proposal from the Regional National Committee as a centre municipality (hereinafter referred to as the Centre Municipality), the local National Committee shall operate with extended scope.
(2) With the consent of citizens, a local national committee may be set up for several municipalities; the national district committee shall decide on this measure on a proposal from local national committees.
(3) The Regional National Committee may, on a proposal from the District National Committee, determine that the local national committee for several municipalities has jurisdiction as a local national committee in a central municipality. "
2.V § 13
the provisions of point (a) are as follows:
'(a) the local national committee had at least:

| 25 poslanců v obcích do | 5000 obyvatel, |

the following point (b) is inserted after point (a):
"(b) the local national committee in the centre municipality or the municipal national committee had at least:

| 30 poslanců v obcích do | 2 500 obyvatel, |
| 35 poslanců v obcích do | 5 000 obyvatel, |
| 50 poslanců v obcích do | 10 000 obyvatel, |
| 60 poslanců v obcích do | 20 000 obyvatel, |
| 80 poslanců v obcích do | 50 000 obyvatel, |
| 85 poslanců v obcích nad | 50 000 obyvatel;“. |
Points (b), (c), (d) and (e) shall be renumbered as points (c), (d), (e) and (f).
3. The heading of Section 25 "Local National Committee" shall be preceded by the numerical description of this section and its paragraph 2 (b). (c) read as follows:
"(c) give consent to the distribution of outlets, fix sales times and take measures to ensure the proper supply of the population;"
4. The following Section 25a is inserted after Section 25:
Local National Committee in the Centre Municipality outside its competence under § 25
(a) establish, manage and abolish small establishments and, as provided for, the undertaking of services providing essential services to citizens and equipment or to the organisation for the administration and maintenance of household property, where this is appropriate in view of the extent of such property;
(b) express its views on the proposals for the development of the district, the medium and implementation economic plans and the budget of the District National Committee; the district national committee is obliged to discuss these proposals with local national committees in central municipalities and to inform them of the approved concepts, economic plans and budget and their implementation;
(c) in relation to organisations managed by national higher-education committees
1. Requires reports on their activities when they affect the living conditions of the municipality population and the tasks of the local national committee in developing its territory;
2. Calls on organisations to make amends for the detection of shortcomings in their activities where there has been a breach of socialist legality or of social interests, thereby jeopardising the legitimate needs or living conditions of the community population; the organisation is obliged to notify the national committee within the time limit specified by it of how and until when it ensures the removal of the deficiencies;
3. Calls on the organisation of the imposition of a disciplinary measure or other penalty to the worker responsible for the deficiencies which have not been remedied within the time limit notified by the organisation to the National Committee;
4. Gives consent to the location and start-up of new establishments or facilities and to the extension, restriction or cancellation of services; establish, after consultation with the organisation and the competent authority of the Revolutionary Trade Union Movement, operational periods for the provision of services to citizens;
5. Expresses its views on the proposals for provisions and appeals of heads of establishment and establishment; in the event of serious or repeated deficiencies in the operation of establishments and installations, may propose the removal of their heads of office;
(d) in relation to centrally managed economic, cooperative and other organisations:
1. has the authorisations referred to in points (c) 1, 2, 3 and 4;
2. Suggests the district national committee to suspend the enforcement of a resolution or other measure of a single agricultural cooperative contrary to the laws or statutes of a single agricultural cooperative with a cooperation agreement or establishing a common agricultural holding;
3. express its views on the granting of authorisations to a single agricultural cooperative to carry out associated production on the territory of the centre municipality;
4. Suggests the Regional National Committee to call for an extraordinary meeting of a single agricultural cooperative to discuss serious questions concerning the interests of the centre municipality. ';
5. In Paragraph 26, the following paragraph 3 is inserted after paragraph 2:
"(3) The Municipal National Committee shall also exercise the responsibility of the local national committee in the central municipality (§ 25a)."
Paragraphs 3, 4 and 5 shall be renumbered paragraphs 4, 5 and 6.
6. Article 64 (1) reads as follows:
"(1) Urban national committees and district national committees as well as local national committees in central municipalities shall establish civil committees. Local national committees in other municipalities may set up civil committees, if the size of the territory and the special conditions of economic and cultural development so require. Citizens shall elect members of civil committees at public gatherings for a period of five years. ';
The Act of the Czech National Council No. 130 / 1974 Coll., on State Administration in Water Management, is amended as follows:
1. the introductory phrase of Paragraph 3 (2) shall read as follows:
"(2) Local national committees in central municipalities and local national committees, if not border flows, '.
2. In Article 3, the following paragraph 3 is inserted after paragraph 2:
"(3) Local national committees in other municipalities may exercise the powers referred to in paragraph 2 only under the responsibility of the Regional National Committee, issued after consultation with the relevant District National Committee in cases where conditions are necessary. ';
3. Paragraph 3 (3) becomes paragraph 4.
Act of the Czech National Council No. 129 / 1975 Coll., on the jurisdiction of the Czech Socialist Republic bodies in social security, is amended as follows:
1. In Article 5 (1), the following sentence is added at the end: "Local national committees in central municipalities and municipal national committees may set up family and child care committees as administrative committees."
2. Paragraph 14 shall become paragraph 1 and the following paragraph 2 shall be added:
"(2) The local national committee in the central community and the municipal national committee, if set up by its family and child care committee,
(a) decide:
1. the warning of a minor, his parents and citizens who undermine his proper education;
2. establishing the supervision of minors,
3. imposing restrictions on minors to prevent harmful effects on their education;
(b) carry out tasks in coordinating the work of the family and child care authorities. ";
Act of the Czech National Council No. 77 / 1978 Coll., on State Administration in Education, is amended as follows:
1. the following paragraph 4 is added to Article 5:
"(4) Local National Committee in the Centre Municipality, other than those referred to in paragraphs 1 to 3, with the agreement of the District National Committee
(a) establish and abolish primary schools;
(b) determine the school and school establishments which it establishes. "
Article 6 (1) reads as follows:
"(1) The municipal national committee shall exercise, outside the competence of the local national committee in the central municipality (§ 5 (4)), the competence which pursuant to § 10 (1) otherwise falls to the district national committee. '
3. In Article 7, paragraph 1 (b), after the words "primary school ', the words" unless Article 5 (4) otherwise' are inserted and in paragraph 3 (a), the reference to "(Article 5 (1)) 'is replaced by a reference to" (Article 5 (1) and (4)'.
(4) Paragraph 8 shall be added at the end by the following words: "unless Article 5 (4) otherwise applies."
Act No. 60 / 1961 Coll., on the tasks of the National Committees in the provision of socialist order, as amended, is amended as follows:
Paragraph 20 (4) reads as follows:
"(4) The offence shall be dealt with by the authority of the national committee in whose field the offence has occurred. Regional national committees, district national committees, urban national committees and district national committees, as well as local national committees in central municipalities, may, as an administrative commission, set up commissions for dealing with all or certain offences. The members of these commissions shall be elected by the National Committee from among its Members and other citizens, in particular those proposed by social organisations. The chairman of the Commission shall be the Member of the National Committee. The Commission shall act and act in a three-member composition and shall act by a majority of votes. ';
Local national committees in central municipalities shall be transferred to the regional national committees listed in the Annex to this Act.
This Act shall take effect on 1 July 1982.
